CONSIDER APPROVAL OF AN ORDINANCE AMENDING SECTION 702.600
AND 702.1200 OF THE CITY CODE PERTAINING TO RESTRICTED
ACTIVITIES AND USE OF ALCOHOL IN JEFFERS POND ELEMENTARY
SCHOOL PARK
Introduction
The purpose of this agenda item is to review an amendment to the City Code
as it relates to activities in Jeffers Pond Elementary School Park. This report
recommends the City Council approve the amendment so the City's Park
Ordinance is consistent with the School District's policy.
History
During the early planning stages of the Jeffers Pond development, the School
District negotiated the purchase of a 12.1 acre parcel of land for the
construction of an elementary school. As part of the negotiations, the City
agreed to accept a 2.11 acre parcel of parkland, to be used jointly with the
elementary school. The School District agreed to construct a ballfield on this
site. The School District will have exclusive use of the 2.11 acre park site
during school hours and days. In return, the City agreed to maintain the 2.11
acre site. The City will have exclusive use of the site outside of the regular
school hours and days.
Current Circumstances
The City and the School District recently entered into a cooperative agreement
for the use and maintenance of this park. According to this agreement,
"[w]henever the School District has the exclusive use and schedule of the
facilities, the School District's "Policy on Facility Use" shall be in full force and
effect." A part of the School District's policy is a ban on the use of alcohol and
tobacco products on school sites. The School District believes this policy
should be in force at all times, because this is primarily a youth facility, and will
be associated with the elementary school. The City Council agreed with this
idea, and directed staff to amend the City Parks ordinance to address this
issue. The City Parks ordinance currently includes similar provisions for
Thomas Ryan, Jr. Memorial Park.
The attached ordinance amends Section 702.600, Restricted Activities, to
include the following language:
(9) It shall be unlawful to use any tobacco related products on the
grounds of Jeffers Pond Elementary School Park.
The ordinance also amends Section 702.1200, Use of Alcohol Within A Park

Facility, as follows:
(7) Jeffers Pond Elementary School Park shall be alcohol-free,
including intoxicating liquors in any form or container.
These amendments are consistent with the School District's policy.
ISSUES:
The proposed amendment is consistent with the Cooperative Agreement
between the City and the School District. Adoption of this amendment is an
example of the partnership that currently exists between the City and the
School District.
FINANCIAL
IMPACT:
Adoption of this amendment has no financial impact on the City.
ALTERNATIVES:
The City Council has the following alternatives:
1. Adopt the ordinance as proposed, or with changes directed by the City
Council.
2. Deny the proposed ordinance.
3. Provide staff with additional direction.
The staff recommends Alternative #1.
RECOMMENDED
MOTION:
A motion and second adopting Ordinance 1 OS-XX amending Section 702.600
and 702.1200 of the City Code to restrict the use of tobacco and alcohol in
Jeffers Pond Elementary School Park.

ORDINANCE NO.1 05- XX
AN ORDINANCE AMENDING SECTIONS 702.600 AND 702.1200 OF THE
PRIOR LAKE CITY CODE
The City Council of the City of Prior Lake does hereby ordain that:
1. Section 702.600 of the Prior Lake City Code is hereby amended to add
subparagraph 9 as follows:
(9) It shall be unlawful to use anv tobacco related products on the arounds of Jeffers
Pond Elementary School Park.
2. Section 702.1200 of the Prior Lake City Code is hereby amended to add
subparagraph 7 as follows:
(7) Jeffers Pond Elementary School Park shall be alcohol-free. includina intoxicatina
liQuors in any form or container.
This ordinance shall become effective from and after its passage and
publication.
Passed by the City Council of the City of Prior Lake this 6th day of September,
2005.
