RESIDENTIAL (R-2) TO SPECIALTY BUSINESS (C-3)

Historv The City Council initiated a Zoning Map
Amendment to change the use district from R-2 (Low to
Medium Density Residential) to C-3 (Specialty Retail) on
property located at 4600 through 4626 Dakota Street. The
property has been identified as C- TC (T own Center) on the
2030 Comprehensive Land Use Plan, recently approved by
the City Council.
The City is in the process of purchasing each of these
properties. In order to construct the new City Hall on the
proposed site, with the proposed setbacks, the property must
be rezoned.
The Planning Commission considered this rezoning at a
public hearing on June 13, 2005. The Planning Commission
recommended approval of the Zoning Map Amendment
because it is consistent with the Comprehensive Plan
designation.
Current Circumstances: The following are the physical
characteristics of the subj ect property.
Total Site Area: The total site is 1.92 acres.
Topography: The topography of this site rises 40' from the
low point (the wetland) on the west to the highest elevation,
964' MSL, at Dakota Street. This property is not located

within the Shoreland District, so the steep slopes are not
classified as a bluff.
Vegetation: There are 3 existing dwellings and outbuildings
on this site. There are also some trees on the site, especially
on the slopes.
Wetlands: There is a wetland located at the northwest comer
of the site.
Access: Access to the site is from Dakota Street on the south
side of the property.
Utilities: Sewer and water services are available to this site
from the existing services in Dakota Street.
Adiacent Zoning and Land Use Plan designations: The
following table details adjacent zoning and comprehensive
plan designations:

Issues: In anticipation of the construction of the new City
Hall, the zoning map must be amended to be consistent with
the C- TC land use designation on the 2030 Comprehensive
Land Use Plan Map. The C-3 use district is consistent with
the C- TC comprehensive plan land use designation.
Section 1108.600 of the Zoning Ordinance identifies the
following policies for amendments to the Official Zoning
Map:
. The area, as presently zoned, is inconsistent with the
policies and goals of the Comprehensive Plan, or the land
was originally zoned erroneously due to a technical or
administrative error, or
. The area for which rezoning is requested has changed or
is changing to such a degree that it is in the public

interest to rezone so as to encourage redevelopment of the
area, or
· The permitted uses allowed within the proposed Use
District will be appropriate on the subject property and
compatible with adjacent properties and the
neighborhood
The current R-2 zoning of the property is inconsistent with
the C-TC land use designation on the 2030 Comprehensive
Land Use Plan Map. The proposed C-3 zoning is the only
zoning use district consistent with the C- TC designation.
Accordingly the requested zoning map amendment will carry
out the goals, objectives, and policies set forth in the
comprehensive plan.
The proposed C-3 zoning is consistent with the C-TC land
use designation on the 2030 Comprehensive Land Use Plan
Map. Based upon the findings set forth in this report, staff
recommends approval. The Planning Commission supported
staff's recommendation.
The City Council has two alternatives:
1. Adopt an ordinance approving the rezoning as requested.
2. Defer consideration of this item and provide staff with
specific direction.
Staff recommends Alternative # 1. This action requires the
following motions:
1. A motion and second adopting an ordinance rezoning the
property located at 4600 through 4626 Dakota Street
from R-2 (Low to Me 'urn Density Residential) to C-3

AN ORDINANCE AMENDING SECTION 1101.700 OF PRIOR LAKE CITY
CODE AND THE OFFICIAL ZONING MAP FOR THE CITY OF PRIOR LAKE

The City Council of the City of Prior Lake does hereby ordain:
1. The Prior Lake Zoning Map, referred to in Prior Lake City Code Section
1101.700, is hereby amended to change the zoning classification of the
following legally described property from R-2 (Low to Medium Density
Residential) to C-3 (Specialty Business).
LEGAL DESCRIPTION:
Lots 1, 2, 7, 8, 9, 10, 11 and 12, Block 8, Prior Lake, according to the plat
thereof of record in Scott County, Minnesota, together with vacated streets
and alleys abutting thereto; together with:
The east 120 feet of Lots 3, 4, 5 & 6, Block 7, Prior Lake, according to the
plat thereof of record in Scott County, Minnesota, except the west 75 feet of
said east 120 feet; together with vacated streets and alleys abutting thereto.
This ordinance shall become effective from and after its passage and
publication.
