SCHOELLER ON BEHALF OF CAROL'S FURNITURE FOR A 35 FOOT FRONT YARD SETBACK VARIANCE TO PERMIT A FRONT YARD OF 15 FEET INSTEAD OF THE REQUIRED 50 FOR CONSTRUCTION OF AN ADDITION ON PROPERTY LOCATED IN THE BI-LIMITED BUSINESS ZONING DISTRICT AT 16511 ANNA TRAIL. BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota; FINDINGS John J. Schoeller has applied for a variance from Section 4 of the Zoning Ordinance in order to permit the construction of an addition on property located in the B 1-Limited Business zoning district at the following location, to wit; 16511 Anna Trail, legally described on Exhibit A, attached hereto. The Board of Adjustment has reviewed the application for variance as contained in Case 96-022VA and held a heating thereon on March 25, 1996. The Board of Adjustment has considered the effect of the proposed variance upon the health, safety, and welfare of the community, the existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, the effect on property values in the surrounding area and the effect of the proposed variances on the Comprehensive Plan. The request meets the Ordinance criteria, in that the applicant has no legal alternatives to make reasonable use of the property which would not interfere with parking and loading on the site, and the continuation of business during construction of the proposed addition. The granting of the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant. The variance would not serve merely as a convenience to the applicant, but is necessary to alleviate demonstrable hardship. The contents of Planning Case 96-022VA are hereby entered into and made a part of the public record and the record of decision for this case. 16200 ~!~cOmOc/~ve. S.E., Prior Lake. Adopted by the Board of Adjustment on March 25, 1996. ATTEST: Richard Kuykendall, Chair Donald R. Rye, Planning Director 9610PC.DOC/CC 2
