Home My WebLink About7F Boathouse Bros Brewery Liquor License Report4646 Dakota Street SE Prior Lake, MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: OCTOBER 16, 2017 AGENDA #: 7F PREPARED BY: JANET RINGBERG, ACCOUNTING SPECIALIST PRESENTED BY: FRANK BOYLES, CITY MANAGER AGENDA ITEM: DISCUSSION: PUBLIC HEARING TO CONSIDER APPROVAL OF AN ON-SALE BREWER’S TAPROOM AND SUNDAY LICENSE AND BREWER OFF-SALE INTOXICATING LIQUOR LICENSE FOR BOATHOUSE BROTHERS BREWING CO LLC Introduction The purpose of this agenda item is to conduct a public hearing to consider ap- proval of an on-sale brewer’s taproom and Sunday license and a brewer off-sale intoxicating liquor license for Boathouse Brothers Brewing Company LLC, located at 16211 Main Avenue. History Boathouse Brothers Brewing Company LLC is the first company to apply for an on-sale brewer’s taproom and brewer off-sale intoxicating liquor license in the City of Prior Lake. Brewers must obtain both federal and state brewing licenses, in ad- dition to city licenses, in order to brew and sell beer. Boathouse Brothers Brewing has been approved at the federal level and is still in the approval process with the state. Current Circumstances An on-sale brewer’s taproom and Sunday license will allow Boathouse Brothers Brewing Company to sell the beer they have brewed on site. This license does not allow them to sell any other brands of beer. The brewer off-sale intoxicating liquor license will allow them to sell their beer for offsite consumption in containers com- monly referred to as growlers. Boathouse Brothers Brewing will not be applying for a 2 AM license, which would allow them to stay open until 2 AM. The licenses being requested for approval will be valid from October 16, 2017 until June 30, 2018, at which time they will be up for renewal along with all other liquor licenses in the city. Conclusion The Prior Lake Police Department has completed an investigation of this applicant to ensure that all requirements and issues concerning public safety and compli- ance have been met. Boathouse Brothers Brewing is still awaiting approval of their brewing license at the state level. Even though the licenses being requested for approval in this agenda report may be approved by the city council, they may not sell beer of any sort until the state has approved all licensing requirements for this brewer. 2 ISSUES: Section 301.600 of the city code states that the council can deny a license request if all taxes, assessments, fines or other financial claims of the city, county, or state are not current. All taxes and monies owed to the city are current. It has been the city’s practice to conduct a public hearing for initial license issu- ance but not for renewals. Therefore, the city council should conduct a public hear- ing to determine if substantive information is offered which would be germane to this topic. Once the hearing is conducted, the city council could take action it deems appropriate. FINANCIAL IMPACT: Boathouse Brothers Brewing Co LLC has paid the $500.00 investigation fee, the $650.00 on-sale taproom and Sunday License fee, and the $200.00 brewer off- sale intoxicating license fee of $200.00. ALTERNATIVES: 1.Conduct the public hearing and if no new information is offered, approve the resolution issuing an on-sale brewer’s taproom and Sunday license and a brewer off-sale intoxicating liquor license for Boathouse Brothers Brewing Company for the period October 16, 2017 to June 30, 2018 as proposed or with conditions. 2.Take no action and direct the staff to obtain additional information relative to the license issuance or denial. 3.Direct staff to prepare a resolution with findings of fact denying the license request. RECOMMENDED MOTION: Alternative #1. 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 17-___ A RESOLUTION TO CONSIDER APPROVAL OF AN ON-SALE BREWER’S TAPROOM AND SUNDAY LICENSE AND A BREWER OFF-SALE INTOXICATING LIQUOR LICENSE FOR BOATHOUSE BROTHERS BREWING COMPANY LLC Motion By: Second By: WHEREAS, Minnesota Statutes Chapter 340A authorizes the City to issue on and off sale liquor and 3.2 malt liquor license, Sunday licenses, and club licenses, and WHEREAS, Prior Lake City Code sets forth the application investigation and approval process for such licenses, and WHEREAS, Boathouse Brothers Brewing Company LLC has submitted an on-sale brewer’s taproom and Sunday liquor license and a brewer off-sale intoxicating liquor license application, and WHEREAS, Boathouse Brothers Brewing Company LLC is leasing the premises of 16211 Main Avenue, and WHEREAS, Pursuant to the Prior Lake City Code section 301.600, “no license shall be granted for operation on any premises on which taxes, assessments or other financial claims of the City are delinquent or unpaid.” NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1.The recitals set forth above are incorporated herein, 2.The on-sale brewer’s taproom and Sunday license and the brewer off-sale intoxicating liquor licenses for the premises of Boathouse Brothers Brewing Co LLC, 16211 Main Avenue are hereby approved for the period October 16, 2017, to June 30, 2018 and, 3.All property taxes and water bills for the premises of the 16211 Main Avenue are paid and current in compliance with Prior Lake City Code 301.600.
