HomeMy WebLinkAbout16-049 15947 Sunfish TrailPRIp 60 4646 Dakota Street SE diNNEso'tP Prior Lake,MN 55372 RESOLUTION 16-049 A RESOLUTION DECLARING THE STRUCTURES ON THE PROPERTY LOCATED AT 15947 SUNFISH TRAIL SE HAZARDOUS STRUCTURES PURSUANT TO MINNESOTA STATUTES SECTIONS 463.15 TO 463.261, MINNESOTA STATE BUILDING CODE AND CITY CODE SECTIONS 605 AND 609 AND ORDERING THE STRUCTURES BE REPAIRED, RAZED OR REMOVED Motion By: Morton Second By: Thompson WHEREAS, for the protection of the public health, safety and welfare Minnesota Statues Sections 463.15- 463.261, Minnesota State Building Code and Prior Lake City Code Sections 605 and 609 establish maintenance and health and safety standards and provide that structures which fail to comply with those standards are to be declared hazardous and shall be repaired, razed or removed; and, WHEREAS, Mark S. Coffman ("Coffman") is the record owner of the Premises;and, WHEREAS, there is a single family dwelling structure and a garage structure located on the Premises. The Premises and structures were visually inspected by City staff from the public right of way on November 3, 2015, November 6, 2015, and January 5, 2016. City staff observed that the structures on the Premises were in disrepair including a damaged roof, an approximately 3 foot by 4 foot hole in the roof, large pieces of what appears to be burned and missing siding, rotting wood, missing windows, and a general lack of maintenance;and, WHEREAS, The City's Code Enforcement Officer provided notices to Coffman on November 12, 2015 and November 23, 2015, attached as Exhibit A, identifying the City Code violations on the Premises and directing that the violations be remedied; and, WHEREAS, The violations were not remedied;and, WHEREAS, the City obtained an administrative search warrant for the Premises. The warrant, application and supporting affidavit are attached as Exhibit B;and, WHEREAS, on March 3, 2016, City staff inspected the Premises pursuant to the warrant. The inspection confirmed the extensive deterioration of the structures, including the following specific violations of Minnesota Statutes Sections 463.15-463.261, Minnesota State Building Code and Prior Lake City Code Sections 605 and 609: Lack of maintenance of both structures; Lack of structural stability resulting in likely collapse of both structures; Failing and detached walls and roof on the single family dwelling; A large hole through the roof in the single family dwelling; Wrack, warped and buckled roofing on the single family dwelling; The presence animal excrement and piles of garbage in the interior of both structures; Mold in the floor and ceiling of both structures; and Deterioration of both structures allowing direct access for moisture, rodents and trespassers;and, WHEREAS, the inspection of the Premises revealed that the structures are uninhabitable, dangerous to the neighborhood, public nuisances and hazardous structures all pursuant to Minnesota Statutes Sections 463.15-463.261, Minnesota State Building Code and Prior Lake City Code Sections 605 and 609;and, WHEREAS, The Scott County Health Officer accompanied City staff during the inspection on March 3, 2016. The Health Officer confirmed by email, attached as Exhibit C, that the single family dwelling is a health hazard;and, WHEREAS, the Building Official provided notice to Coffman on March 7, 2016 identifying the violations on the Premises and directing that the violations be remedied. The notice and supporting photographs are attached as Exhibit D;and, WHEREAS, the notice required the violations to be corrected by April 7, 2016;and WHEREAS, to date Coffman has failed to correct the violations;and, WHEREAS, pursuant to Minn. Stat. §463.16, the City Council of Prior Lake has the authority to order the owner of any hazardous structure to repair, raze or remove the structures and to take action to repair, raze or remove the structures if the property owner fails to do so. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: FINDINGS 1. The recitals set forth above are incorporated herein. 2. The City Council, based upon the above recitals and attached Exhibits finds that the single family dwelling and garage structures located on the Premises are in violation of Minnesota Statutes Sections 463.15-463.261, Minnesota State Building Code and Prior Lake City Code Sections 605 and 609 and constitute hazardous structures. ORDER The City Council declares, determines and orders as follows: 1.Coffman shall repair, raze or remove the single family dwelling and garage structures on the Premises by May 11, 2016. 2.The repair, removal or razing of the structures shall be completed in compliance with all applicable codes and regulations and pursuant to proper permits from the City. 3.Unless Coffman files an answer within the time specified in Minn. Stat. §463.18, or repairs, razes or removes the hazardous structures to the City's satisfaction by May 11, 2016, then the City Attorney is authorized to enforce this Order, including bringing a motion for summary enforcement to the district court to raze the structures. 2 4.The City shall assess against the Property all costs and fees, including but not limited to court costs, demolition costs, attorneys'fees, and engineering or consulting fees that are in any way related to this Order or its enforcement.
