HomeMy WebLinkAbout95-38PC 5360 Candy Cove Trail VarianceRESOLUTION 9538PC A RESOLUTION DENYING A REQUEST FOR A 2.62 FOOT VARIANCE TO PERMIT A 7.38 FOOT SIDE YARD SETBACK iNSTEAD OF THE REQUIRED 10 FEET TO PERMIT CONSTRUCTION OF A HOUSE WITH ATTACHED 3-CAR GARAGE IN THE R-1 SUBURBAN RESIDENTIAL DISTRICT AND SD SHORELAND DISTRICT AT 5360 CANDY COVE TRAIL. BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota; FINDINGS Christopher Pearson has applied for a variance from Section 4.2 of the Zoning Ordinance in order to permit construction of a single-family house with an attached 3-car garage on property located in the RI-Suburban Residential and SD - Shoreland Districts at the following location, to wit; 5360 Candy Cove Trail, legally described as Lot 4 and part of the West 1/2 of Lot 5, Candy Cove Park, Scott County, Minnesota The Board of Adjust~nent has reviewed the Application for Variance as contained in Case #VA95-38, and held a hearing thereon on November 13, 1995. The Board of Adjustment has considered the effect of the proposed variance upon the health, safety, and welfare of the community, the existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, the effect on property values in the surrounding area and the effect of the proposed variances on the Comprehensive Plan. There are other, alternative locations or configurations for the proposed house and garage which would not require a variance. For that reason, literal enforcement of the Zoning Ordinance would not result in undue hardship with respect to the property. For the reasons stated in numbers 4 and 5 above, the granting of the variance is not necessary for the preservation and enjoyment ora substantial property right of the applicant. 7. The contents of Planning Case VA95-38 are hereby entered into and made a part of the public record and the record of decision for this case. CONCLUSION Based upon the Findings set forth above, the Board of Adjustment hereby denies the requested variances as set forth above. Adopted by the Board of Adjustment on November 13, 1995.
