HomeMy WebLinkAbout5G PLSLWD AgreementPhone 952.447.9800 / Fax 952.447.4245 / www.cityofpriorlake.com 4646 Dakota Street SE Prior Lake, MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: AUGUST 22, 2016 AGENDA #: PREPARED BY: 5G PETE YOUNG, WATER RESOURCES ENGINEER PRESENTED BY: PETE YOUNG AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE PRIOR LAKE SPRING LAKE WATERSHED DISTRICT FOR A COOPERATIVE WATER QUALITY PROJECT DISCUSSION: Introduction The purpose of this agenda item is to authorize the Mayor and City Manager to execute an Agreement for a Water Quality Project in partnership with the Prior Lake-Spring Lake Watershed District (PLSLWD). History The City and the PLSLWD have partnered on numerous water quality improvement projects over the years. The City and PLSLWD (along with Scott County) entered into a cooperative agreement for the large wetland restoration project at the intersection of County Roads 12 and 17 that outlined property access rights, vegetation management obligations, and final project acceptance terms. Smaller partnership projects between the City and PLSLWD have not typically been covered by such an agreement. The PLSLWD applied for and received a grant from the Minnesota Pollution Control Agency (MPCA) to install Best Management Practices (BMPs) as part of a targeted Lower Prior Lake water quality improvements program. Working with City staff, PLSLWD identified BMP locations at Indian Ridge Park and on City right-of-way at the intersection of Fairlawn Shores Trail SE and 150th Street SE. PLSLWD then developed construction plans for the project. City staff approached PLSLWD with a request to enter into agreements for all future partnership projects undertaken on property owned or otherwise controlled by the City. Such agreements will identify the roles and responsibilities of each party. Current Circumstances PLSLWD is proposing to move forward with plans to construct proposed water quality improvement BMPs on City-controlled property (see attached plans). City staff has reviewed and approves of the project plans. Both project areas are relatively flat and consist of mowed turf grass. Under the proposal these areas will be modified to accept stormwater runoff and filter it through vegetated shallow depressions before discharging to the City’s 2 storm sewer system and ultimately Lower Prior Lake. This method of stormwater treatment is called bioretention. While bioretention has been used on many past projects in the City, ranging from small neighborhood raingardens to larger development-scale treatment areas, past designs have led to an increased maintenance burden for City Public Works staff. Many past projects rely on shredded mulch and individual plants for final ground cover. Unless these projects are weeded 2-4 times per year and re-mulched every 2-3 years, they can become weedy and harm the public perception of water quality projects even though they remain functional and continue to treat stormwater. Public Works staff has received several complaints from residents regarding these types of projects. City staff supports improving water quality, and long-term vegetation maintenance costs must now be a primary consideration when designing water quality improvement BMPs. Maintenance during the BMP establishment phase must also be considered. The current BMP design, developed by PLSLWD with input from City staff, addresses the City’s concerns with the establishment phase and long-term maintenance. City Public Works staff currently mows the project areas every 1-2 weeks during the growing season. Under the proposed Agreement, PLSLWD will provide the first 2 years of maintenance, after which the City will need to accept the project before taking over long-term vegetation maintenance. Instead of mulch and individual plants, the proposed design includes seed mixes that can be mowed, but less frequently than the existing turf grass (once every 3-4 weeks). If the Agreement is approved, the PLSLWD is proposing to start project construction within the next 2 weeks with substantial completion by the end of December 2016. Conclusion Staff is recommending approval of the Agreement. The Agreement establishes a formal process for accepting and installing partnership water quality BMP projects on City-controlled property. The Agreement form was drafted and approved by the City’s attorney. The PLSLWD Board approved the attached agreement at their August 9, 2016 meeting. ISSUES: Completing formal agreements for water quality BMP projects will protect the City from a legal standpoint and will also outline the short-term and long-term maintenance responsibilities of each party. The City has an obligation to protect and improve the water quality of our water resources. Many water quality BMPs are implemented to satisfy State or Total Maximum Daily Load (TMDL) mandates. From time to time additional opportunities to implement water quality projects with our local government partners become available. By entering into agreements and taking advantage of these additional opportunities to enhance and protect our water resources, the City positions itself as a leader in both water quality and sustainable low-cost maintenance practices. 3 FINANCIAL IMPACT: The City will not incur any costs to implement the project because the PLSLWD proposes to implement and oversee the project using grant funds. The City will realize a savings in maintenance costs during the two- year project establishment phase (2017-2018 growing seasons) because maintenance will be performed by PLSLWD’s contractor. Starting in 2019, if the project is established to the City’s satisfaction, Public Works maintenance crews will once again maintain the project area by mowing, but the frequency of the mowing will be reduced from current mowing practices. Therefore, the long-term maintenance costs for the project area will be either tax-neutral or provide a small cost savings. ALTERNATIVES: 1. Motion and a second as part of the consent agenda to approve the resolution which authorizes the Mayor and City Manager to execute the Agreement for a Water Quality Project. 2. Remove this item from the consent agenda for additional discussion. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. O n e pre-treatment retention basin will be installed on each site to provide stormwater management.RECEIVING WATERSFairlawn Shores and Indian Ridge Park are located approximately 200 feet and 600 feet , respectively, south of Lower Pri o r L a k e . A p p r o x i m a t e l y 4 a c r e s o f e x i s t i n g residential neighborhoods drain from the east through Fairlawn Shores. Roughly 31 acres of existing, residential neighbor h o o d s d r a i n f r o m t h e n o r t h , e a s t a n d s o u t h into Indian Ridge Park. Runoff travels through the upstream drainage area, and enters the park in a natural ravine where it d i s c h a r g e s t o a n i n c i d e n t a l w e t l a n d b e i n g restored through hydraulic improvements. Discharge from the incidental wetland is directed to an adjacent ditch before it e n t e r s a l o c a l s t o r m w a t e r m a n a g e m e n t pond, and then discharges to the Prior Lake.SPECIAL OR IMPAIRED WATERS (APPENDIX A)Lower Prior Lake is not an impaired water body.
