DISCUSSION: Tonight the City Council is scheduled to hold a closed executive session to conduct the City Manager’s performance evaluation for calendar year 2017, determine the base salary and approve an employment agreement for 2018. A resolution is attached, which the City Council is asked to complete with respect to base salary and employment agreement at the conclusion of the performance evaluation. If for some reason the council is unable to complete the performance evaluation, it may continue it’s deliberations and subsequent action to a future council meeting. History Frank Boyles was appointed as the City Manager of Prior Lake in March 1. 1993. The City Manager is an at-will employee appointed by the City Council. The terms of employment for the City Manager are set out in an employment agreement, which is approved annually by the City Council in conjunction with the performance evaluation. The specific contents of the performance evaluation are considered private under M.S.13.43 of the Minnesota Data Practices law. Current Circumstances Councilors McGuire and Thompson serve as the appointed members to the City Manager Evaluation subcommittee. This subcommittee recommends the annual evaluation process, conducts the oral review, and makes recommendations regarding salary and the employment agreement. The evaluation process consists of a written assessment on various performance dimensions by each City Council Member and each department head. A written self-assessment is submitted by the City Manager as well. A discussion about the prior year’s performance will be held during the executive session with the City Council and City Manager. 2 ISSUES: Conclusion Any changes to the employment agreement will be considered during this time. The City Council will reconvene upon the conclusion of the executive session to provide a brief overview of the evaluation, salary and employment agreement recommendation and to take formal action. The central issue for this agenda item is whether, in the opinion of the City Council, the City Manager is adequately performing his responsibilities to the Council’s satisfaction, recognizing that he is an at-will employee. ALTERNATIVES: RECOMMENDED MOTION: 1. Motion and Second to Approve the performance evaluation, base salary for 2018 and Employment Agreement with the City Manager specifying any amendments thereto and authorizing the Mayor to Execute the Amended Agreement. 2. If the process is incomplete, take no action and direct that the matter be deferred to a future meeting as may be desired by the council. As determined by the City Council. 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 18-___ A RESOLUTION SETTING THE CITY MANAGER’S BASE SALARY FOR 2018 AND APPROVING AN EMPLOYMENT AGREEMENT Motion By: Second By: WHEREAS, The City Manager and the City Council on behalf of the City of Prior Lake entered into an employment agreement commencing on March 1, 1993; and WHEREAS, The City Council conducted a performance appraisal of the City Manager for calendar year 2017; and WHEREAS, The performance appraisal was deemed satisfactory and warrants continuation of the employment agreement as amended; and WHEREAS, The City Manager’s base salary shall be adjusted effective January 1, 2018. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Manager’s annual base salary as set forth in this resolution is hereby increased by _____% for calendar year 2018 from $131,838 to $_______ as of January 1, 2018. 3. All other terms and conditions of the employment agreement dated April 2, 2018 are hereby approved and shall be in full force and effect.
