HomeMy WebLinkAbout9B Crystal Bay PUD Amendment Report 4646 Dakota Street SE Prior Lake, MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: NOVEMBER 28, 2016 AGENDA #: 9B PREPARED BY: CASEY MCCABE, COMMUNITY DEVELOPMENT SPECIALIST PRESENTED BY: CASEY MCCABE AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AMENDING THE FINAL PLANNED UNIT DEVELOPMENT (PUD) PLAN KNOWN AS CRYSTAL BAY TOWNHOMES DISCUSSION: Introduction DBOW Properties and the Crystal Bay Homeowners’ Association have applied for approval of a minor amendment to the Planned Unit Development (PUD) known as Crystal Bay Townhomes on property located south of CSAH 82, ap- proximately ½ mile west of CSAH 21. History The Crystal Bay Townhomes Planned Unit Development (PUD) was approved by the City Council on December 1, 2003. The approved PUD Plan included 24 townhouse units in 12 buildings. The proposed townhouses were a 3-story walk- out, attached single family style dwelling with an attached garage. The Prior Lake City Council has granted multiple PUD amendments in the past which allowed for the remaining residential lots to change construction styles be- tween detached single-family units and attached twin-home units, adjust the size of the units and modify the exterior elevations and building materials. Current Circumstances The applicants, DBOW Properties and the Crystal Bay Homeowners Association, have applied for a minor amendment to the PUD requesting a waiver from the requirements of Subsection 1104.805 4.(c) of the City of Prior Lake Shoreland Regulations. Subsection 1104.805 4.(c) states, in part, “The number of spaces provided for continuous beaching, mooring, or docking of watercraft shall not ex- ceed one for each allowable dwelling unit or site in the first tier.” When the Crystal Bay Townhomes PUD was originally approved, there were 20 dwelling units proposed within the first tier of the development which allowed 20 boat slips. One additional boat slip was permitted for loading and unloading of equipment for use by occupants of dwelling units on sites located in other tiers; for a total of 21 boat slips. Subsequent PUD amendments resulted in only 19 dwelling units constructed within the first tier of the development. The applicants have requested approval of 23 boat slips to allow each dwelling unit within the PUD to have one boat slip. To allow 23 boat slips, the Prior Lake City Council must approve a resolution approving a minor PUD amendment and a waiver from the requirements of Subsection 1104.805 4.(c) of the City of Prior 2 ISSUES: Lake Shoreland Regulations. No more slips can be requested since no more dwellings on can be constructed within this PUD. Conclusion The applicant has indicated there is sufficient room on the existing dock system for 23 boat slips and there will be no additions to the current dock. Staff does not believe the proposed amendment will change the character of the PUD, and therefore, staff recommends approval of the minor amendment to the Crystal Bay Townhomes PUD subject to the following condition: 1. The Crystal Bay Townhomes Common Interest Community Declaration shall be updated and recorded to identify boat slip numbers and the unit to which each individual boat slip is assigned. Approval or consent from the Minnesota Department of Natural Resources is re- quired for any modification or waiver of the City of Prior Lake Shoreland Regula- tions. City staff has provided a copy of this memo and discussed this request with the DNR Area Hydrologist and received written consent from the MNDNR related to this request. ALTERNATIVES: 1. Motion and a second to adopt a resolution amending the Final Planned Unit Development (PUD) Plan known as Crystal Bay Townhomes. 2. Motion and a second to deny the resolution amending the Final Planned Unit Development (PUD) Plan known as Crystal Bay Townhomes. 3. Location Map 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 16-XXX A RESOLUTION AMENDING THE FINAL PLANNED UNIT DEVELOPMENT (PUD) PLAN KNOWN AS CRYSTAL BAY TOWNHOMES Motion By: Second By: WHEREAS, DBOW Properties and the Crystal Bay Homeowners’ Association have applied for an amendment to the Planned Unit Development Final Plan known as Crystal Bay Townhomes requesting a waiver from the requirements of Subsection 1104.805 4.(c) of the City of Prior Lake Shoreland Regulations; and WHEREAS, Subsection 1104.805 4.(c) states, in part, “The number of spaces provided for continuous beaching, mooring, or docking of watercraft shall not exceed one for each allowable dwelling unit or site in the first tier.”; and WHEREAS, Upon full development, Crystal Bay Townhomes will have 23 dwelling units with 19 dwelling units within the first tier of the development; and WHEREAS, The applicants have requested an amendment to the Crystal Bay Townhomes PUD to allow 23 total boat slips to permit each dwelling unit within the PUD to have one boat slip; and WHEREAS, The proposed amendment is a “minor amendment” for administrative and procedural purposes; and WHEREAS, The Prior Lake City Council considered the proposed Final PUD Plan Amendment on November 28, 2016; and WHEREAS, The City Council finds the Final PUD Plan to be in substantial compliance with the approved Preliminary PUD Plan; and WHEREAS, The City Council finds the PUD Final Plan is compatible with the stated purposes and intent of the Section 1106 Planned Unit Developments of the Zoning Ordinance. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The Amended Planned Unit Development Final Plan to allow 23 boat slips is hereby approved subject to the following condition: a. The Crystal Bay Townhomes Common Interest Community Declaration shall be updated and recorded to identify boat slip numbers and the unit to which each individual boat slip is assigned.
