AGENDA ITEM: CONSIDER APPROVAL OF AN ORDINANCE REVISING CITY CODE
SECTION 609 RELATED TO PROPERTY MAINTENANCE
DISCUSSION: Introduction
The Code Enforcement Officer in his annual report identified a number of
ordinances that should be updated. The purpose of this agenda item is to
consider approval of an ordinance amending the Property Maintenance
section of the City Code relating to weeds to address the issues identified
by the Code Enforcement Officer.
Current Circumstances
City Code Section 609.700 limits the height of weeds and grass. If weeds
or grass exceed the permitted height the property owner receives a notice
of the code violation. If the violation is not remedied in the stated time, the
City may enter upon the property and cut the grass and weeds. The
attached ordinance streamlines the process to ensure that the City can
address overgrown grass and weeds in a timely manner.
ISSUES: The attached ordinance updates the regulations and procedures relating to
code enforcement.
FINANCIAL
IMPACT:
None. The ordinance provides clearer regulation for existing City Code
provisions.
ALTERNATIVES: 1. Motion and second to adopt the ordinance as proposed.
2. Take no action or direct staff to make further modifications or conduct
additional research.

ORDINANCE NO. 116-XX
AN ORDINANCE AMENDING SECTION 609, PROPERTY MAINTENANCE, OF THE
PRIOR LAKE CITY CODE RELATED TO PROPERTY MAINTENANCE AND ADOPTING BY REFERENCE CITY
CODE PART 1 WHICH, AMONG OTHER THINGS, CONTAINS PENALTY PROVISIONS
THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, ORDAINS:
1. Subsection 609.704 of the Prior Lake City Code is deleted in its entirety and replaced with the following:
609.704 Work done by City: If the provisions of the foregoing subsections are not complied with the City
shall provide written notice of the violation and the actions required to remedy the violation. The
City shall mail the notice to the owner of record of the property, as determined by the records of
the Scott County Auditor, and shall post the notice on the door of the property (or if the property is
vacant at another visible location on the property). If the violation is not remedied within the time
provided by the notice, the City may enter upon the property and remedy the violation. The City
may invoice the owner of record of the property for all of the costs of remedying the violation,
including but not limited to inspection costs, administration costs, and abatement costs. If the owner
of record of the property fails to pay the costs as required by the invoice the City may specially
assess the costs against the property as provided for in Minnesota Statutes Section 429.101 or any
other applicable authority. The assessment shall accrue interest at the rate of the bonding rate for
the calendar year in which the assessment is adopted plus 2% beginning from the date of the
adoption of the assessment except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption thereof. The assessment and interest thereon shall be a lien against
the property shall be collected and paid in the same manner as other municipal taxes.
2. Penalty. City Code Section 103 entitled “Definitions” and Section 104 entitled “General Penalty” are hereby
adopted in their entirety, by reference, as though repeated verbatim herein.
This ordinance shall become effective from and after its passage and publication.
