HomeMy WebLinkAbout7A Woodside Huron Public Hearing Report 4646 Dakota Street SE Prior Lake, MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: DECEMBER 11, 2017 AGENDA #: 7A PREPARED BY: NICK MONSERUD, PROJECT ENGINEER PRESENTED BY: NICK MONSERUD, AGENDA ITEM: PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION ORDER- ING THE IMPROVEMENTS FOR THE WOODSIDE/HURON NEIGHBORHOOD STREET IMPROVEMENT PROJECT, CITY PROJECT #TRN18-000001 DISCUSSION: Introduction The purpose of this agenda item is to conduct the public hearing to receive public comments on the Woodside/Huron Neighborhood Improvement Project and if ap- propriate order the project. History The City uses the Five-Year Capital Improvement Program and its Pavement Management program to plan its infrastructure improvements and the financing for capital improvements. The Woodside/Huron area including Woodside Road, Hu- ron Street, Wildwood Circle, Santee Circle and Luther Road are part of the plan for reconstruction in 2018. At its May 8, 2017 meeting the City Council adopted Resolution 17-064 authorizing staff to prepare a Feasibility Report for the Wood- side/Huron Neighborhood Street Improvement Project as outlined in the CIP. The primary purpose for proceeding with the project is to upgrade the street condition and utilities. The pavement condition is poor and requires reconstruction in ac- cordance with the City’s desire to maintain high overall condition index (OCI) rat- ings on its roadways. At its November 20, 2017 meeting the City Council adopted Resolution 17-190 ac- cepting the Feasibility Report and ordering the public hearing for the Wood- side/Huron Neighborhood Street Improvement Project. A copy of the feasibility Report completed by WSB is attached for city council information. The M.S. Chapter 429 process applies to all projects that will be financed in whole or part through special assessments or bond proceeds. The Woodside/Huron area is considered in the report and includes improvements to RLS 072, Oakwood Hills, and North Prior subdivisions located in Section 36, Township 115, Range 22. Structures in this area were built in the late 1960s and 1970s. A map of the project area (Appendix A) is included in the Feasibility Re- port. The proposed improvements include street reconstruction or reclamation, storm sewer, storm water quality, sanitary sewer, watermain, concrete curb and gutter, and appurtenant work. Current Circumstances The properties deemed to specially benefit from the improvements, in most cases the properties abutting the streets located in the project area, are subject to as- 2 sessment. Each of the affected property owners have been notified in accordance with State Statute regarding tonight’s Public Hearing. A Public Informational Meeting was held on December 6, 2017 to provide the property owners an opportunity to discuss the project in an informal setting prior to the Public Hearing. Meeting notices were sent to all properties located within the Woodside/Huron Neighborhood Street Improvement Area. Staff provided an up- date on the proposed improvements, project costs, estimated assessments and answered general questions regarding the project. Conclusion Staff is prepared to discuss each of the concerns presented at the Public Hearing. If the Council deems the issues that have been brought up need to be addressed in the project plans and specifications, direction can be given to staff. The purpose of this Public Hearing is to determine project elements or whether the project should move forward at all. Completion of plans and specifications is the next step and will provide greater information about expected project cost and, therefore, the assessments associated with the improvements. Once the plans and specifications are completed, they will be submitted to the City Council for ap- proval and authorization to advertise for bids. The Council could decide not to continue with the project upon receipt of bids. A separate Assessment Hearing will be conducted following review of the proposed assessments by the City Coun- cil’s Assessment Review Committee. In summary, the project is feasible from an engineering and economic standpoint. If the project is approved, City staff will continue to work on completion of plans and specifications. ISSUES: The Assessment Review Work Group met on October 25th, 2017, and recom- mended the unit assessment method and assessment in accordance with the City’s Assessment Policy of assessing 40% of the street and storm sewer cost. The group discussed the assessment of townhouses located within the project ar- ea and determined that they are to be assessed at a rate of 1.5 units. Also, St. Pauls Lutheran Church property was discussed. It was determined to utilize resi- dential equivalent units at a rate of 2.2 units per acre for the Church property. The acreage was calculated based on the portion of property actively being used (ie. parking lot, streets and structure). FINANCIAL IMPACT: The Woodside/Huron Neighborhood Street Improvement Project is proposed to be financed by Special Assessments, Tax Levy, Sewer Fund, Water Fund, and Water Quality Fund. RECOMMENDED MOTION: A motion and second for approval of Alternative #1. 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 17-___ ORDERING IMPROVEMENTS FOR THE WOODSIDE/HURON NEIGHBORHOOD STREET IMPROVEMENT PROJECT (PROJECT #TRN18-000001); FINANCING THE WOODSIDE/HURON NEIGHBORHOOD STREET IMPROVEMENT PROJECT TO BE UNDERTAKEN BY THE CITY AND ESTABLISHING COMPLIANCE WITH REIMBURSEMENT BOND REGULATIONS UNDER THE INTERNAL REVENUE CODE Motion By: Second By: WHEREAS, The Prior Lake City Council on its own initiative has determined that it desires to complete the Public Improvements for the Woodside/Huron Neighborhood Street Improvement Project; and WHEREAS, On November 20, 2017; the City Council accepted the Feasibility Report and called for a Public Hearing to be held for the Woodside/Huron Neighborhood Street Improvement Project which includes sanitary sewer, watermain, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work; and WHEREAS, Ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 11th day of December 2017, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, Since the project was initiated by the City Council it must be approved by 4/5ths vote in accordance with Minnesota Statutes 429.031 Subdivision 1(f); NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 3. The City Council by the required statutory 4/5ths vote does hereby order the project as outlined in the feasibility report. 4. The City Engineer is hereby designated as the Engineer for these improvements and is authorized to record engineering expenses in the Construction Fund (#501-43500.00- 55020-TRN18-000001). 5. The Engineer shall prepare plans and specifications for the making of such improvements for the Woodside/Huron Neighborhood Street Improvement Project. 6. The City has determined to make a declaration of official intent (“Declaration”) to reimburse certain estimated costs for this project from proceeds of bonds in accordance with the Internal Revenue Service Reimbursement Regulations (Treasury Reg. 1.150-2). 8. The City may declare other separate statements of reimbursement intent in connection with specific public improvements projects as they are initiated under Minnesota Statutes Chapters 429 and 444, or for other capital projects, with the understanding that such additional declarations of reimbursement intent will supplement this resolution. All reimbursed expenditures will be capital expenditures, costs of issuance of the bonds, or other expenditures eligible for reimbursement under Section 1.150-2(d)(3) of the Reimbursement Regulations. 9. This Declaration has been made no later than 60 days after payment of any original expenditure to be subject to a reimbursement allocation with respect to the proceeds of bonds, except for the following expenditures: . a. costs of issuance of bonds; b. costs in an amount not in excess of $100,000 or five percent of the proceeds of an issue; or c. preliminary expenditures” up to an amount not in excess of 20 percent of the aggregate issue price of the issue or issues that are reasonably expected by the City to finance the project for which the preliminary expenditures were incurred. The term “preliminary expenditures” includes architectural, engineering, surveying, bond issuance, and similar costs that are incurred prior to commencement of acquisition, construction or rehabilitation of a project other than land acquisition, site preparation, and similar costs incident to the commencement of construction 10. This Declaration is an expression of the reasonable expectations of the City based on the facts and circumstances known to the City as the date hereof. The anticipated original expenditures for the Projects and the principal amount of the bonds are consistent with the City’s budgetary and financial circumstances. No sources other than proceeds of bonds to be issued by the City are, or are reasonably expected to be reserved, allocated on a long term basis, or otherwise set aside pursuant to the City’s budget or financial policies to pay such Project expenditures. 11. This Declaration is intended to constitute a Declaration of the Official Intent for the purposes of the Reimbursement Regulations. EXECUTIVE SUMMARY The 2018 Woodside/Huron Neighborhood Reconstruction Project includes reconstructing streets and utilities in the Huron/Woodside neighborhood. The streets included in the project area are Huron Street SE, Wildwood Circle SE, Woodside Road SE, Santee Circle SE, and Luther Road SE. The reconstruction of these streets and utilities was identified in the City’s Capital Improvement Plan (CIP) for construction in 2018. The existing streets in the project area are of an urban section. Roadway reconstruction, consisting of removal of the existing bituminous pavement, subgrade correction, replacement of concrete curb and gutter, and new bituminous pavement, is proposed along the following roadways, totaling approximately 4,138 feet (0.78 miles):  Huron Street SE between Woodside Road SE and Fish Point Road SE  Wildwood Circle SE between Huron Street SE and the cul-de-sac  Woodside Road SE between Candy Cove Trail SE and Wildwood Circle SE  Santee Circle SE between Woodside Road SE and the cul-de-sac  Luther Road SE between State Highway 13 and the parking lot A map showing the project location can be found on Figure 1 in Appendix A. Replacing portions of the City’s deteriorating utility infrastructure, in conjunction with the proposed street improvements, provides an opportunity to minimize the replacement costs and traffic disruptions associated with the work. Proposed utility improvements include the following:  Installation of new watermain  Replacement of hydrants, gate valves, and services as necessary  Repair or installation of storm sewer to improve overall drainage  Area drainage improvements, including a potential storm water pond  Replacement of sanitary sewer pipe and manholes The proposed improvement cost is estimated to be $2,752,300, which includes a 10% contingency and 28% indirect costs. Funding for the project will be provided through assessments to benefiting properties and City funds. The proposed project is scheduled to begin construction during the spring of 2018, with substantial completion by September 2018. The final wear course of bituminous pavement will be placed in 2019. This project is feasible, necessary, and cost-effective from an engineering standpoint and should be constructed as proposed herein. INTRODUCTION 2.1 Authorization On May 8, 2017, the City of Prior Lake City Council authorized the preparation of a feasibility report for the 2018 Woodside/Huron Neighborhood Reconstruction Project in Resolution 17-064. This project has been designated City Project No. TRN 18-000001. 2.2 Scope This report investigates the feasibility of proposed improvements to streets and utilities identified within the City’s Capital Improvement Plan. Streets proposed for the 2018 Woodside/Huron Neighborhood Reconstruction Project were initially considered because of existing pavement conditions and known utility failures. The streets proposed for improvements include:  Huron Street SE between Woodside Road SE and Fish Point Road SE  Wildwood Circle SE between Huron Street SE and the cul-de-sac  Woodside Road SE between Candy Cove Trail SE and Wildwood Circle SE  Santee Circle SE between Woodside Road SE and the cul-de-sac  Luther Road SE between State Highway 13 and the parking lot The project area is shown in Figure 1 of Appendix A. Improvements within this report include roadway reconstruction, sanitary sewer replacement, watermain replacement, and drainage and storm sewer improvements. 2.3 Data Available Information and materials used in the preparation of this report include the following:  City of Prior Lake Capital Improvement Plan  City of Prior Lake Assessment Policy  City of Prior Lake Property Index Records  City of Prior Lake Topography Maps  Geotechnical Report prepared by Element Materials Technology, completed in October 2017  Sanitary Sewer Televising by Pipe Services, completed in September 2016  Field Observations of the Area and Field Topography Surveys 2.4 Background The City of Prior Lake has a Capital Improvement Plan to maintain infrastructure within the City. The Woodside/Huron neighborhood has been identified as a potential area for a street reconstruction project, in which the streets are reconstructed and utilities are replaced. The City of Prior Lake utilizes a Pavement Management Program to rate the condition of the City’s streets. The pavement rating, known as Overall Condition Index (OCI), is determined based on the amount of pavement deterioration that is visually evident. The street OCI is a number between 0-100, with 100 indicating streets that are in the best condition or are newly paved and 0 being the worst. Streets in need of a mill and overlay generally have an OCI of 45-65 and streets with an OCI between 35-45 usually require a full depth reclamation. When the OCI reaches a range of 0-35 or when utility repairs are needed, the street usually requires a full reconstruction. EXISTING CONDITIONS 3.1 Streets Streets range from 30 to 34 feet in width. All the streets within the project area consist of an urban section with D-style concrete curb and gutter. The streets within the proposed improvement area are aging and exhibiting alligator cracking, edge cracking, transverse cracking, and longitudinal cracking. The OCI rating for each street is shown in Table 1. The bituminous pavement is becoming more brittle due to age and is showing signs of accelerated deterioration. The existing right-of-way (ROW) width for the project is 60 feet with 60-foot radii at the cul-de-sacs. There exists a 16-foot wide drainage and utility easement along the back parcel line of the properties bound by Woodside Road SE and Huron Street SE. A geotechnical report was completed by Element Materials Technology on October 18, 2017. A total of eight soil borings were taken at various locations throughout the project area. The borings indicate bituminous pavement thicknesses from six inches to ten inches. Underlying the pavement was approximately six inches to 14 inches of silty sand material with gravel. The full report can be found in Appendix B. 3.2 Storm Sewer and Drainage Existing, aging storm sewer infrastructure exists within the project area. Storm sewer was installed in 1986. Storm sewer in the project area flows to the wetland at the southwest corner of the Woodside Road SE and Huron Street SE intersection, which then overflows into a drainage system that carries the water north through Santee Circle SE to the drainage ditches along Trunk Highway 13. The intersection of Woodside Road SE and Huron Street SE has been known to experience flooding during heavy rain events. Feasibility Report 2018 Woodside/Huron Neighborhood Reconstruction Project City of Prior Lake Project No. TRN 18-000001 WSB Project No. R-010344-000 Page 4 3.3 Sanitary Sewer The sanitary sewer system within the project area was constructed in 1967 and consists of eight-inch vitrified clay pipe (VCP). The sanitary sewer for the project area flows to the west to the sewer main in Candy Cove Trail SE. This area also receives sanitary sewer that runs from the Hidden Oaks neighborhood to the east of the project area. Sanitary sewer televising show the presence of deficiencies that range from pipe sags to minor leaks and mineral deposits. Leaking has also been observed within the sewer manholes. Issues identified in televising: • Sags in the pipe. • Roots at the joints (5%-95% blockage). • Cracks in the pipe. Cracks can lead to pipe collapse and sewage backups if left untreated. • Leaks in manholes. The existing watermain consists of six-inch cast iron pipe (CIP) throughout the project. There have been six documented watermain breaks in the Woodside/Huron neighborhood within the last ten years. It has been noted during repairs to the existing watermain that the pipe is pitted and corroded. 3.5 Street Lighting Cobra-style luminaires on wood poles provide the street lighting in the neighborhood. Lighting is located at intersections, mid-block, and cul-de-sac termini. 3.6 Private Utilities Private utilities that have facilities in or near the project area will be notified during the final design phase of the project and will be requested to coordinate any necessary repairs and replacements as needed at their cost. Private utility companies that have facilities within the project area include the following:  Center Point Energy (Gas)  CenturyLink (Telephone)  Mediacom (Fiber Optic/Cable)  Scott Rice/Integra Telephone (Telephone)  Xcel Energy (Electric)  Zayo (Telecom) Feasibility Report 2018 Woodside/Huron Neighborhood Reconstruction Project City of Prior Lake Project No. TRN 18-000001 WSB Project No. R-010344-000 Page 6 4. PROPOSED IMPROVEMENTS 4.1 Streets For the proposed streets, the roadway is to be reconstructed with subgrade corrections, an 18-inch sand section, and barrier style concrete curb and gutter. This design is based on soil conditions found from the soil borings (see Appendix B) and previous project experience. In these areas, the reconstructed roadway grades will be designed in such a way to minimize impacts to existing neighborhood features such as trees, landscaping, and driveways. All roads within the project area will be narrowed to 28-feet wide. 4.1.1 Right-Of-Way All proposed improvements are located within platted right-of-way so no permanent easements will be required. Temporary construction easements or waivers of trespass may be required for grading purposes to provide positive slopes to the curb. Temporary construction easements may also be necessary along the lot lines in which runoff outlets. 4.2 Storm Sewer and Drainage Reconstruction of the streets provides the opportunity to improve the drainage within the project area through the installation of new or additional storm sewer facilities. Proposed drainage improvements include installing new storm sewer and reconstructing or replacing existing catch basins. Stormwater quality improvements have been identified as part this project. An infiltration basin storm is proposed to be located within the City’s properties (Parcel IDs 250110240 and 250200010). Depending on the existing soils within the identified ponding area, a filtration system may be used in lieu of infiltration. This area will be maximized for the infiltration or filtration volumes that can be accommodated. This will provide excess treatment and bank credits for future City projects. Since the extent of the ponding work is not required by the neighborhood area, water quality improvement will not be assessed to residents. Storm drainage will meet Minnesota Pollution Control Agency (MPCA) and Prior Lake-Spring Lake Watershed District permanent quality and rate control requirements. Temporary erosion and sediment control devices will be utilized during construction in accordance with pertinent NPDES permit requirements. The proposed storm sewer improvements are shown on Figures 3, 4, and 5 of Appendix A. The costs for storm sewer work are included in Appendix C. 4.3 Sanitary Sewer The proposed sanitary sewer improvements consist of replacing the existing VCP sewer pipe with new PVC pipe due to the issues encountered during the televising. It is the City of Prior Lake’s practice to replace any VCP sewer main and house services to the right-of-way during road reconstruction projects. All the existing sanitary sewer pipe and manholes are proposed for replacement with structures and sewer pipe that meet current City standards. The proposed sanitary sewer improvements are shown on Figures 3, 4, and 5 of Appendix A. The costs for sanitary replacement are included in Appendix C. Full watermain replacement including replacement of all water services and curb boxes within the project area are proposed as part of the improvements. Temporary water services will need to be provided to maintain service to the affected properties while the main is replaced. Hydrants, valves, and services will also be replaced in these areas as needed. The proposed water system improvements are shown on Figures 3, 4, and 5 of Appendix A. The costs for watermain replacement are included in Appendix C. 4.5 Street Lighting The number of street lights that exist in the current neighborhood is limited. The replacement of existing street lights and the addition of new street lights, especially at intersections, has been standard practice on past improvement projects within the City. Street lighting is proposed to be installed throughout the neighborhood according to the City standard spacing. The proposed street light for the residential areas will be the traditional style according to City standard, and is located as shown on Figures 3, 4, and 5 in Appendix A. Extension of Watermain Permit 4.7 Construction Access/Staging The residential streets will be closed to “Local Traffic Only” during construction. The neighborhood will have times during storm sewer construction and other work tasks when access and egress is restricted during the day. Alternative routes through the neighborhood may need to be utilized to access driveways. Access to driveways is restricted during and after concrete curb and aprons are constructed. Parking on the street is allowed. 4.8 Public Involvement A public informational meeting for the proposed project was conducted by the City in June of 2017. Preliminary information was presented to attendees regarding the proposed improvements, costs, funding, schedule, and impacts associated with the project, and a questionnaire was sent out to residents after the meeting. A summary of correspondence received are included in Appendix E. FINANCING 5.1 Opinion of Probable Cost A detailed opinion of probable cost is included in Appendix C of this report. The opinion of probable cost is based on projected construction costs for 2018 and includes a 10% contingency and 28% indirect costs. The indirect costs include engineering, legal, and administrative costs associated with the project. FEASIBILITY, NECESSITY, AND COST EFFECTIVENESS The improvements proposed in this study are necessary for a number of reasons. The reconstruction of the streets provides the City with a cost-effective means of continuing the City’s street improvement efforts and ensuring an adequate means of transportation for local residents. The reconstruction of utilities within the area is ideal at this time due to the reconstruction of the roads and the worsening state of the existing utilities. These improvements will provide a longer lasting product needing less maintenance over time. The proposed improvements constitute a project large enough to ensure a competitive bidding environment, economy of scale, and are deemed to be cost-effective. Based on the information contained within this report, the proposed project is deemed necessary, cost-effective, and feasible from an engineering standpoint. The project feasibility is subject to financial review by the City.
