It has been brought to our attention that there is potential for Scott County to use Right of Way/Eminent Domain in order to take our neighbors houses and to put in an unnecessary, expensive, and previously unplanned road that would connect The Harbor Community to Rutgers Street NE. We vehemently oppose this proposal. It is not responsible, and makes no sense to spend taxpayer's money on purchasing these expensive homes,to displace our neighbors, and to disrupt our community for a road that is not even necessary. This proposal will add a substantial cost to the overall project. This proposal also produces many safety concerns and unreasonable implications for our neighborhood and community. We respectfully request that the original proposed, studied, and publicly presented plan of right in,right out access to County Road 42 from the Harbor be chosen and implemented. Over 50%see new construction 1101.102 pg.1 (2) Promote the most appropriate and orderly development of the residential, business, industrial, public land and public areas. 1102 pg. 43 Attached Structure An accessory structure shall be considered attached, and an integral part of, the principal structure when it is structurally connected to the principal structure or located 6 ft. or less from the _principal structure. Such structures shall be subject to the provisions of this Ordinance applicable to principal structures including, but not limited to , setbacks, bldg. ht., and other dimensional requirements. 1101.300 (3) pg.3 The word "shall" is mandatory, and the word "may" is permissive 1101.304 pg. 4 Effect This ordinance shall be construed, if possible,to give effect to all provisions in the ordinance. When the words of this ordinance in their application to an existing situation are clear and free from all ambiguity, the letter of this ordinance shall not be disregarded under the pretext of pursuing JJ the spirit. When the words of this ordinance are not explicit,the following factors may be considered. (There are 7 items.her but I am only siting one.) *The Consequences of a particular interpretation* 1101.306 pg.4 Provisos Provisos shall be construed to limit rather than to extend the operation of the clauses to which they refer. Exceptions expressed in this ordinance shall be construed to exclude all others. 1101.313 pg.6 Application (1) Minimum Requirements 2) More Restrictive Applications. Where the conditions imposed by any provision of this ordinance are either more or less restrictive than comparable conditions imposed by any other applicable law, ordinance or statute of any kind,the law, Ordinance, or statute which is most restrictive or which imposes the higher or more restrictive standards or requirements shall control. 1101.503 pg.30 Yard Encroachments (6) b.The vestibule area, measured from the outside of the outside walls shall nit exceed 30 sq. ft. (9) Decks not meeting the required setbacks were established; The deck existed on the date the structure setbacks were established The replacement deck is in the same size, configuration, location and elevation as the deck in existence at the time the structure setbacks were established 1104.300 pg.4 Zoning Provisions Where the requirements of the underlying zoning district as shown on the official zoning map are more restrictive than those set forth herein,then the more restrictive standards shall apply. 1104.308 pg.12 (2) Setback Requirements for Residential Structures: On shore land lots that have 2 adjacent lots with existing principal structures on both such adjacent lots, any new residential structure or any additions to an existing structure may be set back the average setback of the adjacent structures from the ordinary high-water mark or 50 ft. whichever is greater, provided all other provisions of the shore land overlay district are complied with. In no instance shall a principal structure be located in a shore impact zone or a bluff impact zone. 1104.404 pg.20 Storm Water Management: (1)When possible, existing natural drainage ways, wetlands, and vegetated soil surfaces shall be used to convey, store,filter storm water runoff before discharge to public waters. (3) Preference shall be given to designs using surface drainage, vegetation, and infiltration rather than buried pipes and man-made materials and facilities. 1105.401 pg.3 Flood Plain Regulations Residence and other structures constructed on fill so that the basement floor or first floor, if there is no basement, is at or above the flood protection elevation.(906 flood on record from 2014, so elevation has to be 909)the finished fill elevation shall be no lower than 1 ft. below regulatory flood protection elevation and shall extend at such an elevation at least 15 ft beyond the limits of any structure or bldg. erected thereon. 1108.403 pg. 11 The Board of Adjustment shall consider the requirements of all other applicable State Statutes. 1108.406 pg.11 Decisions on variance (1) Practical difficulties, as used in connection with granting a Variance, means the property owner proposes to use the property in a reasonable manner not permitted by the Zoning Ordinance. Economic considerations alone do not constitute practical difficulties. (3) The practical difficulty is not a mere convenience to the property owner and applicant. (4) The granting of the variance will not alter the essential character of the neighborhood 1108.408 pg.12 Conditions and Modifications 2 In granting a variance, the Board of Adjustment may impose such reasonable and appropriate conditions and safeguards as may be necessary to accomplish, to the extent possible under the circumstances,the purposes of the regulations or provisions which are to be varied or modified and to ensure compliance and protect adjacent properties,the character of the neighborhood, and health, safety, or general welfare of the community. Any conditions must be directly related to and must bear a rough proportionality to the impact created by the Variance. 3 League of Minnesota Cities Zoning Guide for Cities 1/20/2015 pg.5 subd.6. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. Pg.9 The Municipal Planning Act has specific provisions related to local zoning control of:There are 12 items. The twelfth being Solar Energy Systems Pg.13 Legislative authority must be reasonable and free from arbitrariness or discrimination.
