Prior Lake Zoning Ordinance
All driveways and parking areas, whether paved or gravel,
are considered an impervious surface.
Bituminous paving or equivalent required for new construction
Drainage to public storm sewer or other approved storm water
facility
Proposed improvements would trigger compliance with:
Stormwater rate and volume control requirements
State erosion and sediment control standards
Wetland Conservation Act
Staff Review / Recommendation

Proposed Conditions
From July 26, 2017 through October 1, 2017, subject to the following conditions:
➢Charlie’s on Prior may establish a temporary off-street parking area on the
parcel of land at the southwest corner of the Green Heights Trail SW and Dutch
Avenue SE intersection (PID 251020240) (“Parcel”).
➢Charlie’s on Prior must obtain written permission from the owner of the Parcel
and must provide proof of such permission to the City prior to any use of the
Parcel.
➢No impervious surfaces may be installed on the Parcel and any improvements
must be approved in advance and in writing by City staff.
➢The Parcel may be used only for parking of operable, licensed motor vehicles.
➢Parking on the Parcel shall only be permitted on Thursday, Friday, Saturday,
Sunday, City approved special events and holidays.
➢The demonstration project may be terminated at any time, for any reason at the
sole discretion of the City Manager.
➢The Parcel shall be utilized by employees of Charlie’s on Prior and as overflow
customer parking only as needed.
Proposed Conditions (cont’d)
➢Charlie’s on Prior shall be responsible for site clean-up and restoration following
expiration of the demonstration project, or any extension thereof, as
determined necessary by the City Engineer.
➢Charlie’s on Prior is responsible for compliance with the requirements of this
resolution.
➢Charlie’s on Prior shall notify all adjacent property owners of the approved
resolution and terms of the parking demonstration project.
➢There shall be no grading, clearing, storage of equipment or vehicles or parking
within 50 feet of the wetland boundary, as delineated by City staff.
➢Charlie’s on Prior shall obtain a City grading permit prior to any disturbance of
more than 500 square feet of land or removal/deposit of more than 50 cubic
yards of material per City Code Subsection 706.
➢Charlie’s on Prior shall submit to the City an erosion and sediment control plan,
including provisions to remove any sediment tracked onto Green Heights Trail
within 24 hours of discovery.
➢Charlie’s on Prior shall use sound judgement on the use of the grass parking
area and shall close off the area for use during periods of wet weather.
Conclusion
Intent to utilize the existing grass parking surface while providing time for city staff,
Charlie’s on Prior and surrounding residents to evaluate:
The effectiveness of the off-street parking, and
Identify any potential issues or concerns
Staff would not pursue code enforcement action for parking on grass at this
location.
Proposal includes clearing brush, small trees and debris from the site.
Large mature trees and screening will remain.
Approval of the parking demonstration project does not require a public hearing.
As a condition of approval, staff is recommending the requirement that Charlie’s on
Prior notify all adjacent property owners of the approved resolution and terms of the
demonstration project.
After the completion, the Council may determine if subsequent demonstrations are
in order, whether to discontinue such use or if ordinance revisions should be
considered to provide for future usage.
This demonstration project is likely to result in feedback from staff, residents and
customers which may help the City Council in making such a decision.
