A RESOLUTION DENYING A REQUEST FOR A 4 FOOT SIDE YARD SETBACK
VARIANCE AND 4 FOOT FRONT YARD SETBACK VARIANCE TO PERMIT
CONSTRUCTION OF AN ATTACHED 2-CAR GARAGE IN THE R-1 SUBURBAN
RESIDENTIAL DISTRICT AT 16069 CAMBRIDGE CIRCLE SE.
BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
Janet Brockhouse has applied for variances from Section 4.2 of the Zoning
Ordinance in order to permit construction of an attached 2-car garage on property
located in the RI-Suburban Residential district at the following location, to wit;
The subject property is legally described as Lot 3, Block 2, Prior Acres
2nd Addition, Scott County, Minnesota
The Board of Adjustment has reviewed the Application for Variance as contained
in Case #VA95-13, and held heatings thereon on May 8 and June 12, 1995.
The Board of Adjustment has considered the effect of the proposed variance
upon the health, safety, and welfare of the community, the existing and
anticipated traffic conditions, light and air, danger of fire, risk to the public
safety, the effect on property values in the surrounding area and the effect of the
proposed variances on the Comprehensive Plan.
There are other, alternative locations for the proposed garage which would not
require a variance. For that reason, literal enforcement of the Zoning Ordinance
would not result in undue hardship with respect to the property.
The basis for the request is convenience and cost of other alternatives, and does
not result from circumstances unique to the subject property.
For the reasons stated in numbers 4 and 5 above, the granting of the variance is
not necessary for the preservation and enjoyment of a substantial property right of
the applicant

7. The contents of Planning Case VA95-13 are hereby entered into and made a part
of the public record and the record of decision for this case.
CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby denies the
requested variances as set forth above.
