CONSIDER APPROVAL OF A RESOLUTION APPROVING PAYMENT TO
SPRING LAKE TOWNSHIP FOR THE UPGRADE OF MUSHTOWN ROAD
Introduction
Spring Lake Townshi~ is proposing to pave Mushtown Road from the Ponds
Park Entrance to 190 h Street (CR 68) this fall. The project includes 620 feet of
Mushtown Road which is partially located within the City of Prior Lake. The
Township has requested that the City of Prior Lake pay for the improvements
within the City limits.
History
The City of Prior Lake currently maintains a 620 foot unimproved segment of
Mushtown Road within the City. This segment of roadway is gravel and
requires dust control and frequent blading. The segment is located adjacent to
the entrance to the Ponds Park next to the Radanke Farm. .
Current Circumstances
Due to increased road use and maintenance, Spring Lake Township is
proposing to complete subgrade work and pave Mushtown Road to meet a 9-
ton design standard. The proposed project includes Mushtown Road from just
south of the Ponds Park entrance to 190th Street (CR 68).
The Township approached the City on September 15th regarding participation
and met with City staff on September 21st. The Township has requested that
the City contribute $15,872.00 for the portion of roadway within the City as the
Township is unable to assess parcels within the City.
Currently the City spends approximately $1,500.00 annually on dust control
and blading for this segment of Mushtown Road.
This request is not included in the CIP or 2005 budget for the City. However
City Staff feels this project presents an opportunity to partner with the township
to complete a needed road upgrade at a minimal cost to the City. The
anticipated lineal foot cost of $25.60 is very competitive based on our previous
experience with similar projects. Maintenance costs on Mushtown Road
continue to increase due to increased traffic to Ponds Park and development in
the City and townships.
It should be made clear that the City is not paying an assessment for the
roadway improvements. City staff considers this a maintenance contribution
that will eliminate approximately $1,500 in annual City Maintenance costs and
continues the City's partnership with Spring Lake Township.

traffic volumes on Mushtown Road continue to increase; and
the City and Township are partners in maintenance of this road.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA,
that:
1. The recitals set forth above are incorporated herein.
2. City Staff is authorized to make a payment not to exceed $15,872.00 from the Street
Department Budget as a contribution to Spring Lake Township for the improvements to
Mushtown Road.

At the July 14, 2005 Township Board Meeting, the Board ordered a Feasibility Report for the
proposed Mushtown Road Improvements. This study serves as a Feasibility Report under the
Minnesota Chapter 429 improvement requirements used to assess benefiting properties for
improvements undertaken by a municipality.
The project includes minor grading, additional base material placement and compaction, and paving
of Mushtown Road between its southern terminus at 190th Street and the Township boundary with
the City of Prior Lake at Ponds Parkway.

DISCUSSION
In general the proposed improvements consist of adding gravel and/or geotextile fabric to the
existing Mushtown Road roadbed and then paving the improved street base. The proposed
improvements are further detailed in Figures 1 and 3.
Storm Sewer - Based on information provided by the Township, we understand that all existing
culverts under Mushtown Road have been either inspected and deemed adequate as to capacity and
condition or replaced with new culverts of adequate capacity. Therefore, for the purposes of this
report, it is assumed that there will not need to be any further storm sewer (culvert) improvements as
part of this project.
Ponding - Since the existing gravel roadway can be considered impervious surface, and since the
project does not intend to widen the current surface or otherwise add any additional impervious
surface, there will be no requirement for storm water ponding associated with this project.
Streets - Based on information provided by the Township, we understand that the roadbed near the
intersection of 182nd St. has previously been improved through excavation and subsequent
installation of geotextile fabric, sand, and gravel base. Other observations by Township officials
indicate that areas north of the curve which lies just north of 180th St. are typically troublesome in
the spring and may be in need of stabilization through the use of geotextile fabric and additional
gravel base.
Past projects have successfully utilized Asphalt Emulsions to further stabilize base material. Due to
the late schedule being pursued, we are not advising the use of the Emulsion for this project. Since
the emulsion is water based and can take a significant time to fully cure (allow the water to
evaporate), it would be inadvisable to apply late in the fall due to the possibility of freezing
temperatures.
Typical sections are provided in Figure 3 showing the recommended design for different segments of
the roadway. All typical sections shown on Figure 3 are designed to a minimum of9 ton standards
based on assumptions made regarding sub grade soils, existing gravel depths and traffic counts. Nine
ton standards call for a minimum pavement thickness of 3 inches.
Soil borings should be taken prior to final design of the roads to more accurately detennine their
necessary street sections. For the purposes of this report, design sections shown on Figure 3 have
been used to estimate costs.
The horizontal curve just north of 1 80th St. should be evaluated for its compliance with design
standards for the posted speed limit. Superelevating the curve may be a way to meet design speed
standards through the curve. Sight distance will also need to be evaluated to determine the safe
design speed through this area.
Other areas of the roadway should be evaluated with regard to vertical alignment guidelines for the
design speed. These considerations would be part of final design.
Right-of-Way - Mushtown road is currently on easements in favor of the Township with the
exception of a section of the eastern half of the roadway near the north end of the project which is
located within right-of-way owned by the City of Prior Lake.
COST ANALYSIS
The estimated project costs for the improvements and the basis for the estimates are shown below.
The costs below are construction costs. A separate line item is provided for Engineering, Legal,
Contingency, and Administrative Costs, estimated at 25 percent.

ASSESSMENTS/REVENUE
Assessments are proposed to be levied against the benefiting properties. The area to be assessed is
shown in Figure 1. A Preliminary Assessment Roll is shown in Appendix A.
Previously the Township has assessed road improvements on a per parcel basis under the following
schedule of assessments:
Parcel with Direct Access to Improved Road
Parcel with Access to the Improved Road via a Cul-de-sac

The total number of parcels in the assessment area is: 43 (36 direct access, 7 Access off C-D-S).
This assessment scenario would generate revenue of$272,000. The Township's share ofthe project
costs would be $101,731 less the amount charged to the City of Prior Lake for their frontage.
Other viable assessment options include:
Front-foot Basis - Benefiting properties pay assessments based on the per front-foot assessment rate
times their total front footage along the roadway. The rate could be reduced if the Board wished to
take on a percentage of the costs.
The total assessable front footage along the pr~ject is appriximately: 14,600 Feet.
Based 011 the estimated costs and assessable front footage shown above, the Front-foot Assessment
Rate would be $25.60 per lineal foot if the Township wished to recover 100% of the capital costs.
This rate could be charged to The City of Prior Lake for their residents' frontage, since the
Township does not have the ability to assess the parcels within the City. The lone City parcel has a
frontage of620 feet along the east side of the road. At the rate of$25.60/FT, the total charge to the
city would be $15,872.
For "flag lots" and parcels accessing the road through a cul-de-sac, a minimum assessable footage
would be established.
Acre Basis - Benefiting properties pay assessments based on the per acre assessment rate times the
number of benefiting acres. Benefiting acres would be any acreage that could potentially access the
roadway now or upon development.
The total acreage of the assessment area is: 442 Acres.
Based on the estimated costs shown above, the Per Acre Assessment Rate would be $845.55 per acre
if the Township wished to recover 100% of the capital costs. The rate could be reduced if the Board
wished to take on a percentage of the costs.
Potential Parcel Basis - Benefiting properties pay assessments based on the per parcel rate times the
number of potential parcels which would access the roadway in the event of development. Potential
Parcels would be based on current zoning. For example, if the current zoning allows one parcel per
10 acres, a 40 acre parcel would be assessed for 4 potential parcels.
The total number of potential parcels in the assessment area, based on I parcel in 10 acres is: 61.
Based on the estimated costs shown above, the Per Potential Parcel Assessment Rate would be
$6,126.73 per Potential Parcel if the Township wished to recover 100% ofthe capital costs. The rate
could be reduced if the Board wished to take on a percentage of the costs. This rate assumes that
both direct and cul-de-sac accessing parcels are charged the same.
A preliminary assessment roll for the proposed pr~ject is attached in Appendix A.
RECOMMENDATIONS / CONCLUSION
If the Board decides to proceed with this project, we recommend that the affected parties be notified
and that a fonnal public hearing be held. This project is necessary, cost effective, and feasible from
an engineering standpoint.
The project schedule shown below is that of Option 2 as presented at the July 14, 2005 Township
Board meeting. The Board directed us to pursue a project that would generally adhere to this
schedule as much as possible. The project schedule can be modified at any point in the process to
better fit the Township's needs.

2005 Mushtown Road Improvements Reimbursement Agreement between
the Township of Spring Lake and the City of Prior Lake
Whereas the Township of Spring Lake intends to construct improvements on Mushtown Road. a
Township Road, from 190th Street to Ponds Parkway.
And whereas the cost of such improvements is to be partially borne by the adjacent property
owners in the form of special assessments and partially borne by the Township as a whole.
And whereas some of the properties abutting the roadway are part of the city and. therefore.
cannot be assessed by the Township.
Therefore, Spring Lake Township proposes to enter into an agreement with the City of Prior Lake
in which the City agrees to reimburse the Township for a portion of the total project costs equal to
the costs of that portion of the roadway which abuts properties within the City as measured on a
lineal foot basis
The City's frontage is approximately 620 feet Using the rate of $25.60 per lineal front foot. from
the feasibility report and further confirmed from bids taken on September 27. 2005 the City's
share of the project costs would be $15.872,
