AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING FULL AND FI-
NAL PAYMENT TO NORTHWEST ASPHALT FOR THE BOUDINS NEIGH-
BORHOOD IMPROVEMENTS, PHASE II (CITY PROJECT #TRN12-000001)
DISCUSSION: Introduction
The purpose of this item is to authorize full and final payment for the Boudin’s
Neighborhood, Phase II Reconstruction Project which includes Boudin Street,
Timothy Avenue, Natalie Road, Lois Avenue, and Denese Street. This project
included sanitary sewer, watermain, storm sewer, and street reconstruction.
History
On May 7, 2012, the City Council awarded a construction contract to Northwest
Asphalt for the Boudin’s Neighborhood Improvements Phase II, City Project
#TRN12-000001. All work under the contract has been completed in accordance
with the contract. All punch list items have been completed and any additional
repairs will be covered under the project warranty.
Current Circumstances
The final payment amount is $70,726.44. With this payment, the total final con-
tract amount paid to Northwest Asphalt will be $2,032,930.35. This amount is
$254,265.63 less than the original contract amount of $2,287,195.98. Although
the amount is $254,265.63 less than the original contract, $86,860.50 was for bid
items relating to private driveway replacement. These cost items are included in
the bidding of the project but is paid by each property owner participating in the
private driveway program. Without the private driveway bid costs, the amount is
$167,405.13 less than the original contract amount which is 7.3% under the pro-
ject budget.
Conclusion
Northwest Asphalt delivered a quality project, under budget, and has addressed
the outstanding work items. It is appropriate to provide full and final payment at
this time.
ISSUES: The final acceptance and payment for the project has taken longer than expected
due to warranty issues. These issues have been rectified.
FINANCIAL
IMPACT:
Funding for the final payment is available in the Construction Fund for this project.
The final project costs are as follows:

The original budget for this project was $2,679,026.94.

The final work requires the transfer of dollars from the Construction Fund into the
Water Fund, the transfer of dollars from the Sewer Fund into the Construction
Fund and a transfer of dollars from the Construction Fund to the Storm Utility
Fund.
The transfer from the Construction Fund to the Water Fund is $24,871.37.
The transfer from the Sewer Fund to the Construction Fund is $4,286.48.
ALTERNATIVES: 1. Approve a resolution authorizing full and final payment to Northwest Asphalt
for the Boudin’s Neighborhood Improvements Phase II Project #TRN12-
000001.
2. Remove this item from the consent agenda for additional discussion.

RESOLUTION 16-XXX
A RESOLUTION AUTHORIZING FULL AND FINAL PAYMENT TO NORTHWEST ASPHALT
FOR THE BOUDINS NEIGHBORHOOD IMPROVEMENTS, PHASE II (CITY PROJECT
#TRN12-000001)
Motion By: Second By:
WHEREAS, On May 7, 2012, the City Council adopted Resolution 12-066 which authorized
the City to accept bids and award the City’s standardized construction contract
for the Boudins Phase II improvement project.
WHEREAS, The Contract outlined the improvements Northwest Asphalt was responsible for
installing; and
WHEREAS, These improvements and all other Contract responsibilities are now complete to
the satisfaction of the City; and,
WHEREAS, The City Engineer has reviewed the improvements and has written the
acceptance letter for this project.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council hereby accepts the improvements for Boudins Phase II.
3. Final payment will be made to Northwest Asphalt in the amount of $70,726.44.
4. The City Council hereby authorizes the following transfers for the project:
a. Transfer of $24,871.37 from the Construction Fund #501-43500.00-55010.00-TRN12-
000001 to the Water Fund #601-49400.00-55530.00
b. Transfer of $4,286.48 from the Sewer Fund #604-49450.00-55530.00 to the
Construction Fund #501-43500.00-55010.00-TRN12-000001
