HomeMy WebLinkAbout5I Pike Lake Plat Extension 4646 Dakota Street SE Prior Lake, MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: APRIL 25, 2016 AGENDA #: 5I PREPARED BY: JEFF MATZKE, PLANNER PRESENTED BY: JEFF MATZKE AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION EXTENDING THE DEADLINE FOR SUBMITTING THE FINAL PLAT FOR PIKE LAKE DISCUSSION: Introduction The purpose of this agenda item is to consider a request by Ron Clark Construction to extend the deadline for submitting a Final Plat for the Pike Lake development. The site is located at the northwest corner of the Pike Lake Trail and County Highway 42 intersection. History On May 26, 2015 the City Council approved Resolution 15-095 approving the Preliminary Plat for Pike Lake as a 68-unit affordable rental housing development. Current Circumstances In accordance with Subsection 1102.206 “once a preliminary plat is approved by the City Council, a subdivider must submit an application for a final plat within twelve (12) months after approval of the preliminary plat.” The City Council can, however, allow by resolution an extension of this submittal deadline as long as such a request by the subdivider is received 30 days prior to the expiration of the 12-month period. Ron Clark Construction, the developer, is requesting an extension of the deadline for submitting the final plat for Pike Lake, which is May 26, 2016. Conclusion City Staff believes the request to extend the submittal deadline for a period of one year appears reasonable in this case. Ron Clark submitted an application to Minnesota Housing for Housing Tax Credits (HTC) in June of 2015. They were not awarded credits in the competitive program, but they are applying a second time this year; a decision will be made by Minnesota Housing on this year’s round of HTC in October of 2016. ISSUES: The purpose of the requested Final Plat submittal deadline extension is to allow the developer additional time to apply and receive confirmation of HTC during 2016. If the developer fails to meet this extended deadline, the Preliminary Plat approval will become null and void. FINANCIAL IMPACT: This action has no direct financial impact; however, the successful completion of the development will result in the construction of additional (multi-family) housing units within the City. ALTERNATIVES: 1. Motion and a second, as part of the Consent Agenda, to approve a resolution extending the deadline for submitting the Final Plat for Pike Lake until May 26, 2017. 2. Remove this item from the consent agenda to deny the request to extend the Final Plat deadline for Pike Lake. RECOMMENDED MOTION: Alternative #1. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2.
