FEASIBILITY REPORT AND SCHEDULING A PUBLIC HEARING TO
CONSIDER THE 2017 MILL AND OVERLAY PROJECT
INTRODUCTION: The purpose of this agenda item is to accept the Feasibility Report and
schedule a Public Hearing to be held on March 13, 2017 for the 2017 Mill
and Overlay Project.
History
Each year the City mills and overlays street segments that are part of its
Capital Improvement Program (CIP). The City uses the CIP and its
Pavement Management Program to plan for infrastructure improvements
and the financing for capital improvements. Special assessments were
planned to be part of the financing for the project. Minnesota Statute
Chapter 429 identifies a process that applies to all projects that will be
financed in whole or in part through special assessments or bond
proceeds.
At its November 28, 2016 meeting the City Council adopted Resolution
16-147 authorizing staff to prepare a Feasibility Report for the 2017 Mill
and Overlay Project. The next step for the Council is to accept the
feasibility study and call for the Improvement Hearing. At the
Improvement Hearing, interested persons may voice their concerns,
whether or not they are in the proposed assessment area. A reasonable
estimate of the total amount to be assessed and a description of the
methodology used to calculate individual assessments for affected
parcels must be available at the hearing.
Current Circumstances
The 2017 Street Improvement Project affects approximately 3 miles of
roadway in the Cardinal Ridge and Five Hawks neighborhoods.
Proposed roadways to be improved are shown on the Location Map
provided in the feasibility study and include Crossandra Circle SE,
Crossandra St SE, Cardinal Ridge Tr SE, Parkview Dr SE, Kildeer Ln
SE, Mallard Way SE, Wren Ct SE, Parkview Circle SE, Parkview Dr SE,
Oriole Pl SE, Victoria Curve SE, High Pointe Ct SE, Overlook Circle SE,
Meadowview Ct SE, and Five Hawks Ave.
The proposed work type is a mill and overlay where the bituminous
pavement is edge milled and a layer of pavement, typically 1.5” thick, is

placed. This provides a smooth pavement surface as well as providing a
new structural layer to the roadway. Replacement of the curb and gutter
will occur where there is cracked or damaged curb and in locations to
improve drainage. The feasibility report explores the necessity of
rehabilitating the roadways within the developments as part of the City’s
ongoing Street Improvement program.
Conclusion
In summary, the project is feasible, necessary and cost-effective to
maintain the City’s road system. Approval of the Feasibility Report is the
next step in the 429 process and does not grant final approval of the
project. If the Council accepts the Feasibility Report, the Chapter 429
special assessment statute requires the Improvement Hearing be
conducted before the City Council considers ordering the project.
A public hearing is proposed for March 13, 2017. At that meeting, the
proposed improvements, project schedule and assessments will be
presented to residents.
ISSUES: The City’s assessment policy is being followed for this project. The
policy was updated in 2016 to include assessments for mill and overlay
type projects and a per lot amount was set as part of the City’s fee
schedule at the end of 2016. The Single Family Assessment Rate for a
mill & overlay was set at $1,200 per single family lot for 2017 (0.8 or
$960 for multifamily lots). The assessment repayment period is five (5)
years or $240/$196 each year plus financing costs per the assessment
policy.
Updates to the funding allocated to achieve the City’s pavement
management goals should be evaluated in the coming year as road
mileage has been added to the system and costs have had annual
inflationary increases. To provide the total funding needed to achieve
the City’s pavement management goals in 2017, staff recommends that
the Council consider carrying forward funds unused in 2016 for retaining
wall work that was postponed and will be completed with a future street
project. The council will be asked to carry these funds into 2017 at a
subsequent meeting as a budget amendment.
FINANCIAL
IMPACT:
The 2017 Mill and Overlay Project is proposed to be financed by Special
Assessments and the Street portion of the General Fund. Revenue will
come from two sources, the tax levy and special assessments. The total
amount proposed to be assessed is $350,357.00. The remaining
funding of $166,643 will come from the tax levy. The approved 2017
Capital Improvement Program and Budget contemplate these
expenditures.
If the city council does not support the special assessment, this item
should not be approved as this is the primary source of funding.
ALTERNATIVES: 1. Approve a Resolution accepting the Feasibility Report and
establishing a Public Hearing Date.

A RESOLUTION ACCEPTING THE FEASIBILITY REPORT AND SCHEDULING A PUBLIC
HEARING TO CONSIDER THE 2017 MILL AND OVERLAY PROJECT

WHEREAS, Pursuant to Resolution 16-147, the City Council, on November 28, 2016 ordered a
Feasibility Report to be prepared by the City’s Public Works Director with reference
to the 2017 Mill and Overlay Project; and
WHEREAS, The Feasibility Report for the 2017 Mill and Overlay, dated February 13, 2017
contains information that the proposed project is necessary, cost effective, and
feasible.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council hereby accepts the Feasibility Report as submitted.
3. The Council will consider the improvement of such streets and areas in accordance with the
Report and the assessment of property as described in the Report for all or a portion of the
cost of improvements pursuant to Minnesota Statutes Chapter 429 at an estimated cost of
the improvements of $517,000.00
4. A Public Hearing shall be held on such proposed improvements on the 13th of March, 2017
at Prior Lake City Hall, with the address of 4646 Dakota St SE, City of Prior Lake, Minnesota
at 7:00 p.m. statutory notice and publication requirements shall be followed.

Executive Summary

The cost for the proposed improvement, including the 10% contingency and Legal,
Administrative, Engineering and Finance (LEAF) costs is $515,236.21.
Project Location
The project is located in Sections 2, Township 114, Range 22 Five Hawks (SW Quarter section)
and Sections 1, Township 114, Range 22 Cardinal Ridge (NE Quarter sections) in the City of Prior
Lake, Scott County, Minnesota.
Project History
On November 28, 2016, the City Council ordered the preparation of a feasibility study for the
2017 Street Improvements Project (Street Project STR17-0000001). The feasibility study is
necessary because a portion of the funding for this project is proposed to come from special
assessments. State Statutes dictate that a feasibility study can either be initiated by a petition
of the affected property owners, or at the direction of the City Council. This project was
initiated at the direction of the City Council.
This report is intended to consider the areas listed below. Identification of these areas is a
result of the City’s ongoing Pavement Management Program. The program was implemented to
maximize the useful life of the City’s streets.
Based on the Pavement Management Program data and field reviews by City staff, the
following streets have been identified to be included in the 2017 Street Improvements:

Proposed Improvements
Mill & overlay is proposed for the streets in the project area. For mill & overlay, approximately
1.5- inch of the existing bituminous surface near the curbs will be milled and removed from site.
A new layer of bituminous pavement will be placed over the entire roadway width to provide a
smooth surface and new structural layer.
Existing curb and gutter will remain in place except sections of damaged curb and gutter, and
areas that do not drain properly. City staff will inspect the curb and gut ter for cracking and/or
settlement and the actual quantity of curb replacement will be marked for replacement prior to
the project start. The Contractor would be responsible for restoring any disturbed areas behind
the curb after replacement. This restoration may include seed, sod, driveway pavement and/or
landscaping.
Right-of-Way and Easements
No additional right of way or easements are required for this project. If any issues arise,
requiring access outside of the existing right-of-way and easements, staff will handle these on a
case-by-case basis and work with the affected property owner to obtain right of entry.
Private Utilities
Staff will work with all private utility companies to identify, locate, and avoid damaging the
existing service lines in the area. Staff will also work with residents to have the resident locate
their sprinkler systems, landscaping and any underground fencing.
Permits and Approvals
The majority of the work proposed is within the City’s right-of-way. Since the proposed
improvements consist of a mill and overlay, no additional permits are anticipated.
Operational Issues and Costs
No unusual maintenance concerns or costs are expected due to the construction. One of the
segments of proposed work, Five Hawks, is located adjacent to an elementary school. The work
is scheduled to occur during the summer before fall classes begin.
Opinion of Probable Cost
Included in the Appendix of this report is an opinion of probable costs. The costs are estimated
based on recent construction projects in the City of Prior Lake and assume the installation of
the improvements will be completed in 2017. The costs in the appendix are based on the
proposed mill and overlay.

Proposed Funding
As reflected in this funding allocation, staff anticipates a single project in 2017, primarily using
the pavement management allocation in the Street portion of the General Fund. Revenue will
come from two sources, the tax levy and special assessments. The total amount proposed to
be assessed is $350,357.00. The remaining funding of $166,643 will come from the tax levy.
Proposed Assessments
The City’s assessment policy is being followed for this project. The policy was updated in 2016
to include assessments for mill and overlay type projects and a per lot amount was set as part
of the City’s fee schedule at the end of 2016. As this project involves only a basic mill & overlay,
it is unlikely benefit appraisals will be required; ordering of benefit appraisals will be at the
discretion of the City Attorney.
The Single Family Assessment Rate for a mill & overlay was set at $1,200 per lot for 2017. The
assessment repayment period is five (5) years per the assessment policy.
Per the preliminary assessment roll attached, there are 294 residential properties proposed to
be assessed making up 292 assessment units based on the Assessment Policy adjustments for
property types. Included are the Prior Lake School District (Five Hawks Elementary) and Faith
Evangelical Church. The units for these lots was based on the total area compared to a typical
residential lot. Condominium units are proposed to be assessed 0.8 units. The remaining single
family and townhome lots are proposed to be assessed for 1 unit.
