COMMENTS: -ST~ 10 T~ t2.H"'l'W \~~S-I ~'l-? In connection with the City's evaluation of John Bizal's proposed business use of the CJ Marine property, it appears that some right to do on-site repairs or service is grandfathered, particularly if the activity is confmed to areas within the existing building and at or below the historic levels on the property. HUEMOELLER, BATES & GONTAREK PLC 16670 Franklin Trail Prior Lake, MN 55372 (612) 447-2131 Fax: (612) 447-5628 To; Jane Kansier City of Prior Lake Date: From: Pages: Fax#: 447-4245 Subject: When we briefly discussed Mr. Bizal's proposal, you mentioned that any pre- existing nonconforming use status may have been lost because it has been more 6 than months since the marine business was last operated. I recently looked at Minn, Stat.~462.357, Subd. 3e, see attached, and noted that it allows a one year period of discontinuance before the termination of nonconfonning use. I am wondering if this statute would provide the authorization for Mr. Bizal to conduct the relatively minor non-retail portions of his business on the premises. A Eutectic+Castolin AirLux~ Welding Fume Eliminator removes fumes at the source It is portable. which means it can be carried to any job - wherever it may be - in the shop, in confined areas, on the production floor, even in the office Welding jobs can be done anytime, any place, without disrupting work schedules And the AirLux~ Welding Fume Eliminator can save in other areas. There is no need to vent expensive plant heat as with other methods. And you'll never have to move permanent venting systems as your production needs change., .the AirLux@ Fume Eliminator gives you the flexibility to adapt to any change, any challenge, Consider cost effectiveness. The AirLux~ Welding Fume Eliminator is priced well below other. less velsatile systems, AirLux' filters normally operate effectively for months and can be changed lt1 seconds by the welder, and the unit is virtually maintenance, free, (Servicing can be done easily by your own plant staff or by your Eutectic+Castolin Applications Specialist).
