CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING CHANGE
ORDER #1 TO CITY PROJECT #05-01 FRANKLIN TRAIL UTILITY
IMPROVEMENTS
Introduction
As part of the City Improvement Project City Project #05-01, the City is
completing utility projects on Franklin Trail and Duluth Street. These utility
projects were bid under a separate schedule within the City Project #05-01 and
#05-11 bid package which was approved by City Council Resolution 05-87 on
May 16, 2005 and was awarded to Northwest Asphalt.
History
The utility improvements on Franklin Trail from CSAH 44 to TH 13 were added
to the Capital Improvement Program to alleviate a sanitary sewer backup
problem and to improve the sanitary sewer infrastructure. Currently the
sanitary sewer in this area is backing up to one of the buildings in this area.
These improvements will prevent this sanitary sewer backup on Franklin Trail.
Current Circumstances
As planned, the improvements show asphalt sawcutting along the perimeter of
the excavated areas. These areas are shown on the plans to be patched with
bituminous pavement. Because the excavated area lies within the confines of
Franklin Trail, the bituminous patching would be irregular. The bituminous
surface once completed will have new bituminous patching abutting the
existing pavement surface. The new bituminous and old bituminous will leave
a "jigsaw puzzle" look to the pavement. These results are not as aesthetically
pleasing compared to the entire pavement surface being constructed at the
same time. The bituminous seams between the new and old pavement could
see differential settlement and ultimately plow damage.
The Engineering Department has received a quote from Northwest Asphalt for
the milling and paving of the remainder of Franklin Trail to a depth of 1 W'.
This quote is approximately $8,000.00 for the additional milling and
bituminous. Part of the cost for this additional work will be offset by the
reduced amount of bituminous sawcutting. This reduction could be as much
as $5,000. The actual change order amount would be $3,000.00.
It is the Engineering Department's recommendation that the additional milling
and paving be done at this time. The cost for the additional work is marginal
compared to the overall cost of the project. The businesses within this corridor
would appreciate the continuity of a fully paved street in front of their
businesses.

One of the goals of the 2020 Vision and Strategic plan is to "Create a
Cooperative Environment Which Supports Retention and Growth of Existing
Business, Attracts and Stimulates New Business and Encourages Quality
Residential Development". Franklin Trail paving of the entire width from CSAH
44 to TH 13 will help in the attractiveness of the area and thus supporting the
retention of business to this area.
ISSUES:
The central question is whether the Council believes that the "curb to curb"
overlay is appropriate given its added cost of $3,000.00. Aesthetically the road
will not have a patchwork look. From a longevity perspective less saw cuts
mean less opportunity for water to percolate into the sub-base and less seal
coating related work. The Capital Improvement Program does not schedule
any additional work on this road for the foreseeable future.
FINANCIAL
IMPACT:
The cost of these utility projects is budgeted within the sewer utility of the
Enterprise Fund. The amount budgeted is $495,000. The Engineer's
Estimate for this work is $311,890.50. The bid for the work is $261,677.83.
The cost of the additional work combined with the bid is well under the
Engineer's Estimate and amount budgeted for this improvement.
ALTERNATIVES:
There are three alternatives for the City Council to consider:
1. Approve a resolution authorizing Change Order #1 to City Project #05-01
Franklin Trail Utility Improvements.
2. Deny this item for a specific reason and provide staff with direction.
3. Table this item until some date in the future.
RECOMMENDED
MOTION:
A motion and second to adopt a resolution authorizing Change Order #1 to City
Project #05-01 Franklin Trail Utility Improvements.

WHEREAS, the cost for the additional work is marginal compared to the overall cost of the project,
and
WHEREAS, the cost for the additional work is budgeted for this project, and
WHEREAS, One of the goals of the 2020 Vision and Strategic plan is to "Create a Cooperative
Environment Which Supports Retention and Growth of Existing Business, Attracts and
Stimulates New Business and Encourages Quality Residential Development". Franklin
Trail paving of the entire width from CSAH 44 to TH 13 will help in the attractiveness of
the area and thus supporting the retention of business to this area.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA,
1. The recitals set forth above are incorporated herein.
2. Funding for this change order will be drawn from the Sewer Enterprise Fund.
3. Northwest Asphalt is hereby authorized for change order #1 for additional milling and paving
on Franklin Trail from CSAH 44 to TH 13.
