Call to Order and Pledge of Allegiance: Commissioner Fleming called the Monday, October 23, 2017 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Bryan Fleming, Dave Tieman, Mark Petersen, William Kallberg, Dan Ringstad and Liaison Zach Braid. Also present were Community Development Director Casey McCabe, Planner Jeff Matzke, Planner Amanda Schwabe and Community Development Service Assistant Sandra Woods. 2. Approval of Agenda: MOTION BY RINGSTAD, SECONDED BY PETERSEN TO APPROVE THE MONDAY, OCTOBER 23, 2017 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Fleming, Tieman, Petersen, Kallberg and Ringstad. The Motion carried. 3. Approval of Monday, October 9, 2017 Meeting Minutes: MOTION BY PETERSEN, SECONDED BY TIEMAN TO APPROVE THE MONDAY, OCTOBER 9, 2017 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Ayes by Fleming, Tieman, Petersen, Kallberg and Ringstad. The Motion carried. 4. Public Hearings: A. Amendments to Prior Lake City Code – Subsection 1102.900 “TC-T” Transitional Town Center Use District – Consider Amendments to Subsection 1102.900, “TC-T” Transitional Town Center Use District, including the removal of regulations which prohibits additions beyond 50% of the current market value of the structures on the property within the TC-T, Use District. Planner Schwabe introduced the request to consider amendments to Section 1102.900, (TC-T Transitional Town Center Use District) of the Prior Lake City Code to remove language which currently limits additions to properties to 50% of the current market value of the structure within the TC-T Use District. She explained the history, current circumstances, issues, and recommended a motion. She presented a general location map and proposed amendments to Subsection 1102.900. Commission Comments/Questions: Fleming asked about proposed amendments to the ordinance, other than the removal of the 50% improvement restriction. Planner Schwabe explained the rationale for the additional of the ‘Commercial Use’ text within Subsection 1102.904. Fleming asked about feedback during this due-diligence and examination. Planner Schwabe explained staff received feedback from elected and appointed officials, as well as residents, recommending this item be considered for removal of the 50% improvement restriction. Fleming questioned if the removal of the 50% cap would serve as a disincentive to perspective developers, retail or service uses in this area. Planner Schwabe explained the development of a Commercial Use in the Transitional Town Center would require rezoning to Town Center prior to development. Kallberg confirmed rezoning cannot be leapfrogging down the block. Planner Schwabe said that is correct and explained the rezoning process in the TC-T District. Tieman asked if new residential structures are allowed to be built in the area. Planner Schwabe replied yes, that is correct. Ringstad asked how many residential structures are part of this; how many are rentals versus owner occupied north of Eagle Creek. Planner Schwabe stated she was unsure how many properties are rental versus owner occupied; however, staff could do more research on this subject if requested by the Commission. 2 MOTION BY PETERSEN, SECONDED BY KALLBERG TO OPEN PUBLIC HEARING ON 4A AT 6:12 P.M. VOTE: Ayes by Fleming, Tieman, Petersen, Kallberg and Ringstad. The Motion carried. Public Comment: Pat Heaney, 4642 Pleasant Street SE. commented on the map, the area by the Methodist Church and asked when the area by the Methodist Church was added to the TC-T District. Planner Matzke explained the church property has been in the TC District since 2009. Heaney provided comments related to the establishment of the Transitional Town Center Use District and asked questions related to the establishment of the 50% improvement rule. Mr. Haney also requested clarification on the difference between zoning ordinance requirements and zoning use districts. Fleming explained the differences in terminology between the zoning use districts. Heaney questioned who was the applicant when the TC-T district was approved in 2009 and the process of approval. Fleming explained the process of approval including the public hearing before the Planning Commission who then makes a recommendation to the City Council. Heaney asked for verification on if the applicant was the City and if the City had to go through the same approval process at the Planning Commission and then to the Council. He questioned if the 50% rule had the same approval process in 2009. Fleming explained the process is the same regardless of who the applicant is. Planner Schwabe said she would concur as it is traditional to bring to the Planning Commission for guidance first. Heaney asked for direction where he can find out answers to the public hearing notification process that was followed in 2009 and how a resident would get this type of information if they were purchasing property in the TC-T district. Fleming responded stating he has confidence in the City Staff to follow notification requirements. Director McCabe commented on the TC-T being the zoning use district and explained the city does not inform potential residents of zoning ordinance requirements in any zoning use district. Fleming commented on the minimum state statute requirements for public hearing notifications versus the types of communication the Planning Commission and city staff use. Heaney asked about the process of reclassification of zoning districts. Director McCabe explained the process of properties petitioning for rezoning which are adjacent to the zoning districts and restated the proposal before the Planning Commission is to consider an ordinance amendment to remove the 50% improvement restriction in the TC-T use district. Heaney asked for clarification on Director McCabe’s reply. Director McCabe explained in greater detail the process for petitioning to rezone property when that property is adjacent to another zoning use district. John Diers, 4601 Pleasant Street SE. commented on his family’s history within the TC-T use district. He is in support of this change and would like to see the area preserved and is excited to see this being proposed. Marsha Diers, 4601 Pleasant Street SE. commented on being in support of this proposal and her enjoyment of her neighborhood and interest in seeing the neighborhood preserved. Ronald Wolfram, 4612 Pleasant Street SE. stated how long he has lived in Prior Lake; shared concerns with the TC-T District; commented on the 50% improvement restrictions and public hearing notices Fleming asked staff to weigh in on how the public hearing was noticed when the TC-T District was established and asked Director McCabe to explain how it should work. Director McCabe explained the publication requirements and mailing notice requirements for all meetings. Fleming asked staff to research the public hearing notification that took place in 2009 and follow up with the residents in attendance who voiced concern over the 2009 notification and the Planning Commission with that information. Wolfram commented on not receiving a meeting noticed in 2009. 3 MOTION BY PETERSEN, SECONDED BY TIEMAN TO CLOSE THE PUBLIC HEARING AT 6:36 P.M. ON ITEM 4A. VOTE: Ayes by Fleming, Tieman, Petersen, Kallberg and Ringstad. The Motion carried. Commissioners Comments: Ringstad commented on 2008/2009 public hearing and notification process; he asked for information on notices at the next meeting. He stated he fully supports the proposed change. He believes it makes sense and would like to see the neighborhood be able to update their homes without limitations. He commented on changes in the neighborhood, notification and responsibility on house/land sales and zoning information. He commented on going to the City prior to buying a home and taking proper steps in purchasing a home. Petersen stated he is in support of the change to the ordinance which will allow residents to maintain their homes. Fleming said he is in support to the amendment change. He commented on tension between preserving small town feel and managing growth responsively. He commented on the 2040 Comprehensive Plan meetings and discussion of the right balance and mix of commercial and residential development and community values around open spaces and conservation. He stated the four findings and purpose of the zoning ordinance that were illuminated by staff are in good order and make good sense. Tieman said he is also in support. He thanked the citizens for coming out and voicing their opinion. Kallberg stated he is in support. He thanked the neighbors that voiced their opinions and was hopeful their questions were answered. He commented on the staff in 2008/2009, the 2040 Comprehensive Plan discussions, and growth in the Downtown Business District. He explained the TC-T District conditions, abutting zoning, selling property and how zoning can change. He mentioned preserving the historic district. He commented on notifications and boundaries of the TC-T District. MOTION BY PETERSEN, SECONDED BY KALLBERG TO RECOMMEND THE CITY COUNCIL APPROVE THE AMENDMENTS TO SUB-SECTION 1102.900 OF THE CITY CODE ZONING ORDINANCE AS PROPOSED. VOTE: Ayes by Fleming, Tieman, Petersen, Kallberg and Ringstad. The Motion carried. 5. Old Business: No Old Business 6. New Business: A. 2017 PC Accomplishments and 2018 Goals – Consider approving a list of the Planning Commission’s 2017 accomplishments and 2018 goals. Planner Matzke introduced the agenda item as a consideration approving the Planning Commission’s top four accomplishments in 2017. He explained the history, current circumstances, issues and recommended a motion. Planner Schwabe introduced the top three goals for 2018. She explained the history, current circumstances, issues and recommended a motion. Commission Comments/Questions: Fleming commented on having a fifth goal being fostering dialog with different community elements. He stated he would like the fifth goal to read as: Foster and strengthen engagement and dialog with the broader Prior Lake Community. All Commissioners agreed with Commissioner Fleming on this addition. Fleming said he would like the committees and City Council and residents to know that this is top of mind for the Commissioners. 4 MOTION BY PETERSEN, SECONDED BY KALLBERG TO APPROVE THE LIST OF ACCOMPLISHMENTS FOR 2017 AND THE FIVE GOALS FOR 2018 AS RECISED BY FLEMING. VOTE: Ayes by Fleming, Tieman, Petersen, Kallberg and Ringstad. The Motion carried. Announcements: Fleming acknowledged and thanked Commissioner Petersen for his service as a Planning Commissioner on behalf of the Commission. Petersen said it has been very rewarding and has enjoy this role over the last three years. Tieman thanked Commissioner Petersen. Ringstad said we will miss Commissioner Petersen and wished him well. Kallberg thanked Commissioner Petersen. • 2040 Vision and Strategic Plan Event o Tomorrow night o RSVP to City Manager Boyles or Administrative Assistant Ann Schroeder o Begins at 5 P.M. to 9 P.M. o At Club Prior Fleming stated all the commissioners will be there and it will be good to listen to get a tone for what resident are feeling and thinking. 7.
