HomeMy WebLinkAbout96-23PCRESOLUTION 9623PC A RESOLUTION APPROVING A REQUEST FOR A 10 FOOT VARIANCE TO PERMIT A FRONT YARD SETBACK OF 15 FEET INSTEAD OF THE REQUIRED 25 FEET FOR THE CONSTRUCTION OF A DECK AND PORCH ON THE PROPERTY LOCATED AT 16351 ALBANY AVENUE SE. BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota; FINDINGS Michael andKathleen Sorenson haves applied for a variance fi.om Section 4 of the Zoning Ordinance in order to permit the construction of a deck and screened porch on property located in the RI-Suburban Residential zoning district and the SD-Shoreland District at the following location, to wit; 16351 Albany Ave. SE., legally described on the attached copy of survey, Scott County, Minnesota. The Board of Adjustment has reviewed the application for variance as contained in Case 96-048VA and held a hearing thereon on June 10, 1996. The Board of Adjustment has considered the effect of the proposed variance upon the health, safety, and welfare of the community, the existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, the effect on property values in the surrounding area and the effect of the proposed variances on the Comprehensive Plan. The request meets the Ordinance criteria, in that the lot is substandard in area and a reasonable use of the property cannot be made without a variance. The granting of the variance is necessary for the preservation and enjoyment ora substantial property right of the applicant. The variance would not serve merely as a convenience to the applicant, but are not necessary to alleviate demonstrable hardship. 7. The contents of Planning Case 96-048VA are hereby entered into and made a part of the public record and the record of decision for this case CONCLUSION 9623PC.DOC/CC I Based upon the Findings set forth above, the Board of Adjustment hereby approves the requested variance.
