MAINTENANCE OF THE EXTENSION OF COUNTY ROAD
81/STEMMER RIDGE ROAD TO CSAH 82/154TH STREET AND
ASSOCIATED UTILITIES
DISCUSSION: Introduction
The connection of Stemmer Ridge Road from CSAH 12 to CSAH 82 was
shown in the City’s Comprehensive Plan and discussed for many years.
The City Council approved an agreement with the SMSC in March of 2016
for the construction of this segment of roadway. The project is now
complete and an agreement is necessary specifying how the roadway and
underlying utilities will be maintained. A related item is the turn back of this
segment of Stemmer Ridge Road from Scott County to the City which is
also on the agenda this evening as agenda item 5I.
History
A history of the milestones associated with the roadway connection between
CSAH 12 and CSAH 82 is shown below:

• 2006 – Development of Stemmer Ridge Road South of Former
Menden Parcel
• Aug, 2012 – Stemmer Ridge Road Extension Added to City Capital
Improvement Plan
• Oct, 2013 – Aug, 2014 – Feasibility Report and Environmental
Assessment Worksheet Preparation
• Fall, 2014 – SMSC Purchases Former Menden Property
• Dec, 2014 – Public Hearing and City Council Orders Project which
Extends Stemmer Ridge Road to County Road 82
• Spring, 2015 – Attempts for Agreement Between SMSC and the
City
• June, 2015 – SMSC Applies to Place Property into Trust

Current Circumstances
The construction of the utilities and streets for this segment of Stemmer
Ridge Road began in the fall of 2016. The project was completed in
September of 2017 and was officially opened on October 3, 2017.
To facilitate the construction of this segment of the roadway, Scott County
entered into an agreement with the SMSC to dedicate the right-of-way as
County Road 81. Now that the project is complete, the County is
requesting that the roadway be turned back to the City. However, prior to
accepting the roadway it is necessary to have an agreement in place with
the SMSC to define how the maintenance and long-term replacement will
be completed.
The attached agreement outlines the details for maintenance and
replacement. The City will be responsible for snow removal of the entire
roadway as well as the pedestrian trail on the west side of the street up to
the roundabout and then on the east side from the roundabout to CR82.
The City is plowing these segments of trails to provide access to the
existing City park on the west side of Stemmer Ridge Road and to provide
access to the County park located on the east side of Stemmer Ridge
Road at the roundabout. The City is already plowing the portion of
Stemmer Ridge Road to the south so it is cost effective for the City to plow
the new section of Stemmer Ridge Road to the north. The SMSC will be
responsible for all landscape maintenance and for any snow removal on
the remainder of the trail segments. Per the agreement the City will meet
with the SMSC annually to determine if this separation of maintenance
responsibilities is still the most cost effective.
The roadway itself it the responsibility of the SMSC. This includes
sealcoating, patching, mill and overlays, and the eventual replacements.
The City is only responsible for the City owned sanitary sewer and
watermain beneath the roadway. If there is ever an issue with the City’s
utilities that requires excavation to repair or replace those utilities the City
would be responsible for replacing the portion of the street removed to
accommodate the work.
Conclusion
There is a significant benefit to the City to have jurisdiction over this portion
of Stemmer Ridge Road. This road is part of the City’s Municipal State Aid
System and therefore the City receives State Aid funding for this roadway.
In addition, the City is ensured that Stemmer Ridge Road will continue to
provide connectivity between CR 12 and CR 82 in perpetuity which is an

important transportation connection. This agreement between the City and
SMSC clearly defines the maintenance responsibilities between the two
parties and protects the City’s interests.
ISSUES: Citizens within the Spring Lake Estates neighborhood were disappointed
with the extension of Stemmer Ridge Road to CR 82. However, as part of
the project there were a number of traffic calming measures that were
implemented that included bump outs and driver feedback signs. The
roadway has been open for several months now and these extra measures
appear to be accomplishing the desired results.
FINANCIAL
IMPACT:
The financial impacts of this agreement are minimal. The increased costs
for the City are primarily the additional street plowing that the City will be
completing.
ALTERNATIVES: 1. Motion and second as part of the consent agenda to approve an
intergovernmental cooperative agreement between the Shakopee
Mdewakanton Sioux Community for the maintenance of the extension of
County Road 81/Stemmer Ridge Road to CSAH 82/154th Street and
associated utilities.
2. Motion and second to remove this item from the consent agenda for
additional discussion.

WHEREAS, Stemmer Ridge Road is shown in the City’s Comprehensive Plan for connection
between CSAH 82 and CSAH 12; and
WHEREAS, The SMSC and the City previously entered into an agreement to complete the
construction of Stemmer Ridge Road Project and utilities; and
WHEREAS, The City is authorized to enter into contracts pursuant to Minnesota Statutes
Chapter § 412.221; and
WHEREAS, The Parties desire to enter into an Agreement to define the maintenance
responsibilities the County Road 81 / Stemmer Ridge Road Project.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council hereby approves a Cooperative Agreement with the Shakopee
Mdewakanton Sioux Community dated January 8, 2018 for the Stemmer Ridge Road
Project and authorize the Mayor and City Manager to execute the same.
