REPLACEMENT PLAN FOR THE PARKHAVEN AT PIKE LAKE PROJECT
DISCUSSION: Introduction
The purpose of this agenda item is to consider approval of a wetland replacement
plan application for the Parkhaven at Pike Lake development project.
History
On January 18, 1994, the City Council passed Resolution 94-01 adopting the
permanent rules of the Wetland Conservation Act (WCA) of 1991. Along with this,
the Council also assumed the role of local government unit (LGU) for making WCA
determinations for landowners. The purpose of WCA is as follows:
1. Achieve a no net loss in the quantity, quality, and biological diversity of
Minnesota’s existing wetlands;
2. Increase the quantity, quality, and biological diversity of Minnesota’s
wetlands by restoring or enhancing diminished or drained wetlands;
3. Avoid direct or indirect impacts from activities that destroy or diminish the
quantity, quality, and biological diversity of wetlands; and
4. Replace wetland values where avoidance of activity is not feasible or
prudent.
In accordance with the WCA rules, the City Council must approve all plans for
restoration of impacted wetlands before any wetland impact may occur. LGU
decisions under the WCA must be made in compliance with Minn. Stat. § 15.99;
generally, this means that an application for a WCA decision must be approved or
denied within 60 days or it will be deemed to be granted.
The applicant (Parkhaven Holdings, LLC) submitted a WCA application for a
replacement plan for the Parkhaven at Pike Lake development project on March 12,
2018. The proposed project includes the development of approximately 33 acres of
land into 51 residential homesites. The project will result in a total of 0.183 acre of
wetland impacts. The proposed impact will result from the construction of the
project.
The application was noticed to the WCA Technical Evaluation Panel (TEP) on
March 12, 2018. The TEP is advisory in nature and makes technical findings and
recommendations. TEP members include representatives from the City, the Board
of Water and Soil Resources (BWSR), the Scott Soil and Water Conservation
District (SWCD), and the Minnesota Department of Natural Resources (DNR).
Comments were allowed until April 20, 2018. Additional comments were accepted
through April 30, 2018 on minor revisions to the application. The TEP was
supportive of the wetland replacement plan.
Current Circumstances
Parkhaven Holdings, LLC is proposing to construct the Parkhaven at Pike Lake
development project. Construction of the project will result in 7,971 square feet
(0.183 acre) of permanent wetland impact. According to the WCA, permanent
wetland impact for this project must be addressed by replacing wetlands at a 2:1
ratio. Therefore, a total of 15,943 square feet (0.366 acre) of wetland replacement
is required for the project. The wetland application is included as Attachment 1, a
memo from the City’s wetland consultant is included as Attachment 2, and a draft
Notice of Decision (NOD) is included as Attachment 3.
Parkhaven Holdings, LLC will replace wetlands through the purchase of wetland
bank credits from an approved wetland bank within the same Bank Service Area
(Area 9), which meets the replacement plan siting requirements of the WCA. The
total amount of wetland replacement provided will be 0.37 acre.
The project meets the requirements for a replacement plan application and
proposes to replace 0.37 acre of wetland in accordance with the WCA. The
replacement plan should be approved. As a condition of approval, the applicant is
required to submit a fully executed Withdrawal of Wetland Credits form to the City
and to BWSR. If this replacement plan is approved, City staff will execute the WCA
NOD form (Attachment 3).
ISSUES: If approved, this replacement plan approval constitutes the final step in the WCA
process before wetland impacts associated with the Parkhaven at Pike Lake
development project may occur.
The applicant must also apply for and receive a permit from the US Army Corps of
Engineers. The Corps permitting process is separate from the City’s WCA
process.
FINANCIAL
IMPACT:
Approving this wetland replacement plan will have no financial impact on the City
budget.
ALTERNATIVES: 1. Motion and a second as part of the consent agenda to approve a resolution
approving the wetland replacement plan for the Parkhaven at Pike Lake
development project as proposed, or as may be amended by the City Council.
2. Motion and a second to remove this item from the consent agenda for additional
discussion.

Joint Application Form for Activities Affecting Water Resources
in Minnesota
This joint application form is the accepted means for initiating review of proposals that may affect a water resource (wetland,
tributary, lake, etc.) in the State of Minnesota under state and federal regulatory programs. Applicants for Minnesota Department
of Natural Resources (DNR) Public Waters permits MUST use the MPARS online permitting system for submitting applications to
the DNR. Applicants can use the information entered into MPARS to substitute for completing parts of this joint application form
(see the paragraph on MPARS at the end of the joint application form instructions for additional information). This form is only
applicable to the water resource aspects of proposed projects under state and federal regulatory programs; other local
applications and approvals may be required. Depending on the nature of the project and the location and type of water resources
impacted, multiple authorizations may be required as different regulatory programs have different types of jurisdiction over
different types of resources.
Regulatory Review Structure
Federal
The St. Paul District of the U.S. Army Corps of Engineers (Corps) is the federal agency that regulates discharges of dredged or fill
material into waters of the United States (wetlands, tributaries, lakes, etc.) under Section 404 of the Clean Water Act (CWA) and
regulates work in navigable waters under Section 10 of the Rivers and Harbors Act. Applications are assigned to Corps project
managers who are responsible for implementing the Corps regulatory program within a particular geographic area.
State
There are three state regulatory programs that regulate activities affecting water resources. The Wetland Conservation Act
(WCA) regulates most activities affecting wetlands. It is administered by local government units (LGUs) which can be counties,
townships, cities, watershed districts, watershed management organizations or state agencies (on state-owned land). The
Minnesota DNR Division of Ecological and Water Resources issues permits for work in specially-designated public waters via the
Public Waters Work Permit Program (DNR Public Waters Permits). The Minnesota Pollution Control Agency (MPCA) under Section
401 of the Clean Water Act certifies that discharges of dredged or fill material authorized by a federal permit or license comply
with state water quality standards. One or more of these regulatory programs may be applicable to any one project.
Required Information
Prior to submitting an application, applicants are strongly encouraged to seek input from the Corps Project Manager and LGU staff
to identify regulatory issues and required application materials for their proposed project. Project proponents can request a pre-
application consultation with the Corps and LGU to discuss their proposed project by providing the information required in
Sections 1 through 5 of this joint application form to facilitate a meaningful discussion about their project. Many LGUs provide a
venue (such as regularly scheduled technical evaluation panel meetings) for potential applicants to discuss their projects with
multiple agencies prior to submitting an application. Contact information is provided below.
The following bullets outline the information generally required for several common types of determinations/authorizations.
• For delineation approvals and/or jurisdictional determinations, submit Parts 1, 2 and 5, and Attachment A.
• For activities involving CWA/WCA exemptions, WCA no-loss determinations, and activities not requiring mitigation,
submit Parts 1 through 5, and Attachment B.
• For activities requiring compensatory mitigation/replacement plan, submit Parts 1 thru 5, and Attachments C and D.
• For local road authority activities that qualify for the state’s local road wetland replacement program, submit Parts 1
through 5, and Attachments C, D (if applicable), and E to both the Corps and the LGU.

Submission Instructions
Send the completed joint application form and all required attachments to:
U.S Army Corps of Engineers. Applications may be sent directly to the appropriate Corps Office. For a current listing of areas of
responsibilities and contact information, visit the St. Paul District’s website at:
http://www.mvp.usace.army.mil/Missions/Regulatory.aspx and select “Minnesota” from the contact Information box.
Alternatively, applications may be sent directly to the St. Paul District Headquarters and the Corps will forward them to the
appropriate field office.
Section 401 Water Quality Certification: Applicants do not need to submit the joint application form to the MPCA unless
specifically requested. The MPCA will request a copy of the completed joint application form directly from an applicant when they
determine an individual 401 water quality certification is required for a proposed project.
Wetland Conservation Act Local Government Unit: Send to the appropriate Local Government Unit. If necessary, contact your
county Soil and Water Conservation District (SWCD) office or visit the Board of Water and Soil Resources (BWSR) web site
(www.bwsr.state.mn.us) to determine the appropriate LGU.
DNR Public Waters Permitting: In 2014 the DNR will begin using the Minnesota DNR Permitting and Reporting System (MPARS) for
submission of Public Waters permit applications (https://webapps11.dnr.state.mn.us/mpars/public/authentication/login).
Applicants for Public Waters permits MUST use the MPARS online permitting system for submitting applications to the DNR. To
avoid duplication and to streamline the application process among the various resource agencies, applicants can use the
information entered into MPARS to substitute for completing parts of this joint application form. The MPARS print/save function
will provide the applicant with a copy of the Public Waters permit application which, at a minimum, will satisfy Parts one and two
of this joint application. For certain types of activities, the MPARS application may also provide all of the necessary information
required under Parts three and four of the joint application. However, it is the responsibility of the Applicant to make sure that
the joint application contains all of the required information, including identification of all aquatic resources impacted by the
project (see Part four of the joint application). After confirming that the MPARS application contains all of the required
information in Parts one and two the Applicant may attach a copy to the joint application and fill in any missing information in the
remainder of the joint application.

Describe the project that is being proposed, the project purpose and need, and schedule for implementation and completion. The
project description must fully describe the nature and scope of the proposed activity including a description of all project elements
that effect aquatic resources (wetland, lake, tributary, etc.) and must also include plans and cross section or profile drawings
showing the location, character, and dimensions of all proposed activities and aquatic resource impacts.
Project Summary
Parkhaven Holdings LLC is proposing to develop a new neighborhood community named Parkhaven at Pike Lake (“Parkhaven”).
Existing conditions for this site are shown on Figure 2a and 2b. The property consists of 32.85 acres located in the northeast
corner of County Highway 42 and County Highway 21. The project site consists of seven wetlands that total 2.14 acres within

the property. Wetlands A, D, E and G extend outside the property. A summary of the wetlands on-site is provided in the table
below.

There are two channels located within the property and they are shown on Figure 2b and 3. The channel labeled as S1 is a DNR
protected stream and the channel labeled as the “eroded channel” (EC2) is an intermittent stream. Upland within the property
consisted of agricultural fields, residential homes, and mesic hardwood forests. The agricultural field located on the north side
of the property was planted with corn in 2017. The residential homes scattered through the property consisted of maintained
lawns and some planted shade trees. Red oak, boxelder, hackberry, red maple and chokecherry dominate the mesic hardwood
forest within this site.
Proposed Project and Impact Summary
The proposed project consists of 51 residential homesites at a density of 1.55 units/acre along with associated streets, utility
and stormwater treatment features. The proposed project will require 0.183 acre of permanent fill to the fringe of Wetlands
A, C, D and G for proposed roads and temporary impacts from excavation to 0.324 acre of Wetland A, which is necessary to
maintain hydrology to the basin and will also allow enhancement of the vegetation (Figure 4a & 4b). Wetland C, D, and G
impacts are to the wet meadow portion of the basin and the impacts to Wetland A are to a floodplain forest community.
The area of proposed tree impact for the project site is 11.08 acres and is provided on Figure 10.
The proposed road crossing of S1 will result in impacts to 101 ft (2,508 SF) of creek and the proposed crossing of EC2 will
require 99 ft (97 sf) to an intermittent channel (Figure 4b).
This project has been designed as a Planned Unit Development (PUD) which has allowed clustering of lots that are smaller than
what the normal zoning would allow. As a result, the project was able to be designed with the preservation of large areas of
open space and corridors that will have several benefits including preservation of the mesic hardwood forest community
described under project summary and preservation of the hardwood forest adjacent to the creek that flows to Pike Lake that
will provide buffering for nutrients (Figure 9). Construction plan sheets for grading, erosion control and stormwater are
provided as Attachment A.

Project Purpose and Need
The project purpose is to provide a single-family, low density residential Planned Unit Development (PUD) within the City of
Prior Lake. The project will meet the City’s designated use for this land as stated in the 2030 Comprehensive Plan as R-LD
Urban Low Density Residential at 0-4 units/acre. The R-LD category in the 2030 Comprehensive Plan recommends net
densities between 2 and 4 units per acre with greater flexibility for densities and housing types in a PUD. This flexibility as a
PUD has allowed the project to have densities of 1.55 units per acre allowing more preservation of wetlands and the mesic
hardwood forest community that exist within the project site.
Wetland A Excavation/Enhancement (Temporary Impact)
Wetland A exists as a sloping wetland that under existing conditions has a north end that starts near an elevation
880 mean sea level (msl) and slopes to an elevation near 872 msl at its south end (Figure 2a). This wetland is
dependent on a combination of surface flow and groundwater to maintain wetland hydrology. It has a seasonally
flooded hydrologic regime. Dominant plant species identified within the wetland as part of the wetland delineation
include native species such as black willow (Salix nigra), boxelder (Acer negundo) and Canada goldenrod (Solidago
canadensis), as well as invasive species that include common buckthorn (Rhamnus cathartica), Japanese
honeysuckle (Lonicera japonica) and reed canary grass (Phalaris arundinacea).
In order to maintain surface flow to the wetland, the stormwater ponds on-site need to discharge to the basin. The
outlets of the ponds are at elevation 876 msl, and raising the outlets could threaten the proposed homes from
flooding. The excavation of the wetland basin is being done to ensure hydrology is maintained and allows the
ponds to flow into the wetland. The excavation of the wetland will also allow removal of the invasive vegetation
that currently dominates the basin.
The basin has been designed to maintain a similar wetland community. The proposed grading and landscape plan
are provided on Figure 4a. The wetland will be excavated so it is at 874 msl, with an outlet at 873.5 msl, and the
road will act as an embankment to maintain water at that elevation. This will ensure saturation within 12 inches of
the surface to maintain wetland hydrology. The area will be seeded with state mix 34-261 which is a wet meadow
seed mix. There are five locations within the basin where there will be microtopographic features that are slightly
higher (874.4 msl) than the remainder of the basin. These areas will be planted with tree and shrub species as
shown on Figure 4a.
Wetland Replacement
At a 2:1 replacement ratio, this proposed project will require 0.37 acre of U.S. Army Corps of Engineers Approved
replacement. There are five wetland banks within the same major watershed and bank service area that list
enough credit to meet the needs of this project; however, of the listed wetland banks, only one of them had credits
available for sale and were willing to sell credits. This bank did not have enough credit to fulfill the mitigation
requirements of the entire project. Furthermore, the available credits were upland buffer credit. As a result, we are
proposing to purchase Type 2 wetland credits from a wetland bank within the same bank service area and an
adjacent County, but outside the major watershed. The wetland bank is bank #1494. The filled-out withdrawal
form and purchase agreement are provided as Attachment B.

Avoidance and Minimization
Project Purpose, Need, and Requirements. Clearly state the purpose of your project and need for your project. Also include a
description of any specific requirements of the project as they relate to project location, project footprint, water management,
and any other applicable requirements. Attach an overhead plan sheet showing all relevant features of the project (buildings,
roads, etc.), aquatic resource features (impact areas noted) and construction details (grading plans, storm water management
plans, etc.), referencing these as necessary:
An overhead plan sheet shown the relevant features is provided as Figure 3 and proposed impacts are provided on Figure 4a and
4b. The construction plans for grading, stormwater and erosion control are provided as Attachment A.
The project purpose, need and requirements are summarized below:
• Provide a single-family home development, consistent with Comprehensive Plan zoning
to serve market demand;
• Create an efficient layout design that includes internal roadway connections, and offsite
connections (both current and future);
• Provide effective drainage for the overall site while capturing and treating runoff (both
treated and untreated) in a manner consistent with local, state, and federal standards;
• Be sensitive to environmental features (forests, creeks, ravines and wetlands);
• Avoid and minimize direct and indirect impacts on wetlands and water resources; and,
• Replace unavoidable wetland impacts with compensatory wetland mitigation that has wetland functions equal to or
exceeding those of the impacted wetlands.
Avoidance. Both the CWA and the WCA require that impacts to aquatic resources be avoided if practicable alternatives exist.
Clearly describe all on-site measures considered to avoid impacts to aquatic resources and discuss at least two project alternatives
that avoid all impacts to aquatic resources on the site. These alternatives may include alternative site plans, alternate sites, and/or
not doing the project. Alternatives should be feasible and prudent (see MN Rules 8420.0520 Subp. 2 C). Applicants are encouraged
to attach drawings and plans to support their analysis:
No-Build/No Action Alternative
The WCA No-Build Alternative was considered as a way to eliminate all wetland impacts associated with the project. Although the
no-build alternative would directly avoid all wetland impacts, it would not meet the project purpose and need or goals, and would
be inconsistent with the City of Prior Lake 2030 Comprehensive Plan, which guides the project area for single-family low density
residential development. Proposed development of this site will require the proposed road connections that are impacting the
wetlands. Because the No-Build Alternative will not meet the guided use for the site, and any alternative that meets the roads
need for this site would require the similar wetland impact, the No-Build approach is not feasible for this site.
See other Alternatives considered below under Minimization.
Minimization. Both the CWA and the WCA require that all unavoidable impacts to aquatic resources be minimized to the greatest
extent practicable. Discuss all features of the proposed project that have been modified to minimize the impacts to water
resources (see MN Rules 8420.0520 Subp. 4):
Grading plans were not prepared for all alternatives considered, so for purposes of comparison of water resource impacts the road
right of way (ROW) and lot locations were used. Actual impacts would be larger with proposed grading. The following table
provides information for comparison between alternatives.

can occur due to encroachment from
property owners. The proposed
layout concentrates housing in select
locations so 20.03 acres of open
space that includes a mesic
hardwood forest and grasslands can
be protected. A wide corridor of
woodland is protected around the
streams and ravines to provide
wildlife habitat movement and water
quality protection to the streams.
The proposed road crossing of stream labeled S1 on Figure 2b will result in impacts to 101 ft (2,508 SF) of creek. To minimize
impact to the creek the road alignment is proposed at an existing farm road crossing. To minimize impacts to wetlands retaining
walls were initially proposed along Wetlands G and F; however, the city requested removal of the retaining walls from the design
and grading slopes instead, this change has increased wetland impacts.
Off-Site Alternatives. An off-site alternatives analysis is not required for all permit applications. If you know that your proposal
will require an individual permit (standard permit or letter of permission) from the U.S. Army Corps of Engineers, you may be
required to provide an off-site alternatives analysis. The alternatives analysis is not required for a complete application but must

be provided during the review process in order for the Corps to complete the evaluation of your application and reach a final

2. Seller represents and warrants as follows:
a) The Credits are deposited in an account in the Minnesota Wetland Bank administered by the Minnesota
Board of Water and Soil Resources (BWSR) pursuant to Minn. Rules Chapter 8420.0700-.0760.
b) Seller owns the Credits and has the right to sell the Credits to Buyer.
3.Buyer will pay Seller a total of $_22,200.00_ for the Credits, as follows:
a) $_1,620.00__ as earnest money, to be paid when this Agreement is signed; and
b)The balance of $_20,580.00____ to be paid on the Closing Date listed below.

4. Buyer agrees to pay the State of Minnesota:
a)a Withdrawal Fee of $_972.36_ based on the (BSA-based rate) * (acres) = ($2,628.00) * (0.37); and
b)an Easement Stewardship Fee of $_111.74_ based on the (Stewardship rate) * (acres) = ($302) * (0.37).
At the Closing Date, Buyer will execute a check made out for the sum of these amounts ($1,084.10), payable to
the Minnesota Board of Water and Soil Resources (BWSR).
5. The closing of the purchase and sale shall occur on or before _June 31
st ___, 2018__ (Closing Date) at
__Location TBD_. The Closing Date and location may be changed by written consent of both parties. Upon payment of
the balance of the purchase price, Seller will sign a fully executed Application for Withdrawal of the Credits on the form
specified by the BWSR, provide a copy of the Application for Withdrawal to the Buyer and forward the same to the
BWSR along with the check for the withdrawal fee.
6. Buyer has applied or will apply to __ City of Prior Lake _ (Local Government Unit (LGU) or other
regulatory authority) for approval of a replacement plan utilizing the Credits as the means of replacing impacted
wetlands. If the LGU has not approved the Buyer’s application for a replacement plan utilizing the Credits by the
Closing Date, and no postponement of the Closing Date has been agreed to by Buyer and Seller in writing, then either
Buyer or Seller may cancel this Agreement by giving written notice to the other. In this case, Seller shall return Buyer’s
earnest money, and neither Buyer nor Seller shall have any further obligations under this Agreement. If the LGU has
approved the replacement plan and the Seller is ready to proceed with the sale on the Closing Date, but Buyer fails to
proceed, then the Seller may retain the earnest money as liquidated damages.

Parkhaven Holdings, LLC is proposing to develop approximately 33-acres of land near Pike Lake into 51
residential homesites. As a result of the proposed development, approximately 0.183 acre of wetlands will
be filled. As replacement, the applicant is proposing to purchase wetland credits at a ratio of 2:1 from
wetland bank No. 1494, located in Blue Earth County (Bank Service Area 9). The total amount of
replacement provided will be 0.37 acre.
The application was noticed to the Wetland Conservation Act Technical Evaluation Panel (TEP) on March
12, 2018. Comments were allowed until April 20, 2018. Additional comments were accepted through April
30, 2018 on minor revisions to the application. Overall, the TEP was supportive of the wetland
replacement plan.
On behalf of the City of Prior Lake, Local Government Unit for the Wetland Conservation Act, I
recommend that the City Council approves the wetland replacement plan for the Parkhaven at Pike Lake
Development Project. As a condition of approval, the applicant will be required to submit a fully-executed
Withdrawal of Wetland Credits form to the LGU and BWSR. A Notice of Decision is attached for review.

Parkhaven Holdings is proposing to construct 51 residential home sites on approximately 33 acres near
Pike Lake in Prior Lake. Seven wetlands were delineated within the project area in fall 2017. Two
channels, one a DNR watercourse, are located within the property as well. The proposed development
will permanently impact 0.183 acre and temporarily impact 0.324 acre of wetland. Permanent impacts
result from construction of roadways. The 0.183 acre of impact is 0.048 acre more than described in the
Notice of Application. This change is due to removal of retaining walls that were proposed adjacent to
the roadway that bisects Wetlands F and G. The removal of the proposed retaining wall was done at the
request of the City of Prior Lake. Additional time was allowed for the TEP to comment on these
changes.
Temporary impacts result from excavation within a Type 1 wetland to maintain hydrology and allow
for vegetation enhancement. Approximately 101 l.f. of a creek (DNR watercourse) and 99 l.f. of an

For Replacement Plans using credits from the State Wetland Bank:
Replacement Plan Approval Conditions. In addition to any conditions specified by the LGU, the
approval of a Wetland Replacement Plan is conditional upon the following:
Financial Assurance: For project-specific replacement that is not in-advance, a financial assurance
specified by the LGU must be submitted to the LGU in accordance with MN Rule 8420.0522, Subp. 9
(List amount and type in LGU Findings).
Deed Recording: For project-specific replacement, evidence must be provided to the LGU that the
BWSR “Declaration of Restrictions and Covenants” and “Consent to Replacement Wetland” forms
have been filed with the county recorder’s office in which the replacement wetland is located.
Credit Withdrawal: For replacement consisting of wetland bank credits, confirmation that BWSR
has withdrawn the credits from the state wetland bank as specified in the approved replacement plan.
Wetlands may not be impacted until all applicable conditions have been met!
