History Each year the City mills and overlays street segments that are part of its Capital Improvement Program (CIP). The City uses the CIP and its Pavement Management Program to plan for infrastructure improvements and the financing for capital improvements. Our target is to complete between three and four miles of street overlay annually to stay abreast of our citywide street maintenance program. Special assessments were planned to be part of the financing for this project. Minnesota Statute Chapter 429 identifies a process that applies to all projects that will be financed in whole or in part through special assessments or bond proceeds. At it’s December 4, 2017 meeting the City Council adopted Resolution # 17-198 authorizing staff to prepare a Feasibility Report for the 2018 Mill and Overlay Project. The next step for the Council is to accept the feasibility study and call for the Improvement Hearing. At the Improvement Hearing, interested persons may voice their concerns, whether or not they are in the proposed assessment area. A reasonable methodology used to calculate individual assessments for the affected parcles must be available at the hearing. Current Circumstances The 2018 Street Improvement Project affects approximately 3.6 miles of roadway throughout the City. Proposed roadways to be improved are shown on the Location Map provided in the feasibility study and include Carriage Hills Pkwy NE, Dove Ct, Raven Circle, Raven Ct, Hidden View Rd, Greenway Ave, Wild Oaks Terrace, Fish Pt Rd, Fairlawn Shores Tr, Priorwood St SE, Tranquility Ct, Center Rd, Lime Rd, Terrace Circle, 2 Westbury Ave, Kestrel St, Cross St, Simpkins Ave, Peregrine Circle, Willowwood Circle, and Simpkins Circle. The proposed work type is a mill and overlay where the bituminous pavement is edge milled and a layer of pavement, typically 1.5” thick, is placed. This provides a smooth pavement surface as well as a new structural layer to the roadway. Replacement of the curb and gutter will occur where there is cracked or damaged curb and in locations to improve drainage. The feasibility report explores the necessity of rehabilitating the roadways within the developments as part of the City’s ongoing Street Improvement program. Conclusion In summary, the project is feasible, necessary and cost-effective to maintain the City’s road system. Approval of the Feasibility Report is the next step in the 429 process and does not grant final approval of the project. If the Council accepts the Feasibility Report, the Chapter 429 special assessment statute requires the Improvement Hearing be conducted before the City Council considers ordering the project. A public hearing is proposed for March 5, 2018. At that meeting, the proposed improvements, project schedule and assessments will be presented to the residents. ISSUES: The City’s assessment policy is being followed for this project. The policy was updated in 2016 to include assessments for mill and overlay type projects. And a per lot amount was set as part of the City’s fee schedule. The Single Family Assessment Rate for a mill and overlay was set at $1,200 per single family lot for 2018 (0.8 or $960 for multifamily lots). The assessment repayment period is five (5) years or $240/196 each year plus financing costs per the assessment policy. Tonight’s action requires only a majority vote. FINANCIAL IMPACT: The 2018 Mill and Overlay Project is proposed to be financed by Special Assessments and the Street portion of the General Fund. Revenue will come from two sources, the tax levy and special assessments. The total cost is estimated at $630,000 which includes $357,117.77 in special assessments. The remaining funding of $272,882.23 will come from the tax levy. The approved 2018 Capital Improvement Program and Budget contemplated $650,000 in the newly created Permanent Improvement Revolving Fund for this project. ALTERNATIVES: 1. Approve a Resolution accepting the Feasibility Report and establishing a Public Hearing Date. 2. Table the item and direct staff to make further modifications as needed. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council hereby accepts the Feasibility Report as submitted. 3. The Council will consider the improvement of such streets and areas in accordance with the Report and the assessment of property as described iin the Report for all or a portion of the cost of improvements pursuant to Minnesota Statutes Chapter 429 at an estimated cost of the improvements of $630,000. 4. A Public Hearing shall be held on such proposed improvements on the 5th of March, 2018 at Prior Lake City Hall, with the address of 4646 Dakota St SE, City of Prior Lake, Minnesota at 7:00 p.m. statutory notice and publication requirements shall be followed. The cost for the proposed improvement, including the 10% contingency is $630,000. Project Location The 2018 Mill & Overlay Project is located in multiple locations throughout the City including Section 2, Township 114, Range 22; Section 4, Township 114, Range 22; Section 26, Township 115, Range 21; Section 30, Township 115, Range 21; and Section 36, Township 115, Range 22 in the City of Prior Lake, Scott County, Minnesota. Project History On December 4th, 2017, the City Council ordered the preparation of a feasibility study for the 2018 Mill & Overlay Project (Street Project STR18-0000001). The feasibility study is necessary because a portion of the funding for this project is proposed to come from special assessments. State Statutes dictate that a feasibility study can either be initiated by a petition of the affected property owners, or at the direction of the City Council. This project was initiated at the direction of the City Council. This report is intended to consider the areas listed below. Identification of these areas is a result of the City’s ongoing Pavement Management Program. The program was implemented to maximize the useful life of the City’s streets. Streets are generally recommended for mill & overlay when their Overall Condition Index (OCI) is between 45 and 65 on a scale of 0 to 100. In addition to the OCI rating, the streets recommended for the 2018 project were field inspected to confirm if a mill & overlay was appropriate as part of the feasibility study. That is why some streets included in the 2018 project have ratings above 65 and others have ratings below 45. For mill & overlay, approximately 1.5- inch of the existing bituminous surface near the curbs will be milled and removed from site. A new layer of bituminous pavement will be placed over the entire roadway width to provide a smooth surface and new structural layer. Existing curb and gutter will remain in place except sections of damaged curb and gutter, and areas that do not drain properly. City staff will inspect the curb and gutter for cracking and/or settlement and the actual quantity of curb replacement will be marked for replacement prior to the project start. The Contractor would be responsible for restoring any disturbed areas behind the curb after replacement. This restoration may include seed, sod, driveway pavement and/or landscaping. Right-of-Way and Easements No additional right of way or easements are required for this project. If any issues arise, requiring access outside of the existing right-of-way and easements, staff will handle these on a case-by-case basis and work with the affected property owner to obtain right of entry. Private Utilities Staff will work with all private utility companies to identify, locate, and avoid damaging the existing service lines in the area. Staff will also work with residents to have the resident locate their sprinkler systems, landscaping and any underground fencing. Permits and Approvals The majority of the work proposed is within the City’s right-of-way. Since the proposed improvements consist of a mill and overlay, no additional permits are anticipated. Operational Issues and Costs No unusual maintenance concerns or costs are expected due to the construction . The work is scheduled to occur during the summer before school begins. Opinion of Probable Cost Included in the Appendix of this report is an opinion of probable costs. The costs are estimated based on recent construction projects in the City of Prior Lake and assume the installation of the improvements will be completed in 2018. The costs in the appendix are based on the proposed mill and overlay. 7 Following is a summary of estimated project costs: Estimated Construction Cost $570,000 Construction Contingencies (10%) $60,000 Total Estimated Construction Cost $630,000 Proposed Funding As reflected in this funding allocation, staff anticipates a single project in 2018 using the Permanent Improvement Revolving Fund. Revenue will come from two sources, the tax levy and special assessments. The total amount proposed to be assessed is $482,306.40. The remaining funding of $147,693.60 will come from the tax levy. Proposed Assessments The City’s assessment policy is being followed for this project. The policy was updated in 2016 to include assessments for mill and overlay type projects and a per lot amount was set as part of the City’s fee schedule at the end of 2016. As this project involves only a basic mill & overlay, it is unlikely benefit appraisals will be required; ordering of benefit appraisals will be at the discretion of the City Attorney. The Single Family Assessment Rate for a mill & overlay was set at $1,200 per lot for 2018. The assessment repayment period is five (5) years per the assessment policy. Per the preliminary assessment roll attached, there are 369 properties proposed to be assessed making up 402 assessment units based on the Assessment Policy adjustments for property types. Single family and townhome lots are assessed for 1 unit. Condominium units are assessed for 0.8 units. There is one commercial property included in the project area. That property was converted to equivalent residential units by multiplying the acreage of the property by 2.2 units per acre. This is consistent with the methodology that was used in previous years. A typical single-family subdivision generates 2.2 units per acre therefore that is the formula that is used to convert non-residential properties to equivalent residential units. Recommendations Staff recommends the City proceed with the improvements as proposed in the report.
