History On January 18, 1994, the City Council passed Resolution 94-01 adopting the permanent rules of the Wetland Conservation Act (WCA) of 1991. Along with this, the Council also assumed the role of local government unit (LGU) for making WCA determinations for landowners. The purpose of WCA is as follows: 1. Achieve a no net loss in the quantity, quality, and biological diversity of Minnesota’s existing wetlands; 2. Increase the quantity, quality, and biological diversity of Minnesota’s wetlands by restoring or enhancing diminished or drained wetlands; 3. Avoid direct or indirect impacts from activities that destroy or diminish the quantity, quality, and biological diversity of wetlands; and 4. Replace wetland values where avoidance of activity is not feasible or prudent. In accordance with the WCA rules, the City Council must approve all plans for restoration of impacted wetlands before any wetland impact may occur. LGU decisions under the WCA must be made in compliance with Minn. Stat. § 15.99; generally, this means that an application for a WCA decision must be approved or denied within 60 days or it will be deemed to be granted. The applicant (Hunter Homes, LLC) submitted a complete WCA application for a replacement plan for the Majestic development project. The proposed project includes the development of approximately 7 acres of land into 20 residential lots. The project will result in a total of 8,380 square feet (0.19 acre) of wetland impacts. The proposed impacts will result from the construction of the project. The application was noticed to the WCA Technical Evaluation Panel (TEP) on June 8, 2018. The TEP is advisory in nature and makes technical findings and recommendations. TEP members include representatives from the City, the Board of Water and Soil Resources (BWSR), the Scott Soil and Water Conservation District (SWCD), and the Minnesota Department of Natural Resources (DNR). The TEP met on June 18, 2018 to review the application. Comments were allowed until June 29, 2018. The TEP was supportive of the wetland replacement plan. Current Circumstances Hunter Homes, LLC is proposing to construct the Majestic development project. Construction of the project will result in 8,380 square feet (0.19 acre) of permanent wetland impact. According to the WCA, permanent wetland impact for this project must be addressed by replacing wetlands at a 2:1 ratio. Therefore, a total of 16,760 square feet (0.38 acre) of wetland replacement is required for the project. The wetland application is included as Attachment 1, a memo from the City’s wetland consultant is included as Attachment 2, and a draft Notice of Decision (NOD) is included as Attachment 3. Hunter Homes, LLC will replace wetlands through the purchase of wetland bank credits from an approved wetland bank within the same Bank Service Area (Area 9), which meets the replacement plan siting requirements of the WCA. The total amount of wetland replacement provided will be at least 16,760 square feet (0.38 acre). The project meets the requirements for a replacement plan application and proposes to replace 16,760 square feet (0.38 acre) of wetland in accordance with the WCA. The replacement plan should be approved. As a condition of approval, the applicant is required to submit a fully executed Withdrawal of Wetland Credits form to the City and to BWSR. If this replacement plan is approved, City staff will execute the WCA NOD form (Attachment 3). ISSUES: If approved, this replacement plan approval constitutes the final step in the WCA process before wetland impacts associated with the Majestic development project may occur. The applicant must also comply with the US Army Corps of Engineers wetland impact approval process. The Corps wetland permitting process is separate from the City’s WCA process. FINANCIAL IMPACT: Approving this wetland replacement plan will have no financial impact on the City budget. ALTERNATIVES: 1. Motion and a second as part of the consent agenda to approve a resolution approving the wetland replacement plan for the Majestic development project as proposed, or as may be amended by the City Council. 2. Motion and a second to remove this item from the consent agenda for additional discussion. Project Purpose, Need, and Requirements. Clearly state the purpose of your project and need for your project.  Also include a  description of any specific requirements of the project as they relate to project location, project footprint, water management,  and any other applicable requirements. Attach an overhead plan sheet showing all relevant features of the project (buildings,  roads, etc.), aquatic resource features (impact areas noted) and construction details (grading plans, storm water management  plans, etc.), referencing these as necessary:  Hunter Homes  is proposing  a new residential housing development in  the  City of  Prior  Lake.  This  proposed  development will be a 20‐lot, residential subdivision that is located north of County State Aid Highway 82 (154th  Street) and west of County State Aid Highway 21 (Eagle Creek Avenue). The 7 acre site encompasses land with  wooded and open areas, an existing home with outbuildings and two wetlands. The property is presently zoned R‐1  and is designated for Urban Low Density (0‐4 U/AC) Residential uses on the 2040 Comprehensive Plan Land Use Map  (updated in 2016). The proposed zoning for the property is for a Planned Unit Development (P.U.D.)  Access for the site is planned via a main access point from the northwest part of the proposed Majestic development  where it will connect to Majestic Lane. The proposed project will consist of the construction of a residential  development. The project‘s construction will consist of site grading for infrastructure including:  roads, utilities and  building pads. Construction is expected to begin in 2018 and will continue until fully built. A preliminary plat for the  site is included in Appendix A.  The need for this project is based on the expanding residential housing market in this part of Prior Lake as well as  availability to public infrastructure.  Expected housing market growth in this part of Prior Lake will be met with new  residential development including the proposed Majestic residential development.  The City of Prior Lake is planning  for expanded growth in this part of the City which is detailed in the City’s 2030 Comprehensive Plan.  Existing Wetland Resources On‐Site  Wetlands located within the proposed Majestic development were delineated and documented in a report  submitted by Arrowhead Environmental Consulting on February 13th, 2014 (Appendix C). The wetland delineation  report was reviewed by the LGU (City of Prior Lake) and approved by the Technical Evaluation Panel in the attached  Notice of Decision dated April 10th, 2014 (Appendix D). Two wetlands were delineated within  t he  E agle Creek  A venue   Site (Majestic) property and are designated as Wetland 1 and Wetland 2 (see Figure 5 of the wetland delineation  report in Appendix C). The existing area of the part of Wetland 1 located on‐site is 0.95 acre. The area for Wetland  2 was not available.  The following is a brief description of Wetland 1.  Wetland 1  Wetland 1 is located in the central to north central part of the property and would be classified as a palustrine  emergent wetland with a temporarily flooded hydrologic regime (PEMA; Circular 39 Type 1; Seasonally Flooded  Basin). This wetland extends offsite to the north as the same type of wetland. The total area of this wetland is 1.0  acres (43, 595 sq. ft.) in size. Wetland 1 is dominated primarily by reed canary grass (Phalaris arundinacea) with  some stinging nettle (Urtica dioica) and common milkweed (Asclepias syriaca) also present. A culvert is positioned  at the northern end of the wetland where it receives water from a c onstructed  pond  within  t he  development  l ocated   north of the site. Another culvert is positioned at the southern end of this wetland where water drains south out of  the wetland to Wetland 2 by way of a narrow waterbody channel that was not delineated as wetland.  Impacts to existing wetland resources  A portion of Wetland 1 (8,380 sq. ft.) will be impacted for the construction of the main road that will service the  Majestic development. This road allows the reasonable use of the eastern part of the property for the development  of residential housing.  Avoidance. Both the CWA and the WCA require that impacts to aquatic resources be avoided if practicable alternatives exist.   Clearly describe all on‐site measures considered to avoid impacts to aquatic resources and discuss at least two project alternatives  that avoid all impacts to aquatic resources on the site. These alternatives may include alternative site plans, alternate sites, and/or  not doing the project. Alternatives should be feasible and prudent (see MN Rules 8420.0520 Subp. 2 C). Applicants are encouraged  to attach drawings and plans to support their analysis:  No Action Alternative: The no action alternative would result in a failure to meet the purpose and need of the  proposed project. The applicant considers this alternative infeasible since the proposed land use in this part of Prior  Lake is being planned for residential growth and would not be reasonable for the investment‐backed expectations  of the applicant or meeting the growing demand for residential housing in Prior Lake.  Therefore, the no action  alternative is not a viable consideration.  Total Wetland Avoidance Build Alternative #1:  Due to the locations of Wetlands 1 and 2 within the proposed  Majestic development, site topography, and County Highway Department entrance distance requirements, a total  wetland avoidance alternative was not possible.   To avoid impacts to Wetland 1 an alternative site design was considered that would separate the development into  two areas, each terminating with a cul‐de‐sac, with the western part of the site being serviced by Majestic Lane and  the eastern part of the site being serviced by either C.S.A.H 21 (Eagle Creek Avenue) or C.S.A.H 82 (154th Street). This  alternative is not possible due to the Scott County Highway Department’s requirement of not allowing an entrance  to a development within an existing turning lane or within ¼ mile from the intersection of Eagle Creek Avenue and  154th Street. As part of the improvements to the site, the removal of the existing driveway that currently connects  to the turning lane along Eagle Creek Ave will be required by the County.  Nearly all of the eastern boundary of the site is adjacent to the southbound turning lane along Eagle Creek Avenue  of which an entrance will not be allowed to be constructed due to county highway department requirements. For  safety reasons, an entrance to the eastern half of the proposed Majestic development from either C.S.A.H 21 (Eagle  Creek Ave.) or C.S.A.H 82 (154th Street) will not be allowed by the county highway department due to minimum  distances required from this intersection. Two entrances from other developments already are constructed at  roughly the minimum distance which leaves no room to construct an entrance from either of these two roads to the  eastern part of the proposed Majestic development.   At the northeastern part of the site’s boundary there possibly would be room for an entrance road to be constructed  but would end up being too close to the existing entrance road (Jeffers Paw NW) to the development to the north.  An entrance road from this part of the development would likely also impact part of the north eastern portion of  Wetland 1.  Along much of the southern boundary of the site is Wetland 2 which would be impacted if an entrance road was  allowed to connect to 154th Street. The only area where an entrance road could be constructed without impacting  Wetland 2 would be situated within 50’ of the intersection of Eagle Creek Ave. and 154th Street. This option of  avoidance is not feasible due to county highway department’s requirement of not being able to access off of 154th  Street.  Total Wetland Avoidance Build Alternative #2:     A second total wetland avoidance alternative looked at not developing the eastern half of the site and terminating  the cul‐de‐sac just west of Wetlands 1 and 2 (see Appendix B for wetland avoidance figure). This option limits the  reasonable usability and accessibility of the site by reducing the number of buildable lots from 20 units down to 9  units, a reduction of 55%. This alternative is not a feasible option since the expectation of the City and the developer  is to improve the property and provide additional housing in this part of the City. Without impacting Wetland 1 to  service the eastern part of the site, government restrictions will have eliminated the usability and accessibility of the  whole site. Under this wetland avoidance build alternative, roughly 50% of the usable area of the site cannot be  developed without impacting part of Wetland 1 due to road access issues. If this alternative build option was  implemented, once improvements to the site takes place, the easterly 50% of the site cannot be developed due to  no access to this part of the property from either Eagle Creek Avenue or 154th Street.  Minimization. Both the CWA and the WCA require that all unavoidable impacts to aquatic resources be minimized  to the greatest extent practicable.  Discuss all features of the proposed project that have been modified to minimize  the impacts to water resources (see MN Rules 8420.0520 Subp. 4):  The Applicant has considered minimizing wetland impacts to the degree possible, given the constraints posed by the  County requirements for entrance distances  from county highway intersections, minimizing  impacts  to other  wetland areas, and existing site conditions. Several project plans have been considered in an effort to minimize  impacts to Wetland 1 but all did not significantly reduce the permanent impacts to Wetland 1 because of the need  to keep the single street that services this proposed development in its current location.   The current project plan includes the installation of two retaining walls on either side of Wetland 1 that catches  grade before impacting even more area to Wetland 1. Without the installation of these two retaining walls more  square feet of wetland impact would have taken place.  By placing the road in its current proposed location only one wetland will be impacted. Another effort to minimize  the impact to Wetland 1 was to shift the road to the south and not impact as much of Wetland 1 as what is being  proposed. By shifting the road to the south, permanent impacts to wetland 2 would then take place in order for  infrastructure to be built and for site grading for ponding and house pads. This option of minimization would also  reduce the area/volume of ponding that is required for the site.  Off‐Site Alternatives.  An off‐site alternatives analysis is not required for all permit applications.  If you know that your proposal  will require an individual permit (standard permit or letter of permission) from the U.S. Army Corps of Engineers, you may be  required to provide an off‐site alternatives analysis.  The alternatives analysis is not required for a complete application but must  be provided during the review process in order for the Corps to complete the evaluation of your application and reach a final  decision.  Applicants with questions about when an off‐site alternatives analysis is required should contact their Corps Project  Manager.    Additional Information  BMP’s.  Wetland areas not being impacted on‐site will be protected by erosion control fence during the construction phase of the  development. All disturbed areas will be seeded and mulched. Slopes over 3:1 will be seeded and blanketed.    Other Permits or Approvals Required: MPCA‐ General Stormwater Permit  MPCA Sanitary Sewer Extension Permit  City of Prior Lake‐ Preliminary and Final Plat Approval  City of Prior Lake Grading Permit  Scott County Public Works‐ Entrance Permit    Proposed Wetland Mitigation  Wetland mitigation being proposed for impacting wetland 1 will involve the purchase of 16,760 sq. ft. of in‐kind  wetland banking credits from a wetland bank that is located within the same Bank Service Area (9) as the Majestic  development. This action should satisfy the wetland mitigation requirements for impacting the one wetland area  within the Majestic development.              Project Name and/or Number:  Majestic  Attachment D  Replacement/Compensatory Mitigation  Complete this part if your application involves wetland replacement/compensatory mitigation not associated with the local road  wetland replacement program. Applicants should consult Corps mitigation guidelines and WCA rules for requirements.  Replacement/Compensatory Mitigation via Wetland Banking. Complete this section if you are proposing to use credits from an  existing wetland bank (with an account number in the State wetland banking system) for all or part of your  replacement/compensatory mitigation requirements.  Wetland Bank Applicants should attach documentation indicating that they have contacted the wetland bank account owner and reached at least  a tentative agreement to utilize the identified credits for the project. This documentation could be a signed purchase agreement,  signed application for withdrawal of credits or some other correspondence indicating an agreement between the applicant and the  bank owner.  However, applicants are advised not to enter into a binding agreement to purchase credits until the mitigation plan is  approved by the Corps and LGU.  Currently no wetland banking credits are available within the same minor watershed (Minnesota River 33122) as  Majestic. Ten wetland banks are located in the same major watershed (Lower Minnesota River, 33). Of the ten banks  located within the same major watershed as Majestic that were contacted, none have the needed credits available  for sale due to the following: 1) they are holding onto their credits for themselves, 2) were not interested in selling  the amount we needed for mitigation, 3) do not have enough credit available to purchase, 4) do not have in‐kind  credit as the wetland impact or 5) do not have CORP‐approved credits. One b ank was then contacted i n  Bank S ervice  Area 9 since siting requirements state that we need to look at the BSA in which the site of impact is located if credits  are not available within either the minor or major watersheds. This bank in BSA 9 is the only bank with CORP‐ approved, Type 1 credit available for sale in the amount Hunter Homes needs to purchase to satisfy mitigation  requirements.  We are proposing to purchase the needed wetland banking credit from bank #1605 if the TEP and ACOE approves  this application. If the ACOE requires in‐kind replacement, a credit purchase would need to take place from this bank  only since it is the only one with CORP‐approved, Type 1 wetland credit available in BSA 9.  Initial contact has been made with the wetland bank manager (Jason Kirwin) of wetland bank account #1605. Email  correspondence with Jason Kirwin took place in May 2018 to discuss credit availability for the purchase of needed  wetland banking credit for the proposed project. Based on the amount of wetland banking credit required for the  mitigation associated with this project, wetland bank #1605 will be able to provide the total amount of wetland  banking credit needed. This wetland bank has CORP‐approved, Type 1 credit available for sale. Since the impacts at  Majestic involve Type 1 wetland, we are proposing to purchase Type 1 credits to satisfy the mitigation requirements.   Since preliminary and final plat approval for this development have not been approved by the City of Prior Lake, a  purchase agreement will be drafted with a closing to take place following final plat approval. A submittal of the  preliminary plat for Majestic has been submitted to the City of Prior Lake with final plat approval forthcoming. Upon  final plat approval by the City of Prior Lake a purchase agreement with the #1605 wetland bank manager will be  executed in order to secure the needed wetland banking credits for this project. The project area is approximately 7.1 acres in size. On October 9th, 2013, Arrowhead Environmental Consulting (AEC) delineated wetlands using a level two routine determination method. Two wetlands were delineated as part of this project. These wetlands are summarized below: Wetland 1: Type 1 (Seasonally Flooded Basin/PEM1A) Wetland 2: Type 1 (Seasonally Flooded Basin/PEM1A) In general, the boundaries of these wetlands were placed along the vegetation transition zone and where the soil was saturated to the surface and/or changed from hydric to non-hydric soils. On behalf of the LGU, WSB & Associates field reviewed the boundary along with members of the TEP on October 28, 2013 and concurred with the boundaries as delineated. No comments were received during the comment period. This decision is valid for a period of 5 years. The proposed project will include site grading for residential development infrastructure, including roads, utilities, and building pads. Construction is scheduled to begin in 2018 and continue until the development is fully built. The project proposes to impact 8,380 square feet of one wetland to provide access from the west side of the development to the east side. As replacement, the applicant is proposing to purchase wetland credits at a ratio of 2:1 from wetland bank No. 1605, located in Stevens County, Watershed 25, Bank Service Area 9. The total amount of replacement provided will be 16,760 square feet. The application was noticed to the Wetland Conservation Act Technical Evaluation Panel (TEP) on June 8, 2018. Comments were allowed until June 29, 2018. A TEP meeting was held to review the application on June 18, 2018. Overall, the TEP was supportive of the wetland replacement plan. On behalf of the City of Prior Lake, Local Government Unit for the Wetland Conservation Act, I recommend that the City Council approves the wetland replacement plan for the Majestic Development Project.
