Prior Lake, MN 55372-1714 RESOLUTION 05-93 APPROVING THE FINAL PLAT OF "STEMMER RIDGE" AND DEVELOPMENT CONTRACT AND SETTING FORTH CONDITIONS TO BE MET PRIOR TO RELEASE OF THE FINAL PLAT. MOTION BY: Petersen SECOND BY: Fleming WHEREAS: on December 6, 2004, the City Council approved the preliminary plat known as Stemmer Ridge, subject to conditions identified by Resolution 04-179; and WHEREAS: The City Council has found that the final plat of "Stemmer Ridge" is in substantial compliance with the approved preliminary plat for Deerfield; and WHEREAS: The City Council has approved the final plat of "Stemmer Ridge Addition." NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it should and hereby does require the following conditions to be met, pdor to release of, and recording of said plat: . f, The recitals set forth above are incorporated herein as if fully set forth. The final plat of "Stemmer Ridge" is approved subject to the conditions set forth in this resolution: The final plat of "Stemmer Ridge" is subject to the following conditions, which shall be met pdor to release of and recording of the final plat: a. Approval of the final plat and development contract is contingent upon approval of the Cooperative Agreement with Scott County. b. The Developer must submit deeds for all of the outlots to be conveyed to the City with the final plat documents. These deeds must be recorded with the final plat. c. A current title opinion or commitment of title insurance is submitted acceptable to the City Attorney. d. Payment of all fees pdor to release of the final plat mylars. e. Reductions of the entire final plat be submitted, to the following scales: 1" = 800'; 1" = 200'; and one reduction at no scale which fits onto an 81/2" x 11" sheet of paper. Four mylar sets of the final plat with all required signatures are submitted. The developer provides financial security, acceptable to the City Engineer prior to release of the final plat mylars. The final plat and all pertinent documents must be filed with Scott County within 90 days from the date of final plat approval. Failure to record the documents by September 6, 2005, will render the final plat null and void. Mayor and City Manager are hereby authorized to execute the Development Contract on behalf of the City. 4. The Passed and adopted this 6th day of June, 2005.
