PUBLIC FORUM City Manager Boyles reviewed the process for the public forum and explained that items sched- uled for public hearing or items for which a public hearing has been held but no final action taken, are not eligible for discussion on the public forum. Noted it will be brought back at a future City Council meeting. PRESENTATIONS No Presentations Scheduled PUBLIC HEARINGS 7A Consider Approval of a Resolution Approving a Body Worn Cameras Policy Police Chief Elliott presented on this topic dated August 21, 2017. Burkart: Asked who controls when the body worn camera is turned on and off. DRAFT 08 21 17 City Council Meeting Minutes 3 Elliott: Responded the body worn cameras are officer activated. Explained in a squad there is auto activation based on the type of equipment and what activates the squad camera whether it is the light bar or vehicle impact. Noted body worn cameras do not have that type of technology yet. Burkart: Asked what the policy will be for when the officer will be required to turn on and off the camera. Elliott: Stated the policy was developed based on best practices by the League of Minnesota Cit- ies, the International Association Chiefs of Police, Minnesota Chiefs of Police Association and the like that had meetings with several different stakeholders. Noted the City of Prior Lake Policy added if there is an in-progress crime, officers would activate the camera when they respond to that in process call. Burkart: Questioned how the staff feels about this policy. Elliott: Responded there has not been any negative feedback. Added for two years Prior Lake has been looking at this program and the officers have been asking when they would get the cam- eras. Thompson: Asked if the officers in the surrounding communities have cameras. Elliott: Stated Prior Lake is not the last department to receive them; out of the eight law enforce- ment agencies in Scott County, three others have the body worn cameras. Thompson: Questioned how these body cameras might save the city money. Elliott: Responded the city will save money by avoidance or not losing lawsuits. Explained when a claim is made that the officer was not doing their job right, this will give the city an opportunity to show that they did do their job correctly. Schwarzhoff: Added in addition to lawsuits, cities with body worn cameras have seen de-escala- tion in incidents because everyone is on their best behavior when a camera is around. Stated one hopes the officer is correct but if that is not the case the video gives cities a chance to take appro- priate action with the employee. Briggs: Asked if anything was brought up at the education public meeting. Elliott: Responded there were questions about how the camera works, how much data is stored, how other cities are using it, why would you have both a body camera and a squad camera and operational questions. Noted the feedback was supportive of the program. Explained legislation worked hard to keep footage private and not available for the public to see; a lot of the data will be classified but anytime an officer is involved with deadly force or force resulting in injury is public data at some point. McGuire: Asked if an officer chose to stop someone from rolling through a stop sign, would that be a crime in progress. Elliott: Replied that would be a traffic stop at which point everything is recorded. Added for exam- ple if you called to report your car was broken into, it would not be a crime in progress but if you called and said your car is being broken into, that would be a crime in progress. OLD BUSINESS No Old Business Scheduled NEW BUSINESS 9A Consider Approval of a Report Regarding Outstanding Connections to Municipal Water and Sewer Pursuant to City Code Assistant Public Works Director/City Engineer Poppler presented on this topic dated August 21, 2017. Braid: Stated these assessments can be large because it is water and sewer hookup fees. Noted he would like the city to work out something with the residents and come back before the council. Briggs: Noted the City Code Section 705 notes a property needs to connect unless they are in compliance of current standards. Asked what the status of the outstanding systems are and has staff been in contact with these residents. Poppler: Responded he does not have the standards for these systems but staff has notified resi- dents they need to obtain a certificate to delay the hook up. Noted others in the neighborhood have done this and if you have not given us the certificate it is likely their system is not compliant. Briggs: Stated if the city has not received a certificate it is assumed it is out of compliance be- cause staff has informed residents of the guidelines. Noted August 22, 2017 is the last Adaptive Ski Clinic for the year at Quarry Lake from 2:00 to 8:00 p.m.; 34 adaptive skiers are signed up with skiers going out every 6 minutes. OTHER BUSINESS / COUNCILMEMBER REPORTS 12A TH13/CR21 Intersection Project Status Report Poppler: Noted staff is continuing to work through options and define them for the September 7, 2017 meeting with the Scott County Board where alternatives will be unveiled but no decisions will be made or public input collected at that meeting because it is to learn about what has been worked on. Added a pop up meeting will be on September 14, 2017 at the Veterans Harvest Market; there will be a table at Community Fall Fest on September 18, 2017. Stated the EDA and EDAC will review the alternatives on September 11, 2017. Thompson: Asked how many concepts will be shown. Poppler: Responded there will be alternatives for each intersection along the corridor so the combination that comes off each intersection may blossom into a number of alternatives. Briggs: Noted the city council and county board are all going to see the alternatives for the first time on September 7, 2017 at City Hall from 5:00 to 7:00 p.m. ADJOURNMENT With no further business brought before the Council, a motion was made by McGuire and se- conded by Thompson to adjourn.
