LEASE OF PARKING AREA AGREEMENT
Recitals:
The Church of St. Michael of Prior Lake, a Minnesota religious corporation ("St.
Michael's"), owns a parcel of land (among others) in Scott County, Minnesota,
located generally on the Northwest comer of Pleasant Street and Duluth Avenue next to the
Church Education Building, in the City of Prior Lake, containing approximately 56 marked
parking spaces (the "Church lot").
Ballard-Sunder Funeral Home ("Ballard Sunder") owns a parcel of land in Scott County,
Minnesota located about ½ block East of the Church lot, 4565 Pleasant Street SE, in the City of
Prior Lake, containing approximately 20 marked parking spaces. ( The "Ballard-Sunder lot").
Both St. Michael's and Ballard-Sunder maintain these paved parking lots for the use of
their customers, guests, parishioners and invitees. The hours of operation and use differ in that
the busiest time at the Church is Saturday afternoon and evening and Sunday mornings, while the
Funeral Home is generally closed at that time. Conversely, the busiest time for the Funeral
Home is during the week, when the church does not generally have large functions scheduled.
Therefore, the parties have agreed to enter into this Lease Agreement to allow the each
other to use their parking lot during those busiest times.
NOW, THEREFORE, St. Michael's does hereby lease from Ballard-Sunder for $1 00 per
year the right for its parishioners, guests and invitees to park up to 20 cars in the Ballard-Sunder
lot from Saturday at 4:00 p.m. through Sunday at 1:00 p.m., and on Christmas Eve and
Christmas Day.

In return, in the event Ballard-Sunder needs additional parking,
St. Michael's Church will allow Bailard-Sunder's customers, guests and invitees to park
up to 56 cars in the Church lot during the normal business hours of the funeral home.
IT IS FURTI-I~R AGREED AS FOLLOWS:
1. Each party shall be responsible for ail maintenance, repairs, plowing and sanding
as necessary on its own property. Each party shail hold the other harmless from and against all
claims, liabilities, damages, costs and expenses, injuries to the property and/or to persons, arising
out of each other's use of the described parking lots.
2. Each party shall obtain and maintain their own policy of general liability
insurance naming the other as an additional insured.
3. This Agreement shall be binding on and inure to the benefit of each party's
successors and assigns.
4. This Agreement may be terminated by either party by giving 30 days notice in
writing, to the other party. Otherwise it shail automaticaily renew, on the yearly anniversary
date, for an additi.'onal year.

Review of Church of St. Michael Expansion Project
WSB Project No. 1430-13
As requested, we have completed our water resource review of the plans dated March 22,
2002 for the Church of St. Michael expansion project. Based on our review, we offer the
following comments: :
Wetland Conservation Act Review Comments
1. The site plans show two areas labeled as "edge of low area" to the south and west of
the parking lot. Based on a brief field review on April 30, 2002, these areas appear to
be jurisdictional wetland. Further, the National Wetland Inventory also identifies
these areas as wetlands. The wetlands will need to be delineated in conformance with
the Wetland Conservation Act, the wetland edge will need to be identified on the
plans, and the delineation will need to be field reviewed by the City. If the parking
lot expansion is anticipated to fill a portion of the wetland, wetland mitigation will
need to be provided.
If these areas are jurisdictional wetland, the City requires a 30-foot buffer to be
included around the wetlands for those portions of the wetland on the church
property.
Hydrologic/Hydraulic. Water Quality? and Grading Comments
2. There is no treatment provided for the runoffbefore it enters the infiltration basin.
This treatment may be necessary.

3. The infiltration basin may be in an area that is currently a wetland. Water table depth
and the presence of organic soils may affect the ability of the infiltration basin to
function effectively. A wetland delineation is needed to verify the placement of this
infiltration basin.

The DRC will now begin formal review of this request. We will notify you of any

we will schedule a DRC meeting with you to review this application. In accordance with
Section 1108.900 of the City Zoning Ordinance, the Planning staff will notify you within

1. Low land to the immediate south of the site will be protected with a soil berm just off
the entire south edge of the parking area. The berm location with respect to
topography is to be verified by the final survey to be provided by the applicant before
permit issuance.
2. Berm is to be smooth graded and seeded.
3. Applicant/owner is to maintain the berm and associated area such that it retains initial
site runoff and allows infiltration.
This is not a permit. If this project is approved, the owner/applicant is required to obtain
an actual permit prior to starting construction.

During the construction phases of the project and until the total site is
stabilized, erosion control is required to be maintained around the
downstream perimeter of the site.
The design meets the stormwater requirements of the District. This will be
accomplished by the retention and infiltration of runoff resulting from at
least the 0.5 inch rain on the incremental impervious area (0.37 acres).

1. All provisions of the Minnas~a Watershed Act, Overall Plan and Rules of the District, and the General Conditions of the Permit Application,

Introduction
The proposed building expansion to the Church of St. Michael has created the need for
additional parking in order to comply with the City of Prior Lake's ordinances. As a
result, the total impervious cover of the site will increase by 0.37 acres. The proposed
impervious surfaces would flow across a strip of grass directly into the adjacent
municipal stormwater pond. Rule "D" requires that best management practices be used
to infiltrate the rtmoff from the impervious areas to the extent feasible considering site-
specific conditions. Accordingly, the Church proposes to construct a containment berm
along the municipal pond high water line to trap stormwater runoff from the expanded
parking lot. Stormwater would be allowed to pool up to a depth of 1.3 feet before
overflowing the principal spillway. The pool behind the berm caused by one-half inch of
runoff would drain dry over a 72 hour period by infiltration into the underlying soils.
Underlying soils are classified according to the "Soil Survey of Scott County" published
by the U.S. Department of Agriculture. These soils are identified as Estherville gravelly,
sandy loam (Eb) and Lakeville- Bumsville gravelly sandy loam (Lb). Both of these
soils fall into Hydrologic Group "B."
The infiltration hydraulics for one-half inch of runoff from the proposed impervious area
are calculated by the HydroCad® Stormwater Modeling System program. In addition,
the 2-year, 10-year and 100-year rainfall events are modeled in order to evaluate the
proposed pond and spillway design. Copies of the computer model input and output are
attached. Also attached is the Concept Stormwater Management Plan.
Conclusions and Recommendations
One-half inch of runoff from the proposed building and parking surfaces will produce a
volume of 0.19 acre-feet. The proposed infiltration basin will assimilate this volume in
72 hours. Rainfall events that produce more than one-half inch ofrtmoffwill safely pass
over the principal spillway. The peak flood elevation of the infiltration basin would be
922.0 as a result of the 100-year, 6"-24 hour storm. The entrance to the Church was
measured at 926.1, providing a minimum vertical separation of 4.1 feet.
In consideration of the foregoing, it is our opinion that the proposed infiltration basin as
designed meets or exceeds the requirements of Rule "D.'
