History Each year the Minnesota Vikings host a winter celebration (Winterfest) in a differ- ent Minnesota community. This year Winterfest will be held in Prior Lake on Feb- ruary 16 – 18, 2017. There are many events planned throughout the Prior Lake community over this three-day event. Several events, including an ice village, ice fishing contest, ice concert, fireworks and ice bar will be held on Prior Lake just off the shore of Charlies on Prior on Saturday, February 18, 2017. Current Circumstances Charlies on Prior currently holds an on-sale intoxicating liquor license which allows them to sell intoxicating liquor on the premises of 3950 Green Heights Trail SE. The premise for this license also includes the patio and dock areas, but does not include any areas on the lake, therefore a temporary extension of their license is required for this event. An ice bar is planned for the event area on Prior Lake and the perimeter of the event area will be fenced off. The temporary extension of the liquor license for Charlies on Prior will allow them to sell alcohol from the ice bar. Liquor sales and consumption will be limited to the fenced in area. Two police of- ficers will be hired by Charlies on Prior to provide security services for this event. They will be on duty from 2 – 11 PM. The extension of the liquor license will only be valid for the fenced event area on Prior Lake February 18, 2017. Conclusion The Prior Lake Police Department has completed an investigation of this applicant to ensure that all requirements and issues concerning public safety and compli- ance have been met. FINANCIAL IMPACT: Charlies on Prior has paid a license fee of $75.00 for this event. ALTERNATIVES: 1. Approve the temporary liquor license extension for Charlies on Prior. Remove this item from the consent agenda for additional discussion. RECOMMENDED MOTION: Alternative #1. 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 17-___ A RESOLUTION DECLARING WINTERFEST TO BE A COMMUNITY FESTIVAL AND AUTHORIZING CHARLIES ON PRIOR TO DISPENSE INTOXICATING LIQUOR OFF PREMISES AT THE COMMUNITY FESTIVAL Motion By: Second By: WHEREAS, The Minnesota Vikings are planning their annual Winterfest celebration in Prior Lake February 16 – 18, 2017; and WHEREAS, Events are planned throughout the City of Prior Lake; and WHEREAS, Charlies on Prior holds a City of Prior Lake issued on-sale intoxicating liquor license for 3950 Green Heights Trail SE; and WHEREAS, Charlies on Prior has requested authorization to dispense intoxicating liquor off premises at Winterfest pursuant to Minn. Stat. 340A.404, Subd. 4 (b). NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Winterfest, to be held in the City of Prior Lake on February 16-18, 2017, is declared to be a Community Festival. 3. Charlies on Prior is authorized to dispense intoxicating liquor off premises at Winterfest on February 18, 2017 in the location identified on attached Exhibit A. 4. Charlies on Prior shall provide proof of all insurance required by Minn. Stat. 340A.409 and City Code Section 301 prior to the City granting authorization to dispense intoxicating liquor at Winterfest 5. Provision and consumption of intoxicating liquor may occur only within an approved, fenced area. 6. All intoxicating liquor servers shall receive training prior to the event.
