SION:
Introduction
The purpose of this agenda item is threefold; 1) hold a public hearing for the proposed
2018 Official Fee Schedule and 2) consider approval of an Ordinance amending Subsec-
tion 106.600 and Section 113 relating to the Official Fee Schedule and Sections 704 and
705 relating to utility charges and 3) consider a resolution approving a summary ordi-
nance and publication thereof.
History
Annually, staff reviews the fee schedule as part of the budget process and makes rec-
ommendations to the City Council for changes or additions as needed. The Council is
required to announce the time and place of the council meeting at which the 2018 official
fee schedule will be discussed and allow for citizen input. A public hearing is being held
on December 4, 2017. City code provides that the fee schedule be addressed at the
city council’s annual meeting but may be addressed prior to this time when appropriate.
At least for the last few years we have attempted to adopt the fee schedule at the last
meeting of the previous year in order that the new fees will be in effect for the entire new
year in so far as possible.
Current Circumstances
During the 2018 budget process, staff presented the significant changes to the fee sched-
ule as part of the budget workshops. The major items that were discussed that have been
included in the 2018 budget and listed on the proposed fee schedule include:
1. Development Fee Acreage Charges
2. Utility Rates
3. Technology Fee
Following is a list of other changes that are being proposed and the reason for the
change. The input received from the public hearing and City Council on December 4 will
be incorporated into the 2018 Official Fee Schedule.

Conclusion
The 2018 Official Fee Schedule will be incorporated into the City Code with an effective
date of January 1, 2018.
Due to the significant amount of changes to the 2018 Official Fee Schedule, the entire
fee schedule is attached with color coding.
Blue – Changes in heading/name of fee, specifying timeframe (i.e. per month, per
billing cycle). No new fees or changes to the amount of fees.
Orange – New fees or changes in fees. Explanations are listed below.
Red – Deleted fees. No longer applicable or were duplicates.
Purple – Fee is increased by $5 to support the technology costs incurred by the
City.
In addition, the fee schedule will be moved to a new section 113 to make it easier to
locate.
Explanation of Changes to Fees (orange highlighted items)
1- 3. Acreage Charges for Street Oversizing, Trunk Water, Trunk Sewer, &Trunk
Storm; Charges for Water Connection, Sewer Connection, and Water Tower (Stor-
age) :
These rates were determined in 2005 as part of the comprehensive capital plan. During
review of the 2016-2020 CIP, Staff recommended increases to these fees. For sewer,
storm and street oversizing, the suggested increases adjusted the 2005 fees to 2016
using the construction cost index (CCI). From 2005-2016, the CCI had increased 36%,
however, Council directed staff to phase in the CCI increase over several years. The
incremental increase recommended was 10% over the three-year period from 2016-
2018, with an updated rate study defining future rate adjustments. This is the final year
of the three-year increase period.
The water related fees (trunk water acreage, water connection, and water tower fees)
include an inflationary cost increase of 3.7% based on the CCI. Due to the water pur-
chase agreement with the SMSC, the City will not have the same costs as originally es-
timated for a 2nd WTP and addition of Well #10. These fees will also be evaluated as
part of the updated rate study defining future rate adjustments. The study will be com-
plete in early 2018.
4-6. Utility Rates:
The proposed utility rate increases noted below are based on Staff recommendations
made in conjunction with the annual review of the Capital Improvement Program. These
rates are charged each billing cycle and intended to reimburse the City for operating costs
for each utility and a portion of the capital costs.
4a-4b & 6. Water Rates and Storm Water Charge In the approved Transportation
Plan, there are $4.1 million of water projects and $1.4 million of storm water utility pro-
jects planned over the next five years. Staff is proposing to issue debt for the utility work
for the 2018 Franklin Area improvement projects ($330,000) and fund the remainder of

the capital utility improvements out of fund balance. By issuing debt for one of the im-
provement projects, we can fund expenditures with a modest rate increase of 3% for
the Water and Storm Water rates.
5a & 5b. City Portion of Sewer Rate and Met Council Portion of Sewer Rate (MCES):
MCES Rate: The Metropolitan Council adopted a Metropolitan Wastewater Charge for
2018 of $219.7 million. This is an increase of 3.7% from the 2017 charge of $211.9 mil-
lion.
MCES continues to use an allocation method to calculate each municipality’s
charges. The method uses 2016 calendar year flow to allocate the $219.7 million of to-
tal metropolitan charges to customer communities.
The Sewer plan has been modified to reflect this increase in the MCES cost.
For the 2018 MCES rate, staff recommends a corresponding 3.7% increase in the rate
to $2.67 to cover the actual cost of the service. This is an increase of $0.10 over the
2017 rate of $2.57.
City Sewer Rate:
As discussed with the Council at the August 7 budget workshop and CIP Council meet-
ing presentation, Staff has been evaluating the impact of billed sewer flows on reve-
nues and the impact of capital project expenditures on the sewer fund reserves. This
will be evaluated on an on-going basis as conditions change and continues to be a fo-
cus of our planning process.
Based on the current plans it is likely that the fund balance will drop below the recom-
mended amount in 2018.
In the approved Transportation Plan, there are $2.4 million of sewer projects planned
over the next five years. Staff is proposing to issue debt ($550,000) for the utility work
for the 2018 Franklin Area improvement projects and fund the remainder of the capital
utility improvements out of fund balance.
To fund the remaining utility improvements out of fund balance, staff recommends the
rate of $2.94/1,000 gallons for the City portion of the sewer rate. This is an increase of
$0.25 over the 2017 rate of $2.69. This rate is recommended to keep the total sewer
rate increase for the combined City and MCES portions at $0.38 per 1,000 gallons or
about a 7% increase.
Staff’s recommendation for utility rate changes for each fund follows:

mending an increase to cover the City’s annual cost increases.
Miscellaneous:
16a. – 16d. Staff recommends memorial fees become set fees rather than market price
to provide transparency for residents so they know the costs.
17a. – 17c. The City is required to administer the State Wetland Conservation Act
(WCA) and act as the responsible Local Government Unit (LGU) for the WCA program
per Resolution 94-01. The Board of Water and Soil Resources (BWSR) administers the
WCA program at the State level and performs annual audits of our program. The City
incurs costs as the WCA LGU that should be passed along to property owners at the
time of development, like other aspects of development that are currently charged back
to developers such as plan review and inspections. The cities of Savage and Shakopee
also charge fees to developers to administer their WCA programs. The WCA Applica-
tion Fee amount would fall between Shakopee ($75) and Savage ($250) and both cities
charge actual costs for WCA Administration. The Wetland Field Estimate fee would ap-
ply to sites where it isn’t clear whether wetlands exist on the site and a wetland delinea-
tion may or may not be needed; in these cases, the city’s wetland consultant would de-
termine if the city will require a wetland delineation and potentially save the developer
the expense of a delineation if one is not needed. The cost for the Wetland Field Esti-
mate is enough to cover an average field review by our wetland consultant.
ISSUES: This public hearing for the proposed fee schedule is the opportunity for the public to com-
ment or ask questions about the proposed 2018 Official Fee Schedule.
It is suggested that the city council solicit and record resident questions during the public
portion of the meeting. Once everyone wishing to speak has had a chance, staff can
respond to the questions and council members can ask additional questions or add to
the responses already made. This format will allow council members and staff to have a
reasonable and informative discussion which should enhance the public’s understanding
of the proposed 2018 Official Fee Schedule.
FINANCIAL
IMPACT:
The fee schedule identifies those types of service charges and license fees charged on
a user basis to recover City-associated costs. Charges for services, licenses and permits
are a significant part of the revenue stream supporting the City’s budgets. For example,
the General Fund budget receives about 18% of its support from charges for services,
licenses and permits.

Ordinance amending Subsection 106.600 and Section 113 relating to the Official Fee
Schedule and Sections 704 and 705 relating to utility charges as proposed or with

nance and ordering the publication of said summary.

PENALTY PROVISIONS
THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, ORDAINS:
1. City Code Subdivision 704.402 is amended by inserting the following sentence at the end of the
paragraph: “For properties served by another entity the rates for sewer and water are set forth
in the intergovernmental agreement with that entity.”
2. City Code Subdivision 704.603 is amended by inserting the words “and/or a frost plate charge”
after the words “pressure reducer charge”.
3. City Code Subdivision 106.600 related to the Official Fee Schedules is deleted in its entirety.
4. City Code Part 1 is amended by inserting a new Section 113 related to the Official Fee Schedule
as set forth on attached Exhibit A.
5. City Code Section 104 entitled “General Penalty” is hereby adopted in its entirety, by reference,
as though repeated verbatim herein.
This ordinance shall become effective from and after its passage and publication.

A RESOLUTION APPROVING THE SUMMARY OF ORDINANCE NO. _____ AND
ORDERING THE PUBLICATION OF SAID SUMMARY

WHEREAS,
On December 4, 2017 the City Council adopted Ordinance No. ____ amending
Subsection 106.600 and Section 113 relating to the Official Fee Schedule and
Sections 704 and 705 relating to utility charges; and
WHEREAS, Minnesota Statutes requires publication of an ordinance in the official newspaper
before it becomes effective; and
WHEREAS, Minnesota Statutes also allows the publication of a summary of an ordinance if the
Council finds that the summary is an accurate representation of the ordinance; and
WHEREAS, The City Council desires to publish a summary of the amendments to Subsection
106.600 and Sections 113, 704 and 705 of the Prior Lake City Code and has
determined the publication of a summary of this ordinance will meet the intent of
the statute.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
PRIOR LAKE, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Ordinance No. _____________ is lengthy.
3. The text of summary of Ordinance No. __________________, attached hereto as Exhibit A,
conforms to M.S. § 331A.01, Subd. 10, and is approved, and publication of the title and
summary of the Ordinance will clearly inform the public of the intent and effect of the
Ordinance.
4. The title and summary shall be published once in the Prior Lake American in a body type no
smaller than brevier or eight-point type.
5. A complete text of the newly amended City Code will be available for inspection at City Hall

SUMMARY: The Ordinance amends Subsection 106.600 and Section 113 relating to the Official

by updating the fees and charges listed for 2018. The Ordinance amends Sections 704 and 705
relating utility charges for intergovernmental agreements and pressure reducers.
