PRIOR LAKE PLANNING COMMISSION MINUTES
Monday, August 15, 2016
1. Call to Order and Pledge of Allegiance:
Commissioner Fleming called the Monday, August 15, 2016 Prior Lake Planning Commission meeting to
order at 6:00 p.m. Those present were Commissioners Bryan Fleming, Wade Larson, Mark Petersen and
Bill Kallberg. Also present were Director Dan Rogness and Executive Assistant Ann Schroeder. David
Tieman was absent.
2. Approval of Agenda:
MOTION BY PETERSEN, SECONDED BY KALLBERG TO APPROVE THE MONDAY, AUGUST 15,
2016 PRIOR LAKE PLANNING COMMISSION AGENDA.
VOTE: Ayes by Fleming, Larson, Petersen, and Kallberg. The Motion carried.
3. Approval of Monday, August 1, 2016 Meeting Minutes:
MOTION BY KALLBERG, SECONDED BY PETERSEN TO APPROVE THE MONDAY, AUGUST 1,
2016 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES.
VOTE: Ayes by Fleming, Larson, Petersen, and Kallberg. The Motion carried.
4. Public Hearings:
A. DEV16-001022 – Courtwood Village – Conditional Use Permit (Continued from the August
1, 2016 Meeting) – Mesenbrink Construction is requesting a Conditional Use Permit (CUP) to
allow 54 multifamily housing units as Phase 2 at Courtwood Village in a High Density Residential
Use District. The property is located along Adelmann Street in Prior Lake next to the existing 54-
unit building in Phase 1. PID: 25-441-001-1.
Director Rogness introduced the request for the Conditional Use Permit for Courtwood Village. This
property is located south of Eagle Creek Avenue SE and west of Adelmann Street SE. He explained the
history, current circumstances, issues, alternatives and recommended motion. He said the applicant
would like to proceed with only the preliminary plat. He presented a location map, plat map and site plan
and Planning Commission Resolutions 2005 and 2006. He suggested to continue to the August 15, 2016
Planning Commission Meeting.
Commission Comments/Questions:
Larson asked if the plan process starts over or can they use some of the same plans from the process
that was completed back in 2009.
Director Rogness responded that they can use some of the same plans but the architect and the
engineer will need to re-stamp the plans. Stated staff checked to make sure there were no changes
needed to be made regarding the storm water rules and the wetland. Added no changes needed to be
made and they should be able to move forward re-using what was approved before.
Larson stated in the notes it mentioned plans from 2005 and 2006 for something built in 2009.
Director Rogness responded the 2005 and 2006 plans approved both buildings with a phase of the
project starting in 2009. Stated building B was constructed by the end of 2006 but the construction that
was to begin in the summer of 2009 for building A was never done.

Larson questioned with the building originally set up by a condo community then switching over to a
rental property, was there anything needed to change it over from one to another.
Director Rogness believed the buildings can be rented out even though they were marketed as condos.
Added the platting process is different but the City does not require multi-family buildings to be one or
the other. Noted it is the choice of the developer if they go the condo route or not.
Petersen asked if the wetland meets the requirements for green space.
Director Rogness responded no it is actually the dotted area shown on the diagram with open green
space.
Kallberg noted on page one under history the second paragraph should be August 2016.

VOTE: Ayes by Fleming, Larson, Petersen, and Kallberg. The Motion carried.
Commission Comments/Questions:
Petersen asked if the applicant could respond with who would be buying the condos since they are in
the process of planning for the city to get an insight on the demographics. Stated he would be supporting
the CUP.
Fleming asked Rogness if that information can be obtained.
Director Rogness responded that he can forward that request to the applicant and respond to the
commissioners.
Larson stated he likes the amount of parking space with two spaces under the units and two spaces
between the lots. Added if they decide to do both buildings with cleaning underneath there may not be
enough parking during that time. Suggested to build one building at a time so people are not parking on
Adelman which would disrupt large trucks going to the industrial park area.
Kallberg noted the site is ready with the excavation for building A and top soil is ready for grading. Added
the boarders of the property are wooded already which does not create a need to plant trees for a bluffer.
Stated there is an industrial building where apparently employees do park on the street which does not
make sense that we are requiring off street parking one way but not the other way. Added he has no
objections to the project.
Fleming stated he supports the project and it is great to see it come back online after the great recession.
Added the findings are in order and comply with 1108.200 and 1102.603.
MOTION BY PETERSEN, SECONDED BY KALLBERG TO APPROVE THE DEV16-001022 –
COURTWOOD VILLAGE – CONDITIONAL USE PERMIT AT 6:20 P.M.
VOTE: Ayes by Fleming, Larson, Petersen, and Kallberg. The Motion carried.

6. New Business:
A. Initiate Zoning Ordinance Amendments
Director Rogness introduced the topic of proposed zoning ordinance amendments for the City of Prior
Lake which included: Signage subsection 1107.500, Tree Preservation and Restoration subsection
1107.2100, Home Occupations in all residential use districts R-1, R-2, and R-3, and Twin Island
subsection 1104.309. Requested a motion to initiate public hearings for these amendments.
Commission Comments/Questions:
Larson asked for the reasoning behind not having a detached building that may be utilized for business
aspects.
Director Rogness stated the City is open to looking at that but a handful of cities did not allow businesses
in detached structures. Added accessory structures are normally within 5’ of the property line and it may
become more intrusive to neighbors. Stated staff is open to having that as part of the discussion.
Kallberg stated one or two instances in the orderly annexation area in Spring Lake Circle there is a
person who builds yard sheds with a work shop that is detached from the main structure. Agreed it is
something we need to look at.
Petersen commented that when he was on the EDA the signage was a hot topic so it would be good to
be readdressed. Questioned if tree preservation is only required for new development.
Director Rogness stated it is strictly new developments which really applies to the subdivision ordinance
and he confirm and make it clear when this topic comes back.
Petersen stated the home occupation ordinance protects the neighborhoods from traffic and storage.
Noted the recent issue with Twin Island was difficult because nothing was in place so it would be nice to
have clarity.
Director Rogness noted the tree preservation for the Chatonka Heights is showing the replanting plan
of about eight new trees per lot but only require two. Added the building official and inspectors say
homeowners prefer fewer trees for play areas. Explained if there are eight trees replanted, we do not
want to see the homeowner cut down four trees; then we have not achieved the reforestation. Continued
if the planting cannot happen on the lot, we request it to be planted elsewhere like on a park for example.
Petersen stated there is no rule once the home is built the trees have to remain

Larson asked if the Twin Island application discussed at an earlier meeting is still in process.
Director Rogness replied there was not a moratorium put in place and the person who appealed the
variance was unsuccessful. Added that property owner who requested the two variances can build.
Fleming stated he believes all of the proposed amendments make sense which will provide clarity when
items come to the Planning Commission.

Comprehensive Plan Discussion Workshop
The Planning Commission convened in a workshop setting to discuss the 2040 Comprehensive Plan
update. Director Rogness reviewed and discussed the following items:
Staff will continue discussion on the following two items: (1) a draft timeline for what to expect for the
planning process through the remainder of 2016 and into 2017; and (2) the current residential land supply
in Prior Lake and in the Orderly Annexation Area (OAA). Based on the 2040 forecast of 14,700
households by 2040, the City will add 5,500 units between 2015 and 2040, or an annual average of 220
units/year. Rogness reviewed an updated analysis, now adding density information. In addition, the
High Density Residential land use is divided into two sub-categories, R-HDL for a lower high-density of
8-29.9 units per acre, and a R-HDH for a higher high-density of 30+ units per acre.
