Prior Lake, MN 55372-1714 RESOLUTION 05-129 RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE PRELIMINARY PLAT OF "THE WILDS RIDGE NORTH" SUBJECT TO THE CONDITIONS OUTLINED HEREIN. MOTION BY: LeMair SECOND BY: Fleming WHEREAS: The Prior Lake Planning Commission conducted a public hearing on July 11, 2005, to consider an application from Shamrock Development, Inc. for the preliminary plat of The Wilds Ridge North Addition; and WHEREAS: Notice of the public hearing on said preliminary plat has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and WHEREAS: All persons interested in this issue were afforded the opportunity to present their views and objections related to the preliminary plat of The Wilds Ridge North for the record at the public hearing conducted by the Planning Commission; and WHEREAS: The Planning Commission and City Council have reviewed the preliminary plat according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said preliminary plat to be consistent with the provisions of said ordinances; and WHEREAS The Prior Lake City Council considered an application for preliminary plat approval of The Wilds Ridge North on July 18, 2005; and WHEREAS: The City Council has the authority to impose reasonable conditions on a preliminary plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA: A. The above recitals are incorporated herein as if fully set forth. B. The preliminary plat of The Wilds Ridge North is approved subject to the following conditions: 1. The Developer may choose to seek a variance to the Tree Preservation requirements of the Zoning Ordinance. In the event a variance is not granted, a cash payment of $32,000 is required to meet the tree replacement requirements. This payment will be collected as part of the Development Contract. 2. Lots 5-7, Block 1, must be adjusted to meet the minimum 12,000 square feet of net lot area. 3. Outlots A and B must be eliminated and platted as part of the adjacent lots. A drainage and utility easement must be dedicated over the wetlands. 5. Any issues identified in the revised memorandum from the Engineering Department must be addressed with the final plat submittal.
