Call to Order and Pledge of Allegiance: Commissioner Fleming called the Monday, September 19, 2016 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Wade Larson, William Kallberg and David Tieman; Bryan Fleming and Mark Petersen were Absent. Also present were Planner Jeff Matzke and Development Services Assistant Sandra Woods. 2. Approval of Agenda: MOTION BY TIEMAN, SECONDED BY KALLBERG TO APPROVE THE UPDATED MONDAY, SEPTEMBER 19, 2016 PRIOR LAKE PLANNING COMMISSION AGENDA, REMOVING ITEM 5A. VOTE: Ayes by Larson, Kallberg and Tieman. The Motion carried. 3. Approval of Monday, August 1, 2016 Meeting Minutes: MOTION BY KALLBERG, SECONDED BY TIEMAN TO APPROVE THE MONDAY, AUGUST 15, 2016 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Ayes by Larson, Kallberg and Tieman. The Motion carried. 4. Public Hearings: A. DEV16-001027 – Evanston Avenue SE – Variance – George Farrell is requesting variances from the minimum lot width, front yard setback, side yard setback and driveway setback to allow subdivision of a residential property into two lots in the Medium Density (R-2) Residential Zoning District. The property currently contains two principal residential structures and two garages. The property is located at 16189 & 16199 Evanston Avenue SE; north of Dakota Street east of Trunk State Hwy 13. PID: 25-001-093-0. Planner Matzke introduced the request for the Variances at 16189 and 16199 Evanston Avenue SE. He explained the history, current circumstances, issues, alternatives and recommended motion. He presented a resolution, location map and survey dated August 15, 2016. Commission Comments/Questions: Tieman asked about overall lot sizes for each of these two lots. Planner Matzke explained the lot size and stated it does meet the lot requirements; just are not wide enough. Tieman asked about building in the future, would the Lots be in conformance to make something work. Planner Matzke replied they would and stated if these houses were ever torn down, they may still need variances due to the narrow width of the property, but would be classified as buildable Lots. Kallberg questioned how this property became one parcel when it was platted as Lot 9 and Lot 10. He talked about the garage on parcel A encroaching onto the original Lot 9, and the driveway being shared by both parcels. He asked if the need for easement is to share the driveway. Planner Matzke said the main reason for the easement is for the Parcel A, the northern Lot; to have a full access width back to the garage. He explained the current driveway and stated the easement is a private easement. 2 Kallberg questioned the proposed line and the driveway location. Planner Matzke explained dividing the Parcels different and explained the possibility of increased firewall on the single family dwelling on Parcel B. He said what they are proposing now doesn’t require increased construction. Kallberg said they are not changing anything structurally; regardless the driveway and commented on the driveway being on its own parcel rather than getting into easements. He said the motivation is mysterious and each lot should have their own driveway to make it more sellable. He commented on the trend in Prior Lake is not typically making smaller lots. MOTION BY TIEMAN, SECONDED BY KALLBERG TO OPEN PUBLIC HEARING ON 4A AT 6:18 P.M. VOTE: Ayes by Larson, Kallberg and Tieman. The Motion carried. Applicant: George Farrell, 19187 Jewell Path, Lakeville, MN. He commented on the separation line and historical points of the house and property. Larson asked about separate utilities for each home. Farrell said all utilities will be set up separately. Public Comment: None. MOTION BY KALLBERG, SECONDED BY TIEMAN TO CLOSE THE PUBLIC HEARING ON 4A AT 6:23 P.M. VOTE: Ayes by Larson, Kallberg and Tieman. The Motion carried. Commission Comments/Questions: Kallberg stated it seems as if we are trading basically one nonconformance as two residences on a single Lot for several other conformances; if things are the way they are, nothing will change physically. He said as he indicated earlier it does make it more saleable if that time should come. He said he is supporting the request. Tieman said it is clear that this is historical; based on the history of the sight he sees no reason this shouldn’t go forward and make it a chance for the future. Larson stated he sees each parcel being the relative to the other homes in the area in size and dimensions with their own garage units. He is in favor of this request. MOTION BY TIEMAN, SECONDED BY KALLBERG TO APPROVE THE RESOLUTION FOR THE REQUEST OF TWO VARIANCES FOR 16189 AND 16199 EVANSTON AVENUE INCLUDING THE LIST OF CONDITIONS BY STAFF AT 6:25 P.M. VOTE: Ayes by Larson, Kallberg and Tieman. The Motion carried. B. DEV16-001028 – 1735 Shoreline Blvd – Variance – Dana Breault, the property owner, is requesting variances from the minimum front yard setback and minimum side yard setback on a property located at 1735 Shoreline Boulevard SW in the Low Density (R-1) Residential Zoning District; along the northern shores of Spring Lake. PID: 25-487-004-0. Planner Matzke introduced the request for the Variances at 1735 Shoreline Boulevard. He explained the history, current circumstances, issues, alternatives and recommended motion. He presented a resolution, location map and survey dated July 8, 2016. Commission Comments/Questions: Tieman questioned the bituminous drive in the same footprint and asked if it would affect the impervious the same way as the garage. 3 Planner Matzke replied the bituminous drive; impervious surface increases about 60-80 feet; he said that is not a lot and he did look into reducing to maintain; however, the driveway is about as short as it can be. City staff felt that the slight increase was not substantial. He commented on the Bituminous drive and the grading adjustments. Kallberg said this is some crazy platting and stated this is an interesting piece of history; he explained that he looked at this parcel as well some twenty years ago and asked why there is no garage and he said the answer they got was if there is a well there and a garage could not be put on top of the well; but now that there are the improvements on County Road 12 and Shoreline Boulevard, he presumed that the well has been closed and sealed according to the requirements and now a garage can be placed there. He said he felt they are doing the best they can with what they have to work with. Planner Matzke said that is correct regarding the well being sealed. MOTION BY TIEMAN, SECONDED BY KALLBERG TO OPEN PUBLIC HEARING ON 4B AT 6:35 P.M. VOTE: Ayes by Larson, Kallberg and Tieman. The Motion carried. Applicant: None. Public Comment: None. MOTION BY KALLBERG, SECONDED BY TIEMAN TO CLOSE THE PUBLIC HEARING ON 4B AT 6:37P.M. VOTE: Ayes by Larson, Kallberg and Tieman. The Motion carried. Commission Comments/Questions: Tieman stated it looks like a good plan for a garage addition. Kallberg stated he has nothing further to add Larson said seeing that there is an ordinance to not build over a well; and the practicality at that time to not or the desire to not have a garage; but because of practical reasons, they could not build. He is in favor of approval this evening. MOTION BY TIEMAN, SECONDED BY KALLBERG TO APPROVE ALTERNATIVE NUMBER ONE UNDER AGENDA ITEM 4B AT 6:38 P.M. VOTE: Ayes by Larson, Kallberg and Tieman.
