DISCUSSION: Introduction
Herbert Wensmann has applied for an amendment to the CIC Plat Number
1121, otherwise known as the Lakefront Plaza Building. The amendment is
proposed to separate a tenant space for purchase by a business owner.
History
In July 2003, the City approved a CIC Plat for the development of the
Lakefront Plaza building. This building includes 78 senior apartment units
and 12,000 square feet of commercial area.
Current Circumstances
At this time, the developer is requesting approval of an amendment to the
Common Interest Community (CIC) plat to separate an existing commercial
space into two commercial tenant spaces for purchase by a business owner.
The purpose of a CIC plat is to allow the subdivision of a multi-tenant building
into individual lots for sale. Essentially, the plat creates a lot around the walls
of the various units. The original CIC plat included the subdivision of the 78
residential lots in the building and 3 ground floor lots for commercial use.
The amendment would subdivide one of the ground floor lots that includes
tenant spaces.
Conclusion
Staff has reviewed the CIC plat amendment and finds it consistent with the
approved site plan and original CIC Plat. A copy of the CIC plat is attached
to this report.
ISSUES: CIC plats do not require a development contract. The required public
improvements were included as part of the development contract for the
construction of the building.
FINANCIAL
IMPACT:
The approval of the CIC plat will facilitate the dividing of a commercial tenant
space for sale in the Lakefront Plaza Building.

ALTERNATIVES: 1. Motion and a second, as part of the consent agenda, to approve a
resolution approving the 2nd Amendment to the Common Interest
Community Number 1121 (Lakefront Plaza Condominium) CIC Plat.
2. Motion and second to remove this item from the Consent Agenda for
additional discussion or alternative action.

RESOLUTION APPROVING THE SECOND AMENDMENT TO THE COMMON INTEREST
COMMUNITY NUMBER 1121 (LAKEFRONT PLAZA CONDOMINIUM) CIC PLAT
Motion By: Second By:
WHEREAS, On July 7, 2003 the City Council approved the Common Interest Community
Number 1121 (LakeFront Plaza Condominium) CIC Plat;
WHEREAS, The City Council has found the 2nd Amendment to the Common Interest Community
(CIC) Number 1121 is in substantial compliance with the approved CIC Plat 1121;
WHEREAS, The City Council hereby approves the 2nd Amendment to the Common Interest
Community (CIC) Number 1121;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:
1. The above recitals are fully incorporated herein as set forth above.
2. The amendment to the CIC plat must be filed with the Scott County Recorder’s Office within 90
days from the date of City Coucil approval. Failure to record the documents by October 8, 2017 will
render the CIC plat null and void.
3. The Mayor and City Manager are hereby authorized to execute the 2nd Amendment to the CIC Plat
Number 1121 on behalf of the City.
Passed and adopted by the Prior Lake City Council this 10th day of July 2017.
