DISCUSSION:
Historv: Shamrock Development has applied for approval of a
development to be known as The Wilds Ridge North on the property
located south of CSAH H 42, north of The Wilds Ridge, west of
Jeffers Pond and east of Haas Lake. The application includes the
following requests:
. A rezoning of approximately 21.16 acres from the A (Agricultural)
District to the R -1 (Low Density Residential) District;
. A Preliminary Plat consisting of 21.16 acres to be subdivided into
30 lots for single family development.
The Planning Commission held a public hearing to consider this
proposal on July 11, 2005. The Planning Commission recommended
approval of this request.
Current Circumstances: The proposed preliminary plat consists of
21.16 acres to be subdivided into 30 lots for single family dwellings.
The following analysis identifies the physical characteristics of this
site.
Total Site Area: The total site consists of 21.16 acres. The net site
area, less existing highway right-of-way and wetlands, is 18.26 acres.
TOPof!raphv: This site has a varied topography, with elevations
ranging from 946' MSL at its highest point to 890' MSL at the lowest
point. The steepest areas of the site are located adjacent to the existing
wetlands on the west and north side ofthe site.

Vef!etation: This site is heavily wooded. A tree inventory identified
10,637 caliper inches of significant trees on the site. The site is subject
to the Tree Preservation requirements.
Wetlands: There are 2 significant wetlands located in the north and
west areas of the site, totaling 1.8 acres. The plan does not propose
any impact to these wetlands. There are also 2 small wetlands located
on Lots 9 and 11, Block 1. The plan proposes to fill these wetlands
and mitigate the impact on the site.
Access: Access to the site is from CSAH 42 on the north and from
The Wilds Ridge development to the south. The plan also provides
access to the property to the west.
2020 Comprehensive Plan Desienation: This property is designated
it for Low to Medium Density Residential uses.
Zonine: The site presently zoned A (Agricultural). The applicant is
requesting an amendment to the Zoning Map to designate this site R-l
(Low Density Residential). The R-1 district is consistent with the
existing R-L/MD designation. This district permits a maximum
density of3.6 units per acre.
Shoreland: The site is also located within the Haas Lake Shoreland
District. Haas Lake is designated as a Natural Environment Lake;
however, the DNR approved an amendment to the City's Zoning
Ordinance to allow the minimum lot area and lot width requirements
for this lake as 12,000 square feet and 86 feet, respectively.
PROPOSED PLAN
Lots: The preliminary plat consists of 30 lots for single family
dwellings and 4 outlots. The lots range in size from 12,000 square feet
to over 46,000 square feet. Net lot areas must be provided for Lots 5-
7, Block 1. Although these lots have a gross area of more than 12,000
square feet, the net lot area (less ponding area) must be at least 12,000
square feet. In addition, the minimum lot width at the front building
line for Lots 11-13, Block 1, scale less than the required 86 feet. The
lot width for these lots must be verified.
There is an existing house located on Lot 4, Block 1. This house will
remam.
Outlots A and B are the existing wetlands. These outlots will be
dedicated to the City. Outlots C and D are intended for future
development.

Streets: This plan proposes three new public streets. McKenna Road
is the north-south street, extending from CSAH 42 to the south
property boundary, where it intersects with the street in The Wilds
Ridge. This street is called McKenna Road because it lines up with
the ultimate alignment of McKenna Road on the north side of CSAH
42. McKenna Road is a collector street, designed with a 66' wide
right-of-way and a 36' wide surface.
Cul-de-sac 1 is approximately 270' long, and is located on the east side
of McKenna Road. This cul-de-sac provides access to 7 lots. Street 2
is a stub street, providing access to 2 lots and future access to the
property to the west. Both the cul-de-sac and Street 2 are local streets,
with a 50' wide right-of-way and a 32' wide surface.
Sidewalks/Trails: There is a sidewalk on the west side of McKenna
Road and a trail on the east side.
Parks: There is no parkland included within this plat. A
neighborhood park is located in The Wilds Ridge development to the
south. The parkland dedication requirements for this plat will be
satisfied by a cash dedication in lieu of land.
Sanitary Sewer/Water Mains: Sanitary sewer and water mains will
be extended from the utilities to be located within The Wilds Ridge
development.
Storm Sewer: The plan directs the runoff from a portion of the site to
the NURP ponds located in the back yards (east side) of Lots 5-7,
Block 1. The City and the Prior Lake/Spring Lake Watershed District
are currently reviewing this plan.
Density: The development proposes 30 single family units. The net
density in this plan is 1.64 units per acre. The proposed density is
consistent with the maximum 3.63 units per acre permitted in the R-l
Use District.
Landscapine: Single family developments require at least 2 front
yard trees per lot. The developer has provided a plan showing at least
2 trees per lot.
Tree Replacement: The applicant has submitted an inventory
identifying 10,637 caliper inches of significant trees on the site. The
Zoning Ordinance allows up to 25% of the significant caliper inches to
be removed for road and utility purposes, and up to 25% for building
pads and driveways. The number of significant inches removed over
and above these percentages must be replaced at a rate of a 1/2 caliper
inch for each inch removed. This plan proposes to remove 26.5% of
the caliper inches of significant trees for roads and utilities, and 34.2%

for building pads and driveways. This requires replacement of 570
caliper inches (228 2.5 inch trees). The plan submitted includes 100
trees to meet the reforestation requirements. Section 1107.2106 (3,b)
states "in the event that planting of replacement trees on the site being
developed or publicly-owned or controlled sites is either not possible
or desirable, developers shall be required to pay cash in lieu of
replacement trees at a ratio $100.00 per caliper inch of excess tree
removal. Cash received in lieu of replacement trees shall be placed in
the Capital Improvement Fund of the City Park Department, and shall
be dedicated to maintenance of the City's nursery stock and planting of
trees on public property." If this provision is utilized, the developer
will be required to submit a cash payment of $32,000.
Fees and Assessment: This development will be subject to the
standard development fees. In addition, the development will be
subject to a lateral assessment for the extension of sewer to the site.
THE ISSUES:
There are two separate applications included in this proposal. The
following sections identify the issues related to each application.
(1) REZONING FROM THE A TO THE R-1: Section 1108.600 ofthe
Zoning Ordinance identifies the following policies for amendments to
the Official Zoning Map:
· The area, as presently zoned, is inconsistent with the policies and
goals of the Comprehensive Plan, or the land was originally zoned
erroneously due to a technical or administrative error, or
· The area for which rezoning is requested has changed or is
changing to such a degree that it is in the public interest to rezone
so as to encourage redevelopment of the area, or
· The permitted uses allowed within the proposed Use District will
be appropriate on the subject property and compatible with
adjacent properties and the neighborhood.
The property is designated as R-L/MD (Low to Medium Density
Residential) on the 2020 Comprehensive Plan Land Use Map. The R-
1 district is consistent with this designation. The R-1 district is also
consistent with the zoning and development of the adjacent property.
(2) PRELIMINARY PLAT: The applicant proposes to subdivide the
property into 30 lots for single family dwellings. The overall layout of
the plat appears appropriate, given the constraints of the site. There
are a few issues pertaining to this preliminary plat that are somewhat
unique. These are discussed below:
1. There is a large amount of tree replacement required on this site,
due to the number of trees which originally existed on the site. The
plan does not clear cut the site to make it easier to build. The tree

removal is necessary for the construction of roads and other
infrastructure. The replacement plan does include 100 new trees;
however, there is little room on the site to plant the remaining
replacement trees required. The staff recommends the cash
dedication in lieu of replacement be accepted. At the Planning
Commission meeting, the applicant noted he did not agree with the
cash payment. He noted he is willing to work with staff on the tree
preservation requirements. If this issue is not resolved prior to
final plat approval, he is willing to escrow the cash payment until
the matter is resolved. The staff believes this situation is
somewhat unique, due to the number of the trees on the site and the
configuration of the parcels. Under these circumstances, the
variance may be the fastest and most appropriate solution. The
staff intends to review the Zoning Ordinance to look at possible
ways to address these types of situations in the future.
2. There are some lots within the development that do not appear to
meet the minimum net lot area or lot width requirements. These
lots must be adjusted to meet minimum requirements.
3. Outlots A and B should be eliminated and combined with the
adjacent lots. Since there are no stormwater ponds on these
outlots, the City does not require ownership. Drainage and utility
easements over the wetlands should be dedicated.
4. In the memorandum dated June 21, 2005, the City Engineer has
identified several design issues. The staff has met with the
applicant to discuss and resolve many of these items. The
Engineering staff is preparing a revised memorandum which will
be available prior to the Planning Commission meeting.
CONCLUSION:
The Planning Commission concluded the project can proceed with the
following conditions.
1. The Developer may choose to seek a variance to the Tree
Preservation requirements of the Zoning Ordinance. In the event a
variance is not granted, a cash payment of $32,000 is required to
meet the tree replacement requirements. This payment will be
collected as part of the Development Contract.
2. Lots 5-7, Block 1, must be adjusted to meet the minimum 12,000
square feet of net lot area.
3. Lots 11-13, Block 1, must be adjusted to meet the minimum lot
width of 86' at the front building line.
4. Outlots A and B must be eliminated and platted as part of the
adjacent lots. A drainage and utility easement must be dedicated
over the wetlands.

5. Any issues identified in the revised memorandum from the
Engineering Department must be addressed with the final plat
submittal.
The Planning Commission and the staff recommend approval of this
proposal. The attached ordinance approved the rezoning and the
attached resolutions identify the conditions of approval that must be
met prior to final plat approval.
Budf!et Impact: There is no budget impact as a result of this action.
Approval of the project will facilitate the development of the area and
increase the City tax base.
The City Council has three alternatives for action on each application:
1. Adopt an ordinance approving the zone change to the R-1 district as
requested and adopt a resolution approving the Preliminary Plat for
this development subject to the listed conditions, with the finding
that the preliminary plat is consistent with the intent and purpose of
the Zoning and Subdivision Ordinances.
2. Deny the rezoning and the Preliminary Plat on the basis they are
inconsistent with the purpose and intent of the Zoning and
Subdivision Ordinances and/or the Comprehensive Plan. In this
case, the Council should direct the staff to prepare a resolution with
findings of fact based in the record for the denial of these requests.
3. Defer consideration of this item and provide staff with specific
direction.
The staff recommends Alternative #1. This action requires the
following motions:
1. A motion and second adopting an ordinance rezoning
approximately 21.16 acres from the A (Agricultural) District to the
R-1 (Low Density Residential) District.

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE PRELIMINARY PLAT OF "THE WILDS
RIDGE NORTH" SUBJECT TO THE CONDITIONS OUTLINED HEREIN.

WHEREAS: The Prior Lake Planning Commission conducted a public hearing on July 11, 2005, to consider an
application from Shamrock Development, Inc. for the preliminary plat of The Wilds Ridge North
Addition; and
WHEREAS: Notice of the public hearing on said preliminary plat has been duly published and posted in
accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and
WHEREAS: All persons interested in this issue were afforded the opportunity to present their views and
objections related to the preliminary plat of The Wilds Ridge North for the record at the public
hearing conducted by the Planning Commission; and
WHEREAS: The Planning Commission and City Council have reviewed the preliminary plat according to the
applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said
preliminary plat to be consistent with the provisions of said ordinances; and
WHEREAS The Prior Lake City Council considered an application for preliminary plat approval of The Wilds
Ridge North on July 18, 2005; and
WHEREAS: The City Council has the authority to impose reasonable conditions on a preliminary plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE,
MINNESOTA:
A. The above recitals are incorporated herein as if fully set forth.
8. The preliminary plat of The Wilds Ridge North is approved subject to the following conditions:
