RESOLUTION 9519PC
A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE
CONSTRUCTION OF A PUBLIC BUILDING, (PRIOR LAKE PUBLIC
WORKS/PARKS MAINTENANCE FACILITY), WITHIN THE B-P, BUSINESS
PARK DISTRICT AT OUTLOT B, WATERFRONT PASSAGE ADDITION.
BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
1. The City of Prior Lake has applied for a Conditional Use Permit, (CUP) under
Section 7.5 of Prior Lake Zoning Ordinance 83-6.
2. The CUP application is to permit the construction of a public building within the B-
P, Business Park Zoning District.
3. The legal description of the subject site is Outlot B, Waterfront Passage Addition.
4. The Board of Adjustment has reviewed the CUP application as contained in Case
#CU9503, and held a hearing thereon on July 24, 1995.
5. The Board of Adjustment has considered the effect of the proposed CUP related to
conformance to the district and all general regulations of the Zoning Ordinance;
compliance with the performance standards listed as items 1-9, Section 7.5D of the
Zoning Ordinance; siting and landscaping of the site to produce a harmonious
relationship of buildings and grounds to adjacent buildings and properties;
provision of a total visual impression and environment which is consistent with the
environment of the neighborhood; organization of vehicular access and parking to
minimize traffic congestion in the neighborhood; preservation of the objectives of
the Zoning Ordinance and consistency with the Comprehensive Plan.
6. The proposed public building, (Public Works and Park Maintenance Facility), can
be approved with conditions which will make it possible to use the subject property
in such a way that the proposed CUP will not result in the impairment of an
adequate supply of light and air to adjacent properties, unreasonably increase
congestion in the public streets, increase the danger of fire, and danger to the public
safety, unreasonably diminish or impair health, safety, comfort, morals or in any
other respect be contrary to the Zoning Ordinance and Comprehensive Plan.

7. The contents of Planning Case CU95-03 are hereby entered into and made a part of
the public record and the record of decision for this case. Pursuant to Section 5-6-8
of the Ordinance, the CUP will be deemed to be abandoned, and thus will be null
and void one (1) year from the date of approval if the holder of the variance has
failed to obtain any necessary, required or appropriate permits for the completion of
contemplated improvement.
CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby grants and
approves the CUP subject to the following conditions:
1. Amendment of the Landscape Plan to incorporate additional trees along the berm
located on the north side of the principal building.
2. Successful amendment of the Zoning Ordinance to permit accessory structures within
the B-P, Business Park Zone.
3. Approval of the final plat of "Waterfront Passage 2nd Addition."
4. Site plan approval from the City Development Review Committee.
5. Filing of this document with the Office of the Scott County Recorder.
