GEOMETRIC LAYOUT FOR THE CSAH 42 AND TH 13 IMPROVEMENT
PROJECT AND COMMERCE AVENUE EXTENSION
DISCUSSION: Introduction
Scott County has requested that the City of Prior Lake provide municipal
consent of the geometric layout for the CSAH 42 and TH 13 Improvement
Project and Commerce Avenue Extension. This approval assures that Scott
County and the City of Prior Lake are in agreement on the proposed design of
the project.
History
Scott County in Coordination with MNDOT, Savage and Prior Lake are in the
process of completing preliminary design of the CSAH 42 and TH 13
intersection. This intersection has been operating using a “temporary signal”
for over a decade. Construction on this project is scheduled to begin in 2018.
Property acquisition is a long process and therefore design work is starting
now to provide the time for right of way purchase by the County.
Significant projects such as this which involve Prior Lake, Savage, MNDOT,
and Scott County are difficult to coordinate. Lining up funding is another
challenge, especially with MNDOT. When these types of projects are built, it
is important to think ahead and build the project for future conditions as much
as possible with available funding, both of which will save money ultimately.
On December 14th, 2015, the City Council reviewed this project at their regular
work session. The discussion included questions about the turning movement
at Boone Ave and questions of timing of the project.
At the January 13th, 2016 open house several questions were raised regarding
the change in access at Harbor Place and concerns regarding the U-turn at
Boone Avenue.
At the February 2nd, 2016 Scott County Board Workshop, the County Board
reviewed the project and discussed the concerns regarding the access at
Harbor Place. The County Board also directed County Staff to begin to study
alternative access to Harbor Place.

An informational meeting was held March 9, 2016 to discuss specifically the
possible changes of access at the Harbor Place and Commerce Avenue. This
meeting was attended by over 100 persons. At the meeting, Scott County
provided rationale for reviewing alternatives and possible options.
On March 28th,2016 the City Council held a work session to learn more about
the project as well as the Harbor access and the Commerce connection. Scott
County provided an oral presentation. At the meeting the City Council
provided the following comments to the County:
1. Supportive of the base project and study of a signal at Boone Avenue.
2. Differing perspectives on the connection of Commerce to Rutgers
On May 16th,2016 the Economic Development Authority reviewed the
Commerce Avenue connection and made the following recommendations or
observations:
1. The Commerce connection to Rutgers and the signal is important for
commercial businesses on Commerce Avenue.
2. Recommends the Northerly alignment.
3. Recommends that the City and County review the needs of the MVEC
substation.
4. Believes that there is no immediate use of the remnant property after
the roadway connection is made, but has future redevelopment
potential if combined with other property.
On May 23rd, 2016 the City Council discussed this project and tabled a
decision asking for the County to review other alternatives related to the
connection of Commerce to Rutgers Street and return on June 13, 2016 with
various alternatives which would address articulated concerns
Current Circumstances
The improvement project would widen CSAH 42 approaches to TH 13 with
additional turn lanes. Not much work is scheduled for Highway 13 as the
necessary lanes are already in place. This project may not be the final
ultimate project design as a third through lane may be needed in the future but
sufficient right of way for this purpose is intended to be reserved through this
project. This intersection project is being designed so that future widening for
the additional through lanes would occur to the north with minimal impact to
existing pavements on the Prior Lake side.
The project will also revise access points along CSAH 42 with changes to the
concrete median. For example, the access to Harbor Place is scheduled to be
reduced from a full access to a right in / right out access. As traffic volumes
grow, it is difficult to retain this full access here due to its close proximity to the
signalized access at Rutgers Street as it interferes with the left turn lane.
Commerce Avenue
Scott County has indicated that removal of the Commerce Avenue access at
CSAH 42 is extremely important for the safety and mobility of the corridor.

Scott County has cited the following reasons for the removal of the Commerce
Avenue access to CSAH 42:
1. Safety - CSAH 42 is a principal arterial with heavy traffic volumes. It is
important to the County to remove access points along County
roadways and especially on principal arterial highways near
intersections because they are a conflict point and risk for accidents.
2. Interference with CSAH 42 Turn Lanes – The current Commerce
connection is in close proximity to the TH 13 intersection. Turn lanes
for TH 13 extend past the existing Commerce connection to CSAH 42.
Removal allows for proper development of these turn lanes.
3. Signal Queuing – The current and future queuing of traffic for the TH
13 signal backs up traffic beyond the Commerce Avenue connection to
CSAH 42.
4. Traffic Weaving – The existing location of the Commerce Avenue
connection would result in weaving maneuvers to either enter or exit
Commerce Avenue. These maneuvers on a heavily travelled roadway
can lead to accidents especially as traffic volumes grow.
Movement of the Commerce connection to the west on CSAH 42 does not
provide enough length beyond Rutgers Street to properly develop the turn
lanes for Commerce Avenue. Future signal queuing at TH 13 is also a
concern with the movement of Commerce to the west on CSAH 42.
To address the removal of Commerce Avenue off CSAH 42, Scott County is
proposing to connect Commerce Avenue to Rutgers Street across five
previously acquired properties. Through this process, Scott County had
viewed the connection of Commerce to Rutgers as an alternative option. As
the process has proceeded and additional traffic studies have been
completed, Scott County has determined that the removal of Commerce
Avenue at CSAH 42 is necessary for this project for the reasons stated above.
The Commerce connection to Rutgers has been discussed for many years
including City Council discussions back in 2007. During the more recent
process for this project, the Commerce connection was shown at the open
house on January 13th and informational meeting on March 9th.
Per City Council direction on May 23rd, in an effort to respond to various
concerns, Scott County has evaluated several concepts for the connection of
Commerce to the Rutgers Signal. Drawings of these concepts are attached to
the report. These concept drawings include the original concept discussed on
May 23rd but also concepts which define Commerce Avenue as the through
road with Rutgers connecting to Commerce. Similar concepts are shown
which require the purchase of one additional property to the south.
1. Concept 1 - Keeps Rutgers as the through roadway at the signal and
includes Commerce connection to Rutgers. This concept was
presented on May 23, 2016. The concern here was that increased
traffic would enter the residential neighborhood rather than follow
Commerce, at higher than neighborhood speeds and that stacking
would complicate access to the homes immediately adjacent to CSAH
42 and present insufficient north bound stacking on Rutgers.

2. Concept 2 - Keeps Rutgers as the through roadway at the signal and
includes Commerce connection to Rutgers. This concept was
presented on May 23, 2016, but has been updated to include median
islands for channelization of traffic and a southern alignment east of
Rutgers to straighten out the curvature. This alignment discourages
westbound Commerce traffic from moving southbound on Rutgers and
the median on Rutgers is likely to dampen speeds but the stacking
issues seem likely to remain.
3. Concept 3 - Includes Commerce Avenue as the through road using the
County owned property. This concept has a very tight curve in close
proximity to CSAH 42. During peak times some vehicles waiting for
the signal will not be oriented in traditional fashion to see the signal in
front of them. Rather some cars will be oriented along the curve and
possibly parallel to CSAH 42. Special modifications to the signal may
be necessary. Other concerns are acceleration and deceleration
around the curve in close proximity to CSAH 42. One residential
driveway would remain on the Commerce section of roadway.
4. Concept 4 – Concept 4 is similar to Concept 3, but includes the
purchase of another property to the south (This property owner has
expressed an interest in selling). This concept includes a longer
tangent section which allows stacking motorists to see the signal in
front of them. Two residential driveways remain on the Commerce
section of the roadway. The County has not expressed an interest in
the purchase of the property that this concept requires. Another
property may become available for purchase in the vicinity. Over time if
other properties immediately adjacent do the same, there could be the
opportunity for construction of a commercial building in this area but
the city would have to hold the land until that time.
5. Concept 5 – This concept provides for a cul-de-sac of Commerce
Avenue at CSAH 42. This concept is strongly discouraged by staff as
it will reduce access to the Prior Lake commercial business district in
the southwest corner of CSAH 42 and TH 13. This concept would put
greater pressure on the Boudins/TH 13 intersection and could
discourage trips to this commercial sector of the City. There is also an
emergency service concern by disconnecting this roadway.
Retrofitting the Commerce connection to the Rutgers signal is difficult as all of
the concepts have tradeoffs. Operationally, Concept 4 provides the safest
roadway alignment for the intersection and signal operation for the long term
because it provides for proper signal stacking perpendicular to CSAH 42. The
Scott County website shows a value of just under $200,000 for the purchase
of this home. Scott County has stated that if the City prefers this alignment,
the City would be responsible for the costs for the purchase of this property.
Scott County has spent $1.3 Million on 5 properties in this area and has
committed to building the roadway which is approximately $400,000.
The extension of Commerce not only eliminates an access point on CSAH 42
but allows traffic to the Commerce Avenue businesses to access the signal at
Rutgers Street. The connection of Commerce to Rutgers would also provide
for commercial local trips at a full access intersection. Some Boudins
neighborhood trips would avoid using CSAH 42 and TH 13 by providing

connectivity to Commerce. Currently traffic on Rutgers at the signal of CSAH
42 is 550-750 vehicle trips per day. This traffic volume is considered quite low
for a full signal along a principal arterial. The traffic volume is expected to add
2,000-2,300 vehicle trips per day which would utilize the Commerce
Avenue/Rutgers Street signal with a queue length in the peak hour of 140 feet.
Depending on the options, this queue length may not be ideal considering the
connection point of Rutgers to Commerce or vice versa.
Rutgers Street was widened to 36 feet wide near the intersection of CSAH 42
with a right turn lane and a thru-left turn lane. The remaining segment of
Rutgers Street south to the park was re-built at 30 feet in width during the
recent reconstruction project. There seems to be some confusion on this
point. Other streets within this neighborhood were reduced in width to 24 feet
during the reconstruction project, but not the north – south leg of Rutgers
Street which again remained at 30 feet in width.
Concerns regarding parking on this section of Rutgers can be addressed with,
no parking signage for one side of the street as is common on so many city
streets. Adding sidewalk on Rutgers Street to the park to the south could also
be considered by the City Council.
Municipal Consent
The request this evening is for municipal consent on the geometric design for
the project. Final design refinements will be completed as the process moves
forward for the project. Direction on which Commerce connection is approved
by the City through this process is needed. If the Commerce connection is
approved, final alignment determination will continue based on the direction of
the City Council. If a Commerce connection to Rutgers Street is not approved,
a separate resolution is provided for the simple closure of Commerce Avenue
at CSAH 42 (Concept 5).
If the City Council does not agree to a Commerce connection or removal of
Commerce access to CSAH 42, municipal consent on this project has failed
and the Scott County Commissioners will determine the next course of action.
An appeals process exists per Minnesota Statute 162.02, but it is
undetermined if Scott County would go through that appeals process. Scott
County prefers agreement with their project partners on these types of matters
and as far as anyone can remember, has never gone through an appeals
process.
Scott County has indicated that the CSAH 42 and TH 13 project design needs
to continue to move forward to meet the project timelines and respectfully
requests a decision from the City Council tonight.
Conclusion
City Staff recommends approval of a resolution approving the design layout of
the CSAH 42 and TH 13 Improvement Project including the Commerce
Avenue connection. For operational and safety reasons, City Staff
recommends Concept 4 which includes property acquisition to the south. As
discussed above, the City would be responsible for the additional property

acquisition although it is our hope that County staff would be amenable to
completing to performing the right of way task as part of the right of way
acquisition for the overall project as a cost efficiency measure.
ISSUES:
From a broad traffic system perspective and long term view, the connection of
Commerce to Rutgers is prudent because it eliminates an access to a
principal arterial and provides commercial access to a full intersection. This
connectivity reduces local traffic on the highway system. However, this
connection may not be desired by the residents living on Rutgers Street
because it now introduces Commerce Avenue traffic to the Rutgers Street
signal. The Commerce connection to Rutgers is a decision where the greater
good of the transportation system is weighed against the traffic impacts to an
existing neighborhood.
It can be presumed that most traffic utilizing the Commerce connection would
proceed to the full access signal and not travel within the Boudins
neighborhood because navigating through the Boudins neighborhood to get to
TH 13 is difficult due to the narrow streets and circuitous street network. It
would simply take more time to navigate through the neighborhood than to
take Commerce to the Boudins/TH 13 signal or utilize the CSAH 42/Rutgers
signal.
There are neighborhood concerns with the added traffic at the Rutgers signal
and children walking on Rutgers to go to CSAH 42 bus stops. Sidewalks are
included with the design on Rutgers Street from the Commerce access to
CSAH 42 and could be extended further south toward the park if desirable.
There are several distinct differences between the right in access across
CSAH 42 for Walgreens and a Commerce right-in access from CSAH 42. The
Walgreens right in access is west of the TH 13/CSAH 42 signal and therefore
motorists have already navigated through this major intersection. This means
that the Walgreens right in does not conflict with turn lanes for this major
intersection. The Walgreens right-in does not conflict with signal stacking for
TH 13 and CSAH 42 for the same reasons.
Because of the location in advance of the TH 13 and CSAH 42 signal, the
Commerce access is in conflict with the turn lanes for the intersection of TH 13
and CSAH 42 and is in conflict with signal stacking.
It should also be noted that the commercial businesses in the northwest
quadrant of TH 13 and CSAH 42 includes much greater density of commercial
businesses and therefore the traffic needs for this quadrant are greater than
the southwest quadrant and includes three full access intersections (two on
CSAH 42 and one on TH 13. These intersections also serve other residential
property.
The Walgreens right-in access and a Commerce right-in access are not
comparable. Furthermore, the County has determined that a right in access
for Commerce on CSAH 42 is not part of the municipal consent request.

FINANCIAL
IMPACT:
ALTERNATIVES:
If the City Council does not approve the Commerce connection, the other
option which the County has proposed is to close Commerce Avenue at CSAH
42.
Currently Commerce Avenue at CSAH 42 receives 1,000 to 1,500 vehicle trips
per day. If closed those vehicles must then utilize the Boudins/TH 13
intersection or the Commerce access at TH 13. Eliminating the Commerce
access at CSAH 42 may not be well received by the businesses within this
district as some patrons may choose to conduct their business elsewhere if
the access is removed. It should be noted that today during the peak hour,
traffic backs up on Commerce and on Boudins Street at the Boudins/TH 13
signal.
The connection of Commerce Avenue to Rutgers Street may attract interest
from commercial developers to redevelop residential property and convert it to
commercial property near the intersection of Rutgers and CSAH 42. This
possible transition would require amendment to the City’s Comprehensive
Plan which may be controversial to the Boudins neighborhood. The EDA
discussed the commercial possibility at Commerce and Rutgers and felt that
the remaining County owned property after the roadway connection would not
be sufficient unless other property is acquired for that purpose.
The City Council’s action tonight expressly excludes the Harbor Place/Rutgers
study proposal. Scott County wishes to study the Harbor access options
further but this study would be done in the future and not incorporated with this
project. Any changes would be discussed and approved through that future
study process. If changes to accesses are approved through the study
process, they would be built in the future, possibly years after this project is
completed.
The total cost of this project is preliminarily estimated to be $12,700,000 which
includes right of way, design, and construction. The City’s contribution was
estimated at $300,000 within the current Capital Improvement Plan. City
funding is proposed from Municipal State Aid and the Utility Fund. As a part of
the total city cost, the current CIP estimates $100,000 for utility repairs in the
area. The EDA was advised on May 16th that the Commerce extension would
be funded by County funds making a City contribution for the roadway
unnecessary. The City would be responsible for maintaining Commerce
Avenue however. If the City prefers an alignment which requires additional
property acquisition, the County has stated it would be a City responsibility.
Funding for this purchase has not been determined, but would likely come
from Tax Levy as Municipal State Aid cannot be used for that purpose. The
Street Oversize Fund may also be considered.

Commerce Avenue to Rutgers Street.
2. Approve a Resolution approving the geometric layout for the CSAH 42 and
TH 13 Project with the closure of Commerce Avenue (Concept 5) at CSAH
42 and without the Commerce connection to Rutgers Street.
3. Deny this item for a specific reason and provide staff with direction.
