B. Case #02-075 Bernard Carlson is requesting a variance to the required rear
yard setback to allow the construction of an addition to Carlson Hardware Store
located at 16281 Main Avenue SE
Zoning Administrator Steve Horsman presented the Planning Report dated July 8, 2002,
on file in the office of the Planning Department.
The Planning Department received a variance application from Mr, Bernard Carlson
(applicant/owner) to allow the construction of an addition to an existing commercial
building on the property located at 16281 Main Avenue, The proposed addition will be
attached to the side of the existing building and extend to the rear lot line. The request is
for a 10- foot variance to permit a O-foot structure setback from a rear property line rather
than the minimum required lO-feet.
The City Building Department noted the applicant must provide soils and structural
engineers' plans on the method of protecting the adjacent buildings, The City
Engineering Department commented the existing manhole is under the concrete of the
loading dock, and a new manhole outside of building slab envelope must be built. In
addition, the line from the new manhole to the existing becomes a private service,
Integra Telecom noted existing telephone lines that service building will need to be
relocated,
The Planning staff has determined the variance request for the rear yard setback does not
meet the nine hardship criteria, since it is a business decision to expand the existing
building due to economic growth and the need for additional space for storage and
display of materials, The applicant can redesign the addition to meet the required 10'
setback with a comparable yet smaller addition. The stafftherefore recommended denial
ofthe requested variance.

Staff also noted if the Planning Commission found the variance met the hardship criteria,
it should be subject to the condition that no outdoor storage of equipment or dumpsters
will be allowed without providing screening from public view.
Comments from the public:
Applicant Bernie Carlson, 16281 Main Avenue, felt this was going to be a slam dunk but
understood the staffs recommendation following the ordinance, The main point is this is
not a new building and does not meet the new ordinance, It makes sense to add on to the
existing building which has a zero setback. If it is not built on, it will leave a small area in
which to collect trash and snow. The manhole hole was not an issue he was aware of, It
is not a project-breaker either way. Carlson said he wants to invest money and improve
downtown.
Stamson:
. Questioned the manhole, Carlson said there is no visible manhole and he's never
been aware of one in the 15 years he's owned the property.
. Kansier explained they would work with applicant on the manhole issue,
Criego:
. Questioned Carlson on loading and the access behind Fongs, Carlson explained
the proposal and felt he could work out any problems with Fongs,
Atwood:
. Questioned what the alley was used for, Carlson explained the major use was
used for deliveries by Viking Liquor, The video drop-off is not in the back of the
video store anymore reducing significant traffic, Carlson also explained the
additional parking and common trash container,
Criego:
. Concern is for delivery trucks in the alley such as trash pickup and larger trucks,
Carlson said he agreed with Fongs to cut the comer to 14 feet.
. Carlson also explained he would stay 4 feet away from the Extra Inning property,
Lanny Adler, owner of Extra Innings Saloon, concern was for the soil and structure
conditions for his property 4 feet away, Would he have problems down the road and who
would be responsible? Adler said he could find the manhole,
Comments from the Commissioners:
Ringstad:
. Thrilled the hardware store is doing well, but agreed with staffs recommendation
that the hardships have not been met.
. Denied the request.

Criego:
. Is this a side or back yard setback? On Main Street you can build up to the
existing neighbor, but not the back yard, Ifit was a side yard he would be able to
build up to the line.
. Realistically this is a side yard,
Lemke:
. Questioned staff on a minimum distance for an alley, Kansier said there was
nothing for a private driveway or access, This is a private driveway, It is not that
much different from what is there now,
. A strict reading of the 9 hardship criteria - it might be a stretch that it is met.
. The applicant's request makes sense, Understands the front access is on the side,
. Support the request since the applicant is willing to work with Fongs,
Atwood:
. Agreed with the rear and side issue,
. Had an issue with the "undo concentration of structures in relationship of
surrounding land," Viewed the land but technically the hardships had not been
met, but it is a reasonable request from a business owner to expect that area for
construction,
. Supported,
Stamson:
. Agreed with Ringstad, the hardships have not been met, however, the frontlback
yard setback argument is an issue, The way to do that is to overrule staff
indicating Eagle Creek Boulevard is the front. That then eliminates 10 feet off the
building, We do not have the right to do that.
. When this ordinance came up a few weeks ago, I brought up the fact rear yard
setbacks were not needed at all, I stood alone on that issue and everyone else felt
a 10 foot setback was needed, It was argued for quite a bit and I was overruled
because the others strongly felt a 10 foot setback was needed, Now the very first
building we see, they are saying it is not needed, In that case, the ordinance
should be reviewed.
. A variance is not warranted in this case,
. Did not support,
Criego:
. Did not disagree with Stamson, But felt there were two side yards, a front and
back yard, The back yard is the extension ofthe building, My logic is not as
sound as I thought it was.
. We can't allow variances without hardship criteria,
. Can we allow side yards to be zero.
. Ifthere is justification it is a comer lot - that's the hardship,

Stamson pointed out staff and most Commissioners felt very strongly that there should be
10 foot division. A variance should not be granted - the ordinance should be changed,
Criego agreed, The Commissioners continued to discuss the back yard versus the
variance request.
Criego questioned how the City addresses the issue of not damaging the neighboring
property, Kansier explained it would be addressed at the building permit phase,
MOTION BY CRIEGO, SECOND BY LEMKE, TO APPROVE THE REQUEST FOR

FINDINGS BEING IT IS A UNIQUE CORNER LOT AND SITUATION,

C. Case #02-076 Hillcrest Homes, Inc. is requesting variances to allow grading,
fill and excavation within the bluff impact zone on property located at 14764
Rosewood Road.
Zoning Administrator Steve Horsman presented the Planning Report dated July 8, 2002,
on file in the office of the Planning Department.
The Planning Department received a variance application from Hillcrest Homes, Inc, to
permit a boulder retaining wall to remain on the property located at 14764 Rosewood
Road, The boulder wall and fill were installed during the construction of a single-family
dwelling that was approved under Building Permit # 01-1206, The applicant had
submitted a building permit application and survey for the project, but the submitted
materials did not include the retaining wall and the grading/filling work conducted within
the bluff impact zone as part of the proposed project. Thus this work was done without a
permit. An inspection of the project by staff discovered the work, The applicant is
requesting a variance to permit the import of materials and grading/filling within the bluff
impact zone,
The Area Hydrologist with the Department of Natural Resources submitted comments on
this request. The DNR visually inspected the site and directed the applicant to correct the
riprap boulders placed along the shoreline, He reserved judgment on the work in the
bluff impact zone until an engineers report was submitted, but commented that removing
the boulders and imported fill at this point may have greater potential for erosion and
slope failure,
Staff felt all nine-hardship criteria had not been met with respect to the requested
ariance to permit the import of materials and grading/filling in a bluff impact zone, The

A. Cases #02-057 & 058 McDonald Construction, Inc., has submitted an
application for a POO amendment and a combined preliminary and final plat
known as Sterling South at The Wilds. The proposal replats Lots 31-40 to
accommodate townhouses and single family homes.
Planning Coordinator Jane Kansier presented the Planning Report dated July 22, 2002, on
file in the office of the City Planning Department.
McDonald Construction has submitted an application that includes the following
requests:
. An amendment to the Sterling South at The Wilds Planned Unit Development Plan;
. A Combined Preliminary and Final Plat;
. The vacation of a portion of the existing drainage and utility easement over Lot 89,
Block I, Sterling South at The Wilds Addition,
The proposal amends the existing PUD plan to allow a combination of detached single
family dwellings and townhouses within Sterling South at the Wilds, The proposal also
includes a replat of Lots 31-40, Block I, Sterling South at The Wilds, to accommodate
both townhouses and detached single family dwellings,
The proposed PUD amendment, combined preliminary and final plat and vacation are
consistent with the existing development of Sterling South at The Wilds, The staff
therefore recommended approval, subject to the following conditions:
1. The resolution vacating the easement will not be recorded until the final plat of
Sterling Addition has been approved and signed by the City,
2, The applicant must provide existing and proposed individual water and sanitary sewer
service stub locations per Jot or building,

A RESOLUTION APPROVING A VARIANCE TO PERMIT A STRUCTURE SETBACK
OF 0' FEET FROM A REAR PROPERTY LINE RATHER THAN THE REQUIRED
MINIMUM 10 FEET
BE IT RESOL YED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
1. Mr. Bernard J. Carlson has applied for a variance from the Zoning Ordinance in order to
permit the construction of an addition to a commercial building on property located in the C-
3 District (Specialty Business) at the following location, to wit;
16281 Main Avenue SE, legally described as Lot 1, Block I, Carlsons Hardware
Addition, Plat 25369, Scott County, Minnesota,
2. The Board of Adjustment has reviewed the application for variances as contained in Case
#02-075PC and held a hearing on July 8, 2002.
3. The Board of Adjustment has considered the effect of the proposed variance upon the health,
safety, and welfare of the community, the existing and anticipated traffic conditions, light and
air, danger of fire, risk to the public safety, the effect on property values in the surrounding
area and the effect of the proposed variance on the Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding property, the proposed
variance for a O-foot rear setback will not result in the impairment of an adequate supply of
light and air to adjacent properties, unreasonably increase congestion in the public streets,
increase the danger of fire, and danger to the public safety, unreasonably diminish or impair
health, safety, comfort, morals or in any other respect be contrary to the Zoning Ordinance
and Comprehensive Plan.
5. There is justifiable hardship caused by the required rear yard setback and the location of the
existing structure, as reasonable use of the property does not exist without the granting of the
variance.
6, The granting of the variance is necessary for the preservation and enjoyment of a substantial
property right of the applicant. The variance will not serve merely as a convenience to the
applicant, and is necessary to alleviate demonstrable hardship. The factors above do not
allow for an alternative structure to be permitted with a reduced variance or none at all.
7, The contents of Planning Case 02-075PC are hereby entered into and made a part of the
public record and the record of decision for this case.

CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby approves the following
variance for a future building addition to a commercial building as shown in Attachment 1:
1. A 10-foot variance to permit a structure setback of O-feet from a rear property line, rather
than the required minimum lO-feet.
The following conditions shall be complied with prior to the issuance of a building permit for the
proposed addition:
1, The resolution must be recorded wirh Scott County within 60 days of adoption, and proof of
recording along with the acknowledged City Assent Form shall be submitted to the Planning
Department prior to the issuance of a building permit.
2. The building permit is subject to all other applicable city, county, and state agency
regulations.
3. The subject site shall be developed as shown on the attached certificate of survey.

The undersigned hereby assents to the following:
1, I have read the conclusions and conditions of said Resolution, and I am familiar with
their contents and with the content ofthe exhibits,
2, I fully accept all of the terms and conditions of said Resolution,
3, I understand Section 1108.400 ofthe Prior Lake Ordinance Code provides as follows:
1108.413 Revocation and Cancellation of a Variance. A Variance may be
revoked and canceled if the Zoning Administrator determines that the
holder of an existing Variance has violated any of the conditions or
requirements imposed as a condition to approval of the Variance, or has
violated any other applicable laws, ordinances, or enforceable regulation.
1108.414 After One Year. No Construction ReQuired. All Variances shall be
revoked and canceled if 1 year has elapsed from the date of the adoption
of the resolution granting the Variance and the holder of the Variance
has failed to make substantial use of the premises according to the
provisions contained in the Variance,
1108.415 After One Year. New Construction ReQuired, All Variances shall be
revoked and canceled after 1 year has elapsed from the date of the
adoption of the resolution granting the Variance if a new structure or
alteration or substantial repair of an existing building is required by the
Variance and the holder has failed to complete the work, unless a valid
building permit authorizing such work has been issued and work is
progressing in an orderly way,
1108.416 Uoon Occurrence of Certain Events. If the holder of a Variance fails
to make actual use of vacant land. or land and structures which were
existing when the Variance was issued and no new structure, alteration
or substantial repair to existing buildings was required; or if a new
structure was required by the Variance and no building permit has been
obtained, the Variance shall be deemed revoked and canceled upon the
occurrence of any of the following events:
(1) A change in the Use District for such lands is made by amendment to
the Zoning Ordinance by the City Council.

(5) The person to whom the Variance was issued files a written statement
in which that person states that the Variance has been abandoned,
The statement shall describe the land involved or state the resolution

(6) The premises for which the Variance was issued are used by the
person to whom the Variance was issued in a manner inconsistent
with the provisions of such Variance.
4, I understand the granting by the City of this Resolution is in reliance on the
representations that I will fully comply with all of the terms and conditions of said
Resolution. I understand and agree upon notice of non-compliance with any term or
condition, I shall immediately cease conducting activities pursuant to the notice or
will take all actions necessary to accomplish full compliance with said notice and

A RESOLUTION DENYING A VARIANCE TO PERMIT A STRUCTURE SETBACK OF
0' FEET FROM A REAR PROPERTY LINE RATHER THAN THE REQUIRED
MINIMUM 10 FEET
BE IT RESOL YED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
1. Mr, Bernard J, Carlson has applied for a variance from the Zoning Ordinance in order to
permit the construction of an addition to a commercial building on property located in the C-
3 District (Specialty Business) at the following location, to wit;
16281 Main Avenue SE, legally described as Lot I, Block I, Carlsons Hardware
Addition, Plat 25369, Scott County, Minnesota,
2, The Board of Adjustment has reviewed the application for variances as contained in Case
#02-075PC and held hearings thereon on July 8, 2002,
3, The Board of Adjustment has considered the effect of the proposed variance upon the health,
safety, and welfare of the community, the existing and anticipated traffic conditions, light
and air, danger of fire, risk to the public safety, the effect on property values in the
surrounding area and the effect of the proposed variance on the Comprehensive Plan.
Because of conditions on the subject property and on the surrounding property, the proposed
variance will result in the impairment of an adequate supply of light and air to adjacent
properties, unreasonably increase congestion in the public streets, increase the danger of fire,
and danger to the public safety, unreasonably diminish or impair health, safety, comfort,
morals or in any other respect be contrary to the Zoning Ordinance and Comprehensive Plan.
An alternative legal building addition location that meets the required setback for the
structure exists on the subject lot. The applicant has control over the plan design and shape,
such that the hardship created has been created by the applicant. Reasonable use of the
property exists without the building addition as proposed.
There is no justifiable hardship caused by the required rear yard setback, as reasonable use of
the property exists without the granting of the variance,
The granting of the variance, as originally requested, is not necessary for the preservation
and enjoyment of a substantial property right of the applicant. The variance will serve
merely as a convenience to the applicant, and is not necessary to alleviate demonstrable
hardship, The factors above allow for an alternative structure to be permitted with a reduced
variance or none at all,

CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby denies the following
variances for a future building addition to a commercial building as shown in Attachment I;
1. A 10-foot variance to permit a structure setback of O-feet from a rear yard property line,
rather than the required minimum of 10-feet.
Adopted by the Board of Adjustment on July 8, 2002.

The purpose of this letter is to advise you that the enclosed Resolution 02-
011 PC approving a variance on the property located at 16281 Main Avenue
must be recorded at Scott County within 60 days from the adoption date of July
22, 2002, A building permit will not be issued until proof of recording has been
submitted to the Planning Department. The variance will be null and void per
Section 1108 of the City Code within one year if the project is not completed or if

The Planning Department held a public hearing on July 8, 2002, to consider a
variance application from Mr. Bernard Carlson to allow the construction of an
addition to an existing commercial building on the property located at 16281
Main Avenue, The proposed addition will be attached to the side of the existing
building and extend to the rear lot line, After review of the applicant's request
with respect to the variance hardship criteria, the Planning Commission directed
staff to draft Resolution 02-011 PC approving the following variance:
1, A 10-foot variance to permit a O-foot structure setback from a rear
property line rather than the minimum required 10-feet.
The following conditions are included in the resolution and must be complied with
prior to the issuance of a building permit for the proposed addition:
1, The resolution must be recorded with Scott County within 60 days of
adoption, and proof of recording along with the acknowledged City Assent
Form shall be submitted to the Planning Department prior to the issuance of a
building permit.
2, The building permit is subject to all other applicable city, county, and state
agency regulations,

The Planning Department received a variance application from Mr. Bernard
Carlson (applicant/owner) to allow the construction of an addition to an existing
commercial building on the property located at 16281 Main Avenue, The
proposed addition will be attached to the side of the existing building and extend
to the rear lot line, The Main Avenue street side is determined to be the "Front
Lot Line" as defined in Ordinance Section 1101.400,
The following variance is requested:
1. A 10-foot variance to permit a O-foot structure setback from a rear
property line rather than the minimum required 10-feet (Ord. See,
1102,1105: Dimensional Standards),
DISCUSSION:
The property was originally platted in 1934 as Cates Addition to Prior Lake,
Another portion of the property was platted in 1977 as Langhorst 151 Addition,
The property was again platted in the year 2000 as Lot 1, Block 1, Carl sons
Hardware Addition, Mr. Carlson is the business owner, applicant, and property
owner, along with Wallace & Delores Langhorst according to Scott County
records, The lots dimensions are 135,31' (front) x 119.45' (front/side) x 76,98'+
3'+ 56.47' (rear) x 112,26' (side) (Attachment 1 - Certificate of Survey),

The subject building is attached to the building due east of the subject lot with a
common exterior wall or 0' rear yard setback. The proposed addition is irregular
in shape and is an extension of the existing west wall by 26' to within a couple
feet of the side lot line, then turns 90 degrees east for 18,54' to within 9" of the
side property line, and follows the side lot line for 56,9'+ 3' + 55,89' to the East
lot line, then turns 90 degrees north for 19,8' along the rear lot line and
terminates at the existing building wall. The addition includes a full basement to
match the existing basement level. The delivery access is through an 8'
overhead door on the east end of the addition with driveway access,
(Attachment 2 - Building Addition Plans),
The addition's exterior walls consists of 8" masonry walls to match the materials
and design of the existing structure, The proposed building materials do not
meet today's requirements for new structures, but are permitted for additions to
existing buildings under the Section 1102,1407 (2) of the Zoning Ordinance,
This request was referred to applicable City departments and utility companies
for comment. The City Building Department noted, in part, that the applicant
must provide soils and structural engineers' plans on the method of protecting
the adjacent buildings, The City Engineering Department commented that the
existing manhole is under the concrete of the loading dock, and a new manhole
outside of building slab envelope must be built. In addition, the line from the new
manhole to the existing becomes a private service, Integra Telecom noted that
existing telephone lines that service building will need to be relocated,
VARIANCE HARDSHIP STANDARDS
1. Where by reason of narrowness, shallowness, or shape of a lot, or
where by reason of exceptional topographical or water conditions or
other extraordinary and exceptional conditions of such lot, the strict
application of the terms of this Ordinance would result in peculiar and
practical difficulties or exceptional or undue hardship upon the owner
of such lot in developing or using such lot in a manner customary and
legally permissible within the Use District in which said lot is located,
The existing lot can accommodate a revised and scaled down building
addition without the setback variance,
2. Conditions applying to the structure or land in question are peculiar to
the property or immediately adjoining property, and do not apply,
generally, to other land or structures in the Use District in which the
land is located.
The conditions that apply are not peculiar to the property or adjoining
property, and do apply, generally, to other land or structures in the C-3

District. There appears to be a legal alternative for a redesigned addition that
meets code requirements,
3. The granting of the proposed Variance is necessary for the preservation
and enjoyment of a substantial property right of the owner.
By redesigning the configuration of the addition, it can be built without the
requested variance,
4. The granting of the proposed Variance will not impair an adequate
supply of light and air to the adjacent property, unreasonably increase
the congestion in the public streets, increase the danger of fire, or
endanger the public safety,
The granting of the variance appears to impair the supply of light and air to
the adjacent property, The addition will not significantly impact the public
streets or endanger public safety,
5. The granting of the Variance will not unreasonably impact on the
character and development of the neighborhood, unreasonably
diminish or impair established property values in the surrounding area,
or in any other way impair the health safety, and comfort of the area,
Staff is of the opinion that granting this variance will not impact the above
stated values,
6. The granting of the proposed Variance will not be contrary to the intent
of this Ordinance and the Comprehensive Plan.
The granting of these variances is contrary to the intent of the Ordinance and
Comprehensive Plan, which is to provide orderly development and prevent
over crowding of land and undue concentration of structures in relation to the
land surrounding them.
7. The granting of the Variance will not merely serve as a convenience to
the applicant but is necessary to alleviate a demonstrable undue
hardship or difficulty,
The proposed addition can be redesigned to eliminate the need for the
requested variance, The granting of the variance is not necessary to alleviate
a demonstrable hardship existing today, but for the proposed future addition,
8. The hardship results from the application of the provisions of this
Ordinance to the affected property and does not result from actions of
the owners ofthe property.

The applicant is proposing the addition, and therefore the result is a required
variance request. The variance would not be necessary with a redesign of
the addition,
9. Increased development or construction costs or economic hardship
alone shall not be grounds for granting a Variance,
Redesigning the addition will eliminate the need for the requested variance,
RECOMMENDATION:
The Planning staff has determined that the variance request for the rear yard
setback does not meet the nine hardship criteria, since it is a business decision
to expand the existing building due to economic growth and the need for
additional space for storage and display of materials, The applicant can
redesign the addition to meet the required 10' setback with a comparable yet
smaller addition, The staff therefore recommends denial of the requested
variance,
If the Planning Commission finds the variance request meets the hardship
criteria, it should be subject to the condition that no outdoor storage of
equipment or dumpsters will be allowed without providing screening from public
view,
ALTERNATIVES:
1, Approve the variance requested by the applicant, or approve any variances
the Planning Commission deems appropriate in the circumstances, In this
case, the Planning Commission should direct staff to prepare a resolution
with findings approving the variances requested,
2, Table or continue discussion of the item for specific purpose,
3, Deny the application because the Planning Commission finds a lack of
demonstrated hardship under the zoning code criteria.
ACTION REQUIRED:
The staff recommends Alternative #3, A Motion and second adopting
Resolution 02-011 PC denying the requested variance to the 10' minimum

The City will now begin formal review of this request. At this time, you are tentatively
scheduled for the July 8, 2002, Planning Commission meeting. I will notify you of any
changes to that date,
The City review process can be substantially less than 120 days, and we intend to move
this matter through the process in a timely manner that provides a complete,
professional review, Occasionally, however, due to meeting schedules, it is sometimes
necessary to extend the 60,day review period. This letter also serves as your official
notice that the City is extending the 50-day deadline for an additional 60 days from

PROCEDURE FOR AN APPLICATION FOR A VARIANCE
TO THE PROVISIONS OF THE ZONING ORDINANCE
OverY ew: When a person wishes to maintain/build/construct a structure in a manner that does not
compl with the requirements of the City's Zoning Ordinance, a variance is required. Specific
require ents for property in each Zoning Use District are contained in the Zoning Ordinance. Section
1108,4 0 of the Code sets forth the procedure and requirements for the review of variance requests, The
Code it available for review or purchase from the City's Planning Department.

Pre-A lication Procedure: Prior to submitting an application for a variance, applicants are encouraged
to mee with the Planning Staff to discuss the following:
. IZoning requirements that apply to the property,
. Preliminary development or building plans for the property,
. IThe specific criteria of the Zoning Ordinance applicable to the development or building plan,
. ,Alternatives to the proposed development.

If a detision is made to proceed after the advisory meeting or meetings, a formal application is made.

Proce : Within ten (10) business days of submission of the application, the applicant will receive
formal written notice from the City about whether the application is complete, Within 30 days of receipt
of a co plete application, the Planning Department will schedule a public hearing for review by the
Board f Adjustment (Planning Commission). The Board of Adjustment must approve or deny the
applic~tion within 120 days of receipt ofa complete application,

month. Complete applications must be submitted to the Planning Department at least thirty (30) days

1. Whfre by reason of narrowness, shallowness, or shape of a lot, or where by reason of exceptional
top1graphical or water conditions or other extraordinary and exceptional conditions of such lot, the
stri~t application or the tenus of this Code would result in peculiar and practical difficulties or
excfptional or undue hardship upon the owner of such lot in developing or using such lot in a
m;u\ner customary and legally permissible within the Use District in which said lot is located.
2, cotitions applying to the structure or land in question are peculiar to the property or immediately
adj ining property, and do not apply, generally, to other land or structures in the Use District in
wh' h the land is located,
3, Th granting of the proposed Variance is necessary for the preservation and enjoyment of a
sub tantial property right of the owner.
4, Th granting of the proposed Variance will not impair an adequate supply of light and air to the
adj cent property, unreasonably increase the congestion in the public streets, increase the danger of
fire or endanger public safety,
5, Th granting of the Variance will not unreasonably impact on the character and development of the
nei hborhood, unreasonably diminish or impair established property values in the surrounding area,
or i any other way impair the health safety. and comfort of the area,
6, Th~ granting of the proposed Variance will not be contrary to the intent of this Code and the
COIpprehensive Plan,
7, Thtj granting of a Variance will not merely serve as a convenience to the applicant but is necessary
to ~Ileviate a demonstrable undue hardship or difficulty,
8, Thtj hardship results from the application of the provisions of this Code to the affected property and
doejl not result from actions of the owners of the property,
9, Incteased development or construction costs or economic hardship alone shall not be grounds for
graIning a Variance,
