RESOLUTION OF THE PRIOR LAKE PLANNING COMMISSION RECOMMENDING THE
CITY COUNCIL APPROVE THE PRELIMINARY PLAT OF "PHEASANT MEADOW"
SUBJECT TO THE CONDITIONS OUTLINED HEREIN.

WHEREAS:
the Prior Lake Planning Commission conducted a public hearing on February 26, 1996
and March 25, 1996, to consider an application from Williams Development LLC, for
the preliminary plat of Pheasant Meadow; and
WHEREAS:
notice of the public hearing on said preliminary plat has been duly published and
posted in accordance with the applicable Minnesota Statutes and Prior Lake
Ordinances; and
WHEREAS:
the Planning Commission proceeded to hear all persons interested in this issues and
persons interested were afforded the opportunity to present their views and objections
related to the preliminary plat of Pheasant Meadow; and
WHEREAS:
the Planning Commission reviewed the preliminary plat according to the applicable
provisions of the Prior Lake Zoning and Subdivision Ordinances and found said
preliminary plat to be consistent with the provisions of said ordinances; and
WHEREAS: the Planning Commission finds the preliminary plat of Pheasant Meadow to be
consistent with the Year 2000 Comprehensive Plan.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE PLANNING COMMISSION OF
THE CITY OF PRIOR LAKE, MINNESOTA, that it hereby recommends the City Council approve
the preliminary plat of Pheasant Meadow subject to the following conditions:
Approval of the Schematic and Preliminary PUD for Pheasant Meadow to allow a cluster,
townhome development.
2. Approval of Ordinance 96-10 establishing a PUD zone for Pheasant Meadow.
The preliminary plat shall be amended so there is no structure, (deck), encroachment into the setback
areas adjacent to the boundaries of the plat.
The landscape plan shall be amended to show the required irrigation system as per the Zoning
Ordinance.
The landscape plan should be amended to add additional shrubs and ornamental trees around the
entry monument, and to provide for boulevard tree plantings.

A Tree Preservation Plan shall be submitted to the City in accordance with Section 6.16 of the
Prior Lake Zoning Ordinance.
The developer shall submit a draft of the covenants and/or agreements as a condition of preliminary
plat, as required by the Subdivision Ordinance.
The developer shall provide the required covenants and easements for proposed entry monuments as
required by Sign Ordinance 94-6.
Per Ordinance 94-01, a minimum of 30' setback from the 100 Year Flood Elevation to all
building pads and house locations is required.
A 5' wide concrete sidewalk shall be constructed along the entire length of Pheasant Meadow Lane to
the end of the cul-de-sac and be connected to an 8' bituminous trail providing a pedestrian link to the
east edge of the plat. The specific trail location to be determined by staff.
A 5' wide concrete sidewalk shall be located on the south side of Spruce Road which should be
constructed with the installation of other streets in the PUD.
A 30' wide trail easement over the 8' bituminous trail shall be given to the City of Prior Lake at the
time of final plat.
The park requirement for the subdivision will be a cash dedication in lieu of land, the amount to be
determined at the time of final plat.
The developer should re-examine if the sanitary sewer line on Balsam Street would be deep enough
to serve this site. If the Balsam Street sewer line will not work, then the developer will need to
construct the sewer line in between the houses on Lots 3 and 4 of Sunset Hills as shown on the
preliminary utility plans.
The name "Spruce" Road shall be changed to a street name which is not currently used in the City of
Prior Lake.
Balsam Street should be connected to Meadow Lane as indicated by the alternative shown on the
preliminary plat. A sidewalk should be constructed along Balsam Street, with the specific location to
be determined by City staff.
Spruce Road should be moved to the south approximately 100' feet in order to provide enough depth
to lots in the future neighborhood commercial district to the east. The road relocation can be
accomplished without loss of units within the development. Some modification to the large storm
water pond south of proposed Spruce Trail may be required as a result of the road relocation.
Dedication of 50' of right-of-way for 170th Street on CSAH 12, shall be required at the time of final
plat, to accommodate the future upgrading of this street to a two (2) lane urban design with
bituminous trails.
Dedication of drainage and utility easements shall be required at the time of final plat, over the
southeast stormwater pond and all sewer and water lines constructed outside of the dedicated right-
of-way.
The developer shall be responsible to acquire additional temporary and permanent drainage and
utility easements on Lots 3 and 4 of Block 5 of Sunset Hills Addition, prior to the construction of the

8" sanitary sewer line proposed to be constructed along the common lot line in between these lots.
The developer will be responsible for all costs associated with obtaining these easements.
As shown on the preliminary utility plans, the sanitary sewer layout shall include an 8" sanitary sewer
stub and an 8" watermain stub in Spruce Road to serve the future development to the east.
An 8" watermain shall be extended to the south plat line to serve possible future development to the
south of Highway 13.
The small pond located in the west central portion of the site shall be deleted.
Five complete full-size and one 11" x 17" set of the preliminary plat indicating all required
changes identified herein, shall be submitted to the Planning Department prior to submission of
a final plat for the development. Said full-size plan sheets shall be at the same scale as the final
plat.
The preliminary plat is valid for 12 months from the date of approval by the City Council.
Failure to submit the final plat of the within the required time frame shall cause the preliminary
plat to become null and void.

RESOLUTION FOR THE VACATION
OF PART OF A ROADWAY EASEMENT(RETAINING UTILITY EASEMENT)
LOCATED ON THE OLD CHATONKA BEACH TRAIL,LOCATED NORTH OF
EXISTING BEACH STREET AND EAST OF BLUEBIRD TRAIL

WHEREAS. The City of Prior Lake is the holder of permanent easements for public
utility and roadway purposes as evidenced by that certain partial certificate
of completion filed as Document No.238700;and
WHEREAS, the City of Prior Lake, on its own motion, pursuant to Minnesota Statutes
Section 412.851, endeavors to vacate a portion of the roadway easement,
retaining all public right, title and interest in the public utility easement
under the document referenced above.
The legal description of the portion of the public roadway easement to be
vacated is as follows:
Vacation of a portion of an easement for public roadway purposes over,
under, and across the one rod wide (16.5 feet) road according to Document
No. 238700 on file in the Office of the Recorder, Scott County, Minnesota,
more specifically described as follows;
1. Commencing at the southeast corner of the south 112 of the northeast 1/4
of Section 26, Township 115, Range 22, Scott County, Minnesota, thence
South 88 degrees 53 minutes 29 seconds West, assumed bearing, along the
north line of Government Lot No. 3 a distance of 592.56 feet to the point of
beginning; thence South 88 degrees 53 minutes 29 seconds West to the
northeast corner of Lot 4, Block 5, Knob Hill, according to the record plat
on file in the office of the County Recorder, Scott County, Minnesota a

WHEREAS, a Public Hearing was held on said motion to vacate on Monday, May 20,
1996, in the Council Chambers located at the Prior Lake Fire Station#l;and
WHEREAS, the City Council then proceeded to hear all persons interested in said motion
and persons interested afforded the opportunity to present their views and
objections on said motion; and
WHEREAS, the City Council of Prior Lake has determined that the vacation of said
roadway easement and retention of the utility easement would be in the
public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
that pursuant to Minnesota Statues 412.851, the above described roadway easement situated in
the City of Prior Lake, Scott County, Minnesota is hereby vacated, and the public's title and
interest in the utility easement acquired under Document No.238700 shall be retained.
BE IT FURTHER RESOLVED that this Resolution will be forwarded to the Office of the
County Recorder, Scott County,for recording.

Improvement Project. - The City Manager explained the purpose of the
action and the recommendation.
Marge Kinney from the Prior Lake School Board inquired whether the
consideration was for only the Westwood Elementary School project. The
Mayor and the City Manager responded in the affirmative.
MOTION BY KEDROWSKI, SECONDED BY SCHENCK TO
APPROVE RESOLUTION 96-62 AUTHORIZING PARTIAL FEE
WAIVER FOR WESTWOOD ELEMENTARY SCHOOL
IMPROVEMENT PROJECT.
Ms. Kinney thanked the Council for the action.
Upon a vote being taken, ayes by Andren, Greenfield, Kedrowski, Mader
and Schenck,the motion carried.
B. Consider Approval of Vacation of Street Easement for portions of
Chatonka Beach Trail. - The Mayor stepped down as she had at the public
hearing, due to a conflict of interest; she handed the gavel to Mayor Pro
Tem Greenfield. The City Manager explained the background per the
Staff Agenda Report, and the need for a 4/5 vote. He explained that the
public hearing has been held and closed.

INTRODUCTION: The public hearing for this item was opened on April 15, 1996,
but was continued to May 20, 1996, so that individual, affected
property owners could be notified. Public hearing notices were
mailed to these property owners on May 1, 1996, consistent
with the statutory notice period.

SUBJECT: Public hearing to consider vacation of part of a roadway
easement located on the old Chatonka Beach Trail, located
north of existing Beach Street and East of Bluebird Trail
DATE: April 9, 1996
INTRODUCTION: The purpose of this public hearing is to consider the vacation of
part of a roadway easement located on the old Chatonka
Beach Trail (See Exhibit A, attached hereto, for the location of
the easement). At or about the time of Council approval of the
final plat approval of Knob Hill, city staff was directed by the
Council to pursue the vacation of the roadway easement.
Notice of the hearing was published in the Prior Lake American
on March 30, and April 6, 1996. However, individual notices
were not sent to the Beach Street neighborhood. For this
reason, staff recommends that the City Council open the public
hearing, and continue it to allow time for individual notices to
be sent.
BACKGROUND: The City Engineering Department has reviewed the proposed
release of Easement No. 84-8, and has concluded that the
roadway portion should be released as shown on Exhibit A.
This easement was originally acquired by the City through
condemnation.
DISCUSSION: In a vacation request, the City must determine whether there is
a public need or anticipated future need for the dedicated
property. After review, the Engineering staff has concluded that
there is existing and future need for the easement for drainage
and utility purposes, and future need for a portion of the
roadway easement.
The public needs identified by City Staff are as follows;
1. As a part of the recent plat of Knob Hill, water quality ponds
were installed. One of these ponds is adjacent to the

subject easement. In some areas the existing gravel
roadway will be removed as part of the grading of the pond.
To create additional water quality and water storage in the
future, the 16.5' easement would be needed to expand to
the West. (See Grading Plan attached)
2. The existing gravel surface within the subject easement is
an ideal area for heavy equipment to maneuver around the
pond without causing damage to the yards of the adjacent
lots. (See Grading Plan attached)
3. As shown on the "Utility Map" (a copy of which is attached)
the City does have several underground utilities at the
Southwest end of the easement (i.e. near Beach Street).
Most notable is the sanitary sewer located at the South end
of Lot 4, Block 4, Knob Hill. This sewer is approximately 28
feet deep. There is also a storm sewer that cuts across the
existing easement near Beach Street. It is imperative that
the utility portion of this easement be retained for future
maintenance of these facilities.
4. The roadway easement at Hemlock Circle should be
retained, so that if the property to the East develops, 50
feet of right-of-way will be available. (See Exhibit A
attached)
ALTERNATIVES: 1. Approve Resolution 96-29 authorizing the vacation of part
of a roadway easement located on the old Chatonka
Beach Trail.
2. Continue the public hearing until the May 20, 1996, City
Council meeting.'
RECOMMENDATION: Alternative #2, i.e. Continuation of the public hearing to allow
individual notices to be sent.
ACTION REQUIRED: A motion to continue the public hearing.

You are hereby notified that the Prior Lake City Council will hold a continued public hearing at
Prior Lake Fire Station #1, located at 16776 Fish Point Road SE. (Southwest of the intersection
