Call to Order and Pledge of Allegiance: Commissioner Fleming called the Monday, June 11, 2018 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Bryan Fleming, Dave Tieman, William Kallberg, Dan Ringstad, Jason Tschetter, and Liaison Zach Braid. Also present were Planner Amanda Schwabe, Planner Jeff Matzke, Project Engineer Nick Monserud and Community Development Services Assistant Sandra Woods. 2. Approval of Agenda: MOTION BY TSCHETTER, SECONDED BY TIEMAN TO APPROVE THE MONDAY, JUNE 11, 2018 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried. 3. Approval of Tuesday, May 29, 2018 Meeting Minutes: MOTION BY RINGSTAD, SECONDED BY TSCHETTER TO APPROVE THE UPDATED TUESDAY, MAY 29, 2018 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES TO REFLECT COMMISSION RINGSTAD IN THE VOTE LINE AFTER MOTIONS. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried. 4. Public Hearings: A. PDEV18-000020 – 3356 Todd Road SW – Variance – Property owners Craig Gillen and Denise Barnhardt-Gillen are requesting variances to the lake setback, front yard setback, and lot area in the R-1SD, Low Density Residential Shoreland Zoning District, to construct a new home. The proposal is to remove the existing non-conforming structure and construct a new residence. The Subject property is located on the south side of Upper Prior Lake; west of Sycamore Trail SW, on the north side of Todd Road SW. PID: 259030120. Planner Schwabe: Introduced the request to consider the approval of a resolution approving variances from the minimum lot area, minimum lake setback and minimum front yard setback for a replacement of a single-family structure on a property located at 3356 Todd Road SW. The property is located along the southeastern shores of Upper Prior Lake, north of CSAH 12, and east of Dewitte Avenue SW. The property contains a single-family home (two-story with basement walkout) structure. She explained the history, current circumstances, issues, and recommended a motion. She presented a resolution, location map, survey of existing and proposed structures dated May 8, 2018 and proposed elevations and floor plans. Commission Comments/Questions: Fleming: Asked, if the proposed deck was not there what would the distance be to the Ordinary High Water (OHW) and what is the proposed finished square footage of the two-story home. Planner Schwabe: Explained the next closest point to the OHW would be at about 65 feet if the deck was removed. She said the approximate home footprint would be at 1400 square feet with an attached garage around the 1000 square feet. She mentioned each level of the homes square footage and said there is a possibility that part of the basement might be used for s torage and remain unfinished. She said Darren from College City Homes is here tonight and may be able to explain the square footage better. 2 Tschetter: Asked about the side yard setback and mentioned the adjacent home is gone. He asked if there are any other variances that are related to this proposed construction. Planner Schwabe: Replied all the variances that are associated for construction of the proposed residence are being proposed this evening. Tschetter: Asked if the side yard setback for this property is compliant with our standards and the only variances are the ones proposed tonight; front setback, lake setback, and the lot size. Planner Schwabe: Replied that is correct. Applicant Craig Gillen: Resides at 3356 Todd Road SW. He introduced his wife Denise and said Planner Schwabe did a great job at presenting them tonight. He said they have been working with the city for about 6-8 years. He commented on using creativity on angles to get the best plan. MOTION BY TIEMAN, SECONDED BY TSCHETTER TO OPEN THE PUBLIC HEARING ON AT 6:23 P.M. ON ITEM 4A. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried. Public Comment: Erik Plaisted: Resides at 3374 Sycamore Trail SW. He mentioned his location in comparison to the proposed property and said he is curious on the east side of how much the house will be moved over as he believes it will move over 15 feet. He commented on how far his house is setback and stated he is concerned about his view when the house is built. Fleming: Asked for an aerial photo regarding this location. Planner Schwabe: Showed the overview photo. Plaisted: Pointed out his house and said if the house is moved to the right 15 feet; it would take a chunk out of his view. He questioned if any studies have been done on the rock wall and the backfilling of it; stating concerns of the lake cove area collecting dead fish and weeds, the depth of the lake and the benefit of increased frontage of setback. He asked if this was done about 15 years ago. Un-named Neighbor from Audience: Commented on the length of time this wall was built and the backfill added. Project Engineer Monserud: Commented on the retaining wall being reviewed with the building permit application as then they would have an in-depth grading plan. He said he doesn’t know much about the history timeline. Plaisted: Asked about the obstruction of his view. Project Engineer Monserud: Replied there may be an obstruction of view; however, they applicant also has every opportunity to build their house on their private property as well. Denise Barnhardt-Gillen: Said she has no knowledge of the backfill; however, it still follows the water requirements for the setback. She commented on the house moving over only 6 feet not 15 feet. MOTION BY TSCHETTER, SECONDED BY TIEMAN TO CLOSE THE PUBLIC HEARING AT 6:28 P.M. ON ITEM 4A. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried. Commissioners Comments: Kallberg: Commented old platting that occurred before current ordinances, requiring certain setbacks, lot sizes, curvature of the shoreline, neighbors view, applicant complying with ordinances, and this being an improvement to the neighborhood. He stated he supports this agenda item. Tieman: Said it is an appropriate use of the property and there was great effort to fit the proposed home into the lot. He will be supporting this variance. Fleming: Stated he will be supporting the request for the variances and commented on removal of the deck not changing setback enough. He said he empathizes with neighbor on potential obstruction; however, is not swayed or compelled enough as it appears there is still ample viewing opportunities and 3 according to the Ordinance 1108.400, this proposal does meet all five-point threshold criteria. He said he will support this request. Ringstad: Highlighted number four of the five criteria’s for approving a variance, regarding not altering the essential character of the neighborhood and commented on where the variances/setbacks areas are located; boundary line, side of home, lake and Todd Street. He said he emphasizes with the neighbor; however, due to a squeezed footprint by Todd Street and the sanitary sewer easement, he said he will be supporting this agenda item. Tschetter: Said he is sympathetic to all concerns raised tonight as well as concerned about the constraints on Todd Street in general. He commented on the property owner’s rights and said we have done the best we can with a challenging lot, if we were to further constrain this lot it would potentially be inconsistent with the rest of the neighboring properties. He said he is supporting the variance. MOTION BY TSCHETTER, SECONDED BY KALLBERG TO APPROVE A RESOLUTION APPROVING THE VARIANCES REQUESTED FOR 3356 TODD ROAD SW WITH THE LISTED CONDITIONS. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried. 5. Old Business: 6.
