PRIOR LAKE PLANNING COMMISSION MINUTES
Monday, June 25, 2018
1. Call to Order and Pledge of Allegiance:
Commissioner Fleming called the Monday, June 25, 2018 Prior Lake Planning Commission meeting to
order at 6:00 p.m. Those present were Commissioners Bryan Fleming, Dave Tieman, William Kallberg,
Dan Ringstad, Jason Tschetter, and Liaison Zach Braid. Also present were Planner Jeff Matzke, Project
Engineer Nick Monserud and Community Development Services Assistant Sandra Woods.
2. Approval of Agenda:
MOTION BY TSCHETTER, SECONDED BY KALLBERG TO APPROVE THE MONDAY, JUNE 25, 2018
PRIOR LAKE PLANNING COMMISSION AGENDA.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
3. Approval of Monday, June 11, 2018 Meeting Minutes:
MOTION BY KALLBERG, SECONDED BY RINGSTAD TO APPROVE THE UPDATED MONDAY, JUNE
11, 2018 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES TO REFLECT COMMISSION
RINGSTAD IN THE VOTE LINE AFTER MOTIONS.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
4. Public Hearings:
A. PDEV18-000023 – 5282 Candy Cove Trail SE - Variance – Fieldstone Family Homes, Inc. is
requesting a variance regarding the structure setback from the OHW of Prior Lake and a variance
to allow a structure within the bluff impact zone on a property in the R-1 (Low Density Residential)
Zoning District. The project is proposing a house to be constructed in the bluff impact zone at
5282 Candy Cove Trail SE located on the eastern shores of Lower Prior Lake; west of Trunk
Highway 13. PID: 259360671.
Planner Matzke: Introduced the request to consider the approval of a resolution approving a variance
from the structure setback from the OHW of Prior Lake and a variance to allow a structure within the bluff
impact zone on a property in the R-1 (Low Density Residential) Zoning District to allow a house to be
constructed in the bluff impact zone at a property located along the eastern shores of Lower Prior Lake,
west of truck Highway 13. He explained the history, current circumstances, issues, and recommended
a motion. He presented a resolution, location map, existing and proposed surveys dated May 24, 2018
and a proposed conceptual building plans.
Commission Comments/Questions:
Ringstad: Questioned who approves the process for the four-foot retaining walls in the bluff zone.
Planner Matzke: Explained how the evaluation of the process is done. He stated it is part of the building
department permit.
Fleming: Questioned the process that is used to ensure the stability of the retaining walls as they are
being constructed.
Project Engineer Monserud: Explained how each wall would be designed and commented on the soil
information and the anticipated loads the walls would take. He commented on the process of submission
of information to staff and then to the Geotechnical Engineer/City Consultant to provi de comments. He
said this is standard protocol for any bluff area.
Fleming: Asked where the walls are now proposed, do we have a sense whether the soil has experienced
any sort of a-typical settling or erosion at this point or in the last year or so.

Project Engineer Monserud: Replied, not that we could tell from the two borings that were provided.
He said with the building permit process, it will be reviewed again in more depth and with our consultant.
Tieman: Asked if the existing entrance/walkway goes through the adjoining property.
Planner Matzke: Explained the area of the walkway, how it is maintained and where the driveway is
located. He said they have ingress and egress easements for that ability to get to and from that driveway.
Kallberg: Asked when the property was first platted.
Planner Matzke: Responded that it is part of Government Lot property and is not platted. He said it is
part of the Candy Cove Addition and specified the original platting, stating the homes were probably
updated in the 50’s and 60’s with four season homes.
Applicant
Trent Johnson: Resides at 3877 Hyland View Circle NW. He stated he is the Co-Owner of Fieldstone
Family Homes. He thanked Planner Matzke and staff for preparing them for tonight’s meeting. He
commented on the work being done upfront, reports showing stability for the home, forwarding the full
analysis to Planner Matzke this afternoon and said he feels they came up with a plan that fits the site and
the lake community.
MOTION BY TIEMAN, SECONDED BY TSCHETTER TO OPEN THE PUBLIC HEARING ON AT 6:21
P.M. ON ITEM 4A.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
Public Comment:
Ron Lenling: Resides at 5298 Candy Cove Trail SE. He commented on the plans being reasonable and
a great fit for his neighbors. He pointed out where he lived in comparison to the proposed lot and
commented on the homes being replaced with larger, higher end homes in the last five years. He asked
questions regarding concerns of changes or adjustments of the shared driveway during or following the
construction, significant bluff lots, drainage, erosion and utility impacts occurring based on construction
activities.
Fleming: Asked Staff to reply to the questions and how the process will unfold.
Planner Matzke: Commented on discussion with applicant, construction activity, existing house and
garage demolition, shared driveway, grading impacts, changes to driveway, drainage, and utilities.
Project Engineer Monserud: Commented on the plans and refining the plan. He explained the drainage
plans and the drainage arrows on the map. He commented on the utilities and stated from past
conversations, he understands they are just utilizing the existing stubs.
MOTION BY TSCHETTER, SECONDED BY RINGSTAD TO CLOSE THE PUBLIC HEARING AT 6:28
P.M. ON ITEM 4A.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
Commissioners Comments:
Tschetter: Thanked Planner Matzke for the thorough report. He commented on the challenge of building
on this terrain, consistent with the adjacent homes in the neighborhood, impacts to the shared driveway
being carried by construction process or agreement with the neighbors and stated we are in good shape
to move forward.
Ringstad: Stated he agrees with Commission Tschetter comments and stated the plan appears cleaner
with one structure on this lot instead of two and with the variance criteria being met, he will be supporting
this agenda item.
Fleming: Stated he will be supporting the proposal. He mentioned he is impressed with the impervious
surface and agrees that there has been a lot of thoughtfulness going into this plan.
Tieman: Stated he also support these plans as they seem logical for the site and said there was a lot of
planning put into this agenda item.

Kallberg: Stated concerns of disturbance of the slope to create all the walls will be significant. He said
obviously there is going to be extensive erosion control requirements so that nothing is washed into the
lake; however, it is a good use of the property, considering the age of the platting and the natural terrain
of the lake. He stated he is surprised at how many homes are built with these steep slopes. He said he
will support this agenda item.
MOTION BY TSCHETTER, SECONDED BY TIEMAN TO APPROVE A RESOLUTION APPROVING
THE VARIANCE FROM THE MINIMUM STRUCTURE SETBACK FROM THE OHW OF PRIOR LAKE
AND A VARIANCE TO ALLOW A STRUCTURE WITHIN THE BLUFF IMPACT ZONE ON A PROPERTY
IN THE R-1 (LOW DENSITY RESIDENTIAL) ZONING DISTRICT WITH THE THREE LISTED
CONDITIONS.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
