AGENDA ITEM: CONSIDER APPROVAL OF A CERTIFICATION OF PLAT CORRECTION
TO THE PLAT OF SUMMIT PRESERVE
DISCUSSION: Introduction
The purpose of this agenda item is to consider approval of a land surveyor’s
certificate of correction to the plat of Summit Preserve. This correction will
change one street name within the subdivision and does not affect street or
lot dimensions.
History
The final plat of Summit Preserve was approved by the Prior Lake City
Council on May 22, 2017 and was filed in the office of the Scott County
Recorder on July 13, 2017.
Current Circumstances
Occasionally recorded plats have corrections, errors, or omissions on them.
Minnesota Statutes Section 505.174 provides for either the surveyor who
signed the plat or another licensed surveyor to record a Certificate of
Correction to Plat to notify the public of a correction.
After the final plat of Summit Peserve was recorded, it was discovered that
a street within the plat was identified as 141st Street NE. This street is a
westerly continuation of 141st Street West in the City of Savage; however,
this street is north of 140th Street (Hwy 42) and therefore does not conform
to the numerical street system of the City of Prior Lake. The street is
proposed to be changed to Royalton Road NE.
Conclusion
The attached land surveyor’s certificate of correction to plat will officially
change the street name of 141st Street NE to Royalton Road NE. The Scott
County Surveyor has reviewed the proposed certificate of correction to plat.
ISSUES: The certificate of correction to plat will need to be recorded. The house
address numbers will not change but the street name will change for the 19
residential properties along 141st Street NE [Royalton Road NE] within
Summit Preserve. No sales have closed for properties along this street
section. The developer is working with city staff and is aware the street name
will be changed.

FINANCIAL
IMPACT:
A document recording fee of $46.00 is required for the certificate of plat
correction.
ALTERNATIVES: 1. Motion and second, as part of the consent agenda, approving the
Resolution authorizing the Mayor and City Manager to sign the Land
Surveyor’s Certificate of Correction to Plat for Summit Preserve.
2. Take no action and provide direction to staff

RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER
TO SIGN THE LAND SURVEYOR’S CERTIFICATE OF CORRECTION TO PLAT
FOR SUMMIT PRESERVE

WHEREAS, Occasionally recorded plats have corrections, errors, or omissions on them; and
WHEREAS, Minnesota Statutes Section 505.174 provides for either the surveyor who signed
the plat or another licensed surveyor to record a Certificate of Correction t o Plat
to notify the public of a correction; and
WHEREAS, After the final plat of Summit Preserve was recorded on July 13, 2017, it was
discovered that the street name of 141st Street NE was north of 140th Street NE,
and therefore not in compliance with the City of Prior Lake numerical street
system; and
WHEREAS, The Land Surveyor submitted a Land Surveyor’s Certificate of Correction to Plat
for Summit Preserve which will officially change the street name of 141st Street
NE to Royalton Road NE; and
WHEREAS, The Prior Lake City Council reviewed the Land Surveyor’s Certificate of
Correction to Plat on March 19, 2018 and authorized the Mayor and City Manager
to sign the Land Surveyor’s Certificate of Correction to Plat for Summit Preserve.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council authorizes the Mayor and City Manager to sign the Land Surveyor’s
Certificate of Correction to Plat for Summit Preserve.
Passed and adopted by the Prior Lake City Council this 19th day of March 2018.

Pursuant to the provisions of Minnesota Statutes Section 505.174, Craig Morse, the undersigned,
a Registered Land Surveyor in and for the State of Minnesota, declares as follows:
1. That I prepared the plat of SUMMIT PRESERVE filed on July 13, 2017 in the office of the
County Recorder, Scott County, Minnesota, as Document No. A1029003.
2. That said plat contains errors, omissions, or defects in the following particulars, to-wit:
That the street name 141st Street NE was incorrectly identified.
3. That said plat is hereby corrected in the following particulars, to wit:
The street name 141st Street NE has been changed to Royalton Road NE.
