A RESOLUTION DENYING A REQUEST FOR LAKESHORE, FRONT AND SIDE
YARD SETBACK VARIANCES BY THOMAS AND CHERYL VIDMAR IN
CONNECTION WITH A PROPOSED NEW HOUSE ON PROPERTY LOCATED IN
THE RI-URBAN RESIDENTIAL ZONING DISTRICT AND SD-SHORELAND
DISTRICT AT 4307 GRA1NWOOD CIRCLE.
BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
Thomas and Cheryl Vidmar have applied for variances from Section 4 and 9 of
the Zoning Ordinance in order to permit the construction of a new house on
property located in the R1-Urban Residential zoning district and the SDo
Shoreland District at the following location, to wit;
4307 Grainwood Circle, legally described as Lot 18, GRA1NWOOD
PARK, Scott County, Minnesota.
The Board of Adjustment has reviewed the application for variance as contained
in Case 96-023VA and held a hearing thereon on March 25, 1996.
The Board of Adjustment has considered the effect of the proposed variances
upon the health, safety, and welfare of the community, the existing and
anticipated traffic conditions, light and air, danger of fire, risk to the public
safety, the effect on property values in the surrounding area and the effect of the
proposed variances on the Comprehensive Plan.
The request does not meet the Ordinance criteria, in that the applicants have legal
alternatives to make reasonable use of the property.
The granting of the variance is not necessary for the preservation and enjoyment
of a substantial property right of the applicant. The variance would serve merely
as a convenience to the applicant, but is not necessary to alleviate demonstrable
hardship.
The contents of Planning Case 96-023VA are hereby entered into and made a part
of the public record and the record of decision for this case.

CONCLUSION
Based upon the Findings set £orth above, the Board o£ Adjustment hereby denies thc
requested variances.
