History The City Code provides that the City Council may approve the renewal of annual on-sale intoxicating, Sunday liquor, off-sale intoxicating, on-sale wine, off-sale 3.2 malt liquor, on-sale 3.2 malt liquor, and club licenses. State statute requires that all licenses must expire on the same date, June 30 of each year. Current Circumstances All applicants have submitted the required documentation to renew their licenses. They have provided proof of liquor liability insurance. Prior Lake City Ordinance 301.600 states that no license shall be granted for operation on any premises for which taxes, assessments or other financial claims of the City are delinquent or unpaid. The Scott County Treasurer’s records and City records show that all property taxes and money owed to the City are current. Conclusion The Prior Lake Police Department has conducted an investigation and has reported that in the past five years the following establishments have been cited with selling alcohol to minors: 2015 – Memories on Main 2014 – PL Baseball Association, Memories on Main 2013 – The Pointe 2012 - None 2011 - None Memories on Main has had two violations within the last two year period- one in 2014 and one in 2015. The Council administered a penalty in the 2014 case. The staff is administering the investigation and reporting in the 2015 case. These violations will result in a cash fine and temporary license suspension but not license revocation in accordance with city code. Each licensee must conduct regularized liquor service training for their employees. FINANCIAL IMPACT: Included in this agenda report is Exhibit A which details the license type and fees for the applicants who have paid a total of $63,390.00 for their licenses. ALTERNATIVES: 1. Motion and second as part of the consent agenda to approve the renewal of the liquor licenses listed on Exhibit A for 2016-2017. 2. Remove this item from the consent agenda for additional discussion. 3. Deny one or more specific renewal requests and/or provide staff with additional direction. RECOMMENDED MOTION: Alternative #1. The recitals set forth above are incorporated herein. 2. Exhibit A referenced above, which includes Artisan Coffee Bistro, Charlies on Prior, The Cove, Extra Innings Saloon, Fong’s Chinese Cuisine, Holiday Stationstore, Kwik Trip, Memories on Main, MGM Wine & Spirits, Perron’s Sul Lago, The Pointe, Prior Lake Amateur Baseball Association, Prior Lake VFW, Teresa’s Mexican Restaurant, TJ Hooligan’s, Viking Liquor Barrel, Village Liquor, and The Wilds Golf Club, is incorporated herein if fully set forth, 3. The liquor licenses for the premises set forth in Exhibit A are hereby approved for the period July 1, 2015 to June 30, 2016 and, 4.
