Request
DBOW Properties and the Crystal Bay HOA have applied
for a minor amendment to the PUD requesting a waiver
from the requirements of Subsection 1104.805 4.(c) of the
City of Prior Lake Shoreland Regulations.
Approval would allow 23 HOA boat slips.
21 boat slips currently permitted
Subsection 1104.805 4.(c) states, in part, “The number of
spaces provided for continuous beaching, mooring, or
docking of watercraft shall not exceed one for each
allowable dwelling unit or site in the first tier.”
Recommendation
Staff has worked with the City Attorney and the DNR Area
Hydrologist to obtain DNR consent.
The applicant has indicated there is sufficient room on the
existing dock system for 23 boat slips and there will be no
additions to the current dock.
The proposed amendment will not change the character
of the PUD, and therefore, staff recommends approval of
the minor amendment to the Crystal Bay Townhomes PUD
subject to the following condition:
The Crystal Bay Townhomes CIC Declaration shall be
updated and recorded to identify boat slip numbers and the
unit to which each individual boat slip is assigned.
