CONSIDER APPROVAL OF A RESOLUTION REQUESTING THE
CONVEYANCE OF TAX FORFEITED PROPERTIES TO THE CITY OF
PRIOR LAKE FOR PUBLIC USE
Introduction
This agenda report recommends the City Council authorize a request to the
State of Minnesota to convey two tax forfeited properties to the City for public
use. One of the parcels will provide a future trail connection to currently
undeveloped property. The other parcel is a portion of Welcome Avenue.
History
The City of Prior Lake received a list of non-conservation lands located within
the City that have been forfeited to the State of Minnesota due to non-payment
of taxes. Minnesota Statutes 282.01, S 1 a allows the Commissioner of
Revenue to convey tax-forfeited parcels to the City for an authorized public
use.
Current Circumstances
There are two properties currently in tax-forfeiture in the City of Prior Lake.
The first parcel is described as Outlot A, Maple Hill 2nd Addition. This parcel is
a 15' wide by 140' deep strip of land, originally intended to provide future trail
access to the unplatted property to the north. The City has fee title to the 15'
wide strip of property directly adjacent to this parcel.
The second parcel is a 60' wide by approximately 200' deep strip of land
located adjacent to the property at 16860 Welcome Avenue. This strip of land
is actually part of the traveled Welcome Avenue right-of-way. The portions of
Welcome Avenue to the north and south of this piece are already considered
public right-of-way.
In order to claim title to these parcels, the City must have a specified public
use. The Maple Hill 2nd Addition parcel was intended to provide trail access to
the unplatted property to the north. This parcel should have probably been
deeded to the City as part of the development. The City should maintain this
future access.
The Welcome Avenue parcel is part of the traveled right-of-way. In order to
maintain access, the City has a specified use of this parcel as public road.
There is no financial impact to the City with this action. Property taxes have
not been paid on either of these parcels. The parcels are not developable.
Furthermore, the City has a specified public use for each parcel.

ALTERNATIVES:
The City Council has the following alternatives:
1. Adopt a resolution requesting the conveyance of these parcels to the City
for a specified public use.
2.. Deny the attached resolution. In this case, the City Council should direct
staff to prepare a resolution approving the parcels for public sale.
RECOMMENDED
MOTION:
The staff recommends Alternative #1. This requires the following motion:
Motion and second adopting a resolution requesting the conveyance of the two
tax-forfeited parcels to the City for a specified public use.

A RESOLUTION REQUESTING THE CONVEYANCE OF TAX FORFEITED PROPERTIES TO THE
CITY OF PRIOR LAKE FOR PUBLIC USE

WHEREAS, The City of Prior Lake has received notice of non-conservation lands located within the
City forfeited to the State of Minnesota due to the nonpayment of taxes; and
WHEREAS, Minnesota Statutes 282.01, S 1 a allows the Commissioner of Revenue to convey tax-
forfeited parcels to the City for an authorized public use; and
WHEREAS, The City has a specified public use for each of the tax-forfeited parcels.
NOW THEREFORE,.BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City has a specified public use for each of the following parcels:
a) Parcel #25-343029-0, Outlot A, Maple Hill 2nd Addition (park and trail)
b) Parcel #25-901012-1, P/O E % of SE ~, Section 1, Twp 114, Range 22 (road right-of-way).
PASSED AND ADOPTED THIS 1ST DAY OF AUGUST, 2005.
