History On July 26, 2016 the City received the official Notice of (Non-Gaming) Land Acquisition Application for 72.88 acres known as the Group P Property. The City requested and was granted a 30-day extension to make comments until Septmeber 27, 2016. The City Council’s Fee to Trust Work Group. Mayor Hedberg, Councilor Keeney, Attorney Schwarzhoff, and myself met to discuss this application. We concurred that the key issue with respect to this application is the construction and maintenance of North Bernus Road, a collector street, which is located near the southerly boarder of the property and will ultimately make a connection between McKenna and County Road 21. Current Circumstances The City staff and the SMSC staff have begun to discuss this topic but need more time. Therefore, the request for a second thirty day extension was sent last Friday (attached) with the support of the SMSC staff. Attached is an email from the BIA indicating that it is their intention to grant the extension since both parties agree and that a letter to that effect should be forthcoming by Monday, September 26, 2016. Conclusion No action is necessary at this time. An agenda item will be placed on either the October 10 or October 24 City Council meeting. We requested and we were granted a 30-day extension to September 27, 2016. The City and the SMSC staff are in the process of discussing roadway issues which have potential impacts on significant portions of land on the outside of the Group P property. The City of Prior Lake therefore requests an additional 30-day extension of the deadline to submit comments and the requested information, as provided for in the Notice. We will submit our comments by October 27, 2016. It is my understanding that SMSC staff are amenable to this request. If you require any additional information, please feel free to contact me.
