CONSIDER APPROVAL OF A RESOLUTION APPROVING
THE COMMON INTEREST COMMUNITY NUMBER 1151
(TOWER PLACE CONDOMINIUM) CIC PLAT
DISCUSSION:
Historv: The Tower Hill Apartments, a 68-unit building, was built in
1986. Since then, the building has been under single ownership with
rental units.
Current Circumstances: The current owner of the building, Meridian
Management, Inc., is requesting approval of a Common Interest
Community (CIC) plat. The purpose of a CIC plat is to allow the
subdivision of the 68-unit apartment building into lots for each
individual unit. These lots may be sold to individual owners, or be
rented. Essentially, the plat creates a lot around the four walls of an
individual unit. CIC plats are typically done following the actual
construction of the buildings in question. The CIC plat does not
change the number of units or the density of the development.
The Issues: CIC plats do not require a development contract. The
required developer improvements were included under a previous final
plat, so no Letter of Credit is necessary. In addition, the City fees
normally associated with a final plat have been collected under the
previous Development Contracts.
Conclusion: A copy of the CIC plat is attached to this report. Staff
will be available to discuss the details of this plat with the Council.
FISCAL IMPACT:
Budeet Imoact: There are no budget impacts with the approval of this
CIC plat since the building has already been built.
ALTERNATIVES:
The City Council has three alternatives:
1. Adopt a Resolution approving the Common Interest Community
Number 1151 (Tower Place Condominium) CIC Plat.
2. Deny the resolution approving the CIC plat.
3. Defer this item and provide staffwith specific direction.

The staff recommends adoption of Alternative # 1 as part of the consent
agenda.
A motion and second to adopt a resolution approving the Common
Interest Community Number 1151 (Tower Place Condominium) CIC
Plat and authorizing the Mayor and City Manager to sign the CIC plat
documents is required.

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE COMMON INTEREST
COMMUNITY NUMBER 1151 (TOWER PLACE CONDOMINIUM) CIC PLAT

WHEREAS: The Tower Hill Apartments were built in 1986 as a 68-unit building; and
WHEREAS: the Tower Hill apartment building is located on an existing, platted lot; and
WHEREAS: The City Council has found that the Common Interest Community Number 1151
(Tower Place Condominium) CIC Plat is in compliance with the existing building and
does not change the number of units or density of the site; and
WHEREAS: The City Council has approved the Common Interest Community Number 1151
(Tower Hill Condominium) CIC Plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR
LAKE, MINNESOTA, that it should and hereby does require the following conditions to be met, prior to
release of, and recording of said plat:
1. The recitals set forth above are incorporated herein as if fully setforth.
2. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the
date of final plat approval. Failure to record the documents by August 20, 2005, will render the CIC
plat null and void.
3. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
