Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT OCTOBER 3, 2005 10 C JANE KANSIER, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION APPROVING A PRELIMINARY PLAT TO BE KNOWN AS THE ENCLAVE AT CLEARY LAKE AND CONSIDER APPROVAL OF A RESOLUTION APPROVING THE WETLAND REPLACEMENT PLAN FOR THE ENCLAVE AT CLEARY LAKE Introduction Pulte Homes has applied for approval of a development to be known as The Enclave at Cleary Lake on property located north of 180th Street, west of Revere Way, east of Mushtown Road, and south of Deerfield Drive. The two phased proposal involves a single-family development consisting of 117 dwelling units on approximately 119 acres. The Enclave at Cleary Lake development as proposed will also impact wetlands as part of development. As the responsible local government unit (LGU) for the Wetland Conservation Act (WCA) the City is charged with reviewing and approving or denying the application as required by law. This agenda item requests City Council approval of the preliminary plat and of the Wetland Replacement Plan. History - Preliminary Plat This 119 acre site was annexed by the City in March, 2005. The property is designated for Low to Medium Density Residential (R-UMD) uses on the 2020 Comprehensive Plan Land Use Map and is zoned R-1 (Low Density Residential). The Planning Commission held a public hearing to consider this preliminary plat on September 12, 2005. A copy of the minutes of this meeting is attached to this report. The Planning Commission recommended approval of this preliminary plat subject to the following conditions: 1. In accordance with the agreement between the developer and Spring Lake Township, the developer shall make improvements to 180th Street concurrently with the development of the project. 2. Provide a revised Tree InventorylTree Preservation Plan that demonstrates size and species specific to individual trees detailed on the plan. The plan must also distinguish which trees proposed to be removed will be impacted by future building pads, utility areas, roadways and driveways. 3. Phase II of the project will not be allowed to proceed prior to the necessary upgrades of the lift station as outlined in this report. 4. The Wetland Mitigation Plan dated May 18, 2005 must be approved by the www.cityofpriorlake.com \ EPPi6n~952i.~#:zt.230d j; iFeS{ 952:447'.(1l24iS City. 5. All Engineering Department comments must be addressed. 6. A cash dedication in lieu of land must be paid for any remaining unmet parkland dedication requirements. Historv- Wetland Replacement Plan On January 18, 1994, the City Council passed Resolution 94-01 adopting the permanent rules of the Wetland Conservation Act (WCA) of 1991. Along with this, the Council also assumed the role of local government unit (LGU) for making WCA determinations for landowners. The purposes of WCA are as follows: 1. Achieve a no net loss in the quantity, quality, and biological diversity of Minnesota's existing wetlands; 2. Increase the quantity, quality, and biological diversity of Minnesota's wetlands by restoring or enhancing diminished or drained wetlands; 3. Avoid direct or indirect impacts from activities that destroy or diminish the quantity, quality, and biological diversity of wetlands; and 4. Replace wetland values where avoidance of activity is not feasible or prudent. Current Circumstances The proposed preliminary plat consists of 119 acres to be subdivided into 117 lots for single family dwellings. The following analysis identifies the physical characteristics of this site. Total Site Area: The total site area consists of 118.81 acres. Topoaraphv: This site has a varied topography, with elevations ranging from 940' MSL along the southern side of the largest wetland to 984' MSL towards the southwest corner of the site. Veaetation: There are several stands of trees on this property, particularly in the southwest corner and the east central portion of the site. The project is subject to the Tree Preservation requirements of the Zoning Ordinance. Wetland Replacement Plan: The Enclave at Cleary Lake project wetland replacement plan application proposes to impact 0.71 acres of wetland. The WCA requires wetland mitigation of 1.42 acres for this project. Mitigation of these impacts is proposed via 0.91 acres of on-site new wetland credits and 0.91 acres of on-site Public Value Credits for a total of 1.82 acres of mitigation. The Technical Evaluation Panel (TEP) reviewed the proposed impacts and mitigation on June 1, 2005 and determined that with inclusion of required buffers and additional on-site mitigation that the proposed plan is acceptable. Attached is a copy of the TEP "Findings and Conclusions" for this project, which is the basis for the staff recommendation. Access: Access to the site is from Revere Way and 180th Street. PROPOSED PLAN Densitv/Lots: The preliminary plat consists of 117 lots for single family dwellings and 10 outlots. Density for this development is based on the R-1 district maximum allowed density of 3.6 units per acre. The density (net) for the proposed plat is 1.86 units per acre. The minimum lot area and lot width in the R-1 district is 12,000 sq. ft. and 86 ft at the front building line. The lots range in size from 12,042 square feet to over 25,000 square feet. The proposed lots meet or exceed 86 ft in width at the front building line. The proposed outlots contain ponding, wetlands, and public park areas. Streets: This plan proposes seven new public streets. Trailhead Lane will serve as the main collector within the development. Trailhead Lane will connect to and provide access points from 180th Street and Revere Way. The southwest portion of Trailhead Lane will have a loop road connected to it that is proposed to be known as Cleary Trail. Prairie Way will extend approximately 250 feet off of Cleary Trail and will stub to the southeast property line. Marsch Court and Bluestream Court are cul-de-sacs that will extend approximately 200 feet to the north and south off of Trailhead Lane. In addition, Natures Way is a 420 ft long proposed roadway that will extend to the north off of Trailhead Lane. The developer has provided a concept to demonstrate how Natures Way could accommodate an extension to the north and allow for additional units if the property to the north is developed. Mission Trail will extend 120 ft from Trailhead Lane and will be stubbed to the adjoining property to the south to allow a future connection. The developer has been working with the Spring Lake Township to accommodate necessary road improvements for 180th Street. The developer will be responsible for making necessary road improvements concurrently with the development of the project. SidewalkslTrails: The plan proposes 6,323 ft of 8 ft wide public trails that will extend along the central portion of project from 180th Street to the public park and continue along the northern edge of the single family properties and ultimately to Revere Way. The plan also shows an 8 ft wide public trail extending along the north side of 180th Street and providing for future connections to the City trail system. The plan proposes 1,759 ft of private trails that will extend from the homeowners association park area to Cleary Trail. In addition, 5,257 ft of 5 ft wide sidewalks will extend along the north side of Trailhead Lane, the north and west side of Cleary Lane, the south side of Prairie Way, and the west side of Mission Trail. Parks: A 4.0 acre park is proposed within the west central portion of the project site. The City park site will have City provided amenities including a picnic shelter, half basketball court, play structure area, and small ball field with backstop. In the winter months, the ball field will serve as a pleasure ice rink. An interior trail system will connect the various park uses. Section 1004.1000 of the Subdivision Ordinance requires 10% of the net area of the site for parkland dedication. The net area for the project is 63.01 acres, which would require 6.31 acres for park dedication. The applicant will also receive park dedication credit for a 10ft wide strip of land area where the public trail extends out from the public park and along 180th Street. Any remaining ISSUES: parkland dedication requirements can be satisfied by a cash dedication in lieu of land. In addition, the development is proposed to have a 2.7 acre homeowner's association park. The association park will contain a pavilion and open space. Sanitary Sewer/Water Mains: The site will be served from utilities that will be extended within Revere Way from the Deerfield Industrial Park to the north. An adjacent lift station will service the site. Currently the lift station is managed by the Metropolitan Council and is anticipated to be turned over the City in 2006. The lift station will also need to be upgraded to more fully meet the needs of the City. For that reason, during the Comprehensive Plan Amendment approval for the project site, the Metropolitan Council stipulated that only 60 units could be constructed prior to the upgrade of the lift station. Thus, the plans show the development taking place in two phases. Storm Sewer: The plans show the northern portion of the site (Phase I) having storm water directed to the pond located to the west of Natures Way. The southern portion of the site (Phase II) will have storm water directed to the pond located on the southwest side of the project. The City will need to review the proposed design prior to Final Plat approval. Tree ReDlacement: The applicant has submitted an inventory identifying 3,818 caliper inches of significant trees on the site. The Zoning Ordinance allows up to 25% of the significant caliper inches to be removed for road and utility purposes, and up to 25% for building pads and driveways. The number of significant inches removed over and above these percentages must be replaced at a rate of a 1/2 caliper inch for each inch removed. The plan proposes to remove 1,563 caliper inches of significant trees (40.9%). The tree inventory will need to be revised to specify what percentages of the trees to be removed will be impacted by future roads, utilities, building pads and driveways. The applicant is proposing to plant 582 deciduous trees (2.5 caliper inches minimum) and 154 coniferous trees (6 feet in height minimum). The proposed replacement plan will provide for a total of 1,455 caliper inches of deciduous trees and 154 coniferous trees. The tree replacement plan will meet the Code requirements. A Letter Of Credit will be required as part of the development contract for the replacement trees. LandscaDe Plan: The Subdivision Ordinance requires two front yard subdivision trees per lot. Corner lots require at least four trees. This plat requires a total of 258 subdivision trees. The developer has submitted a landscaping plan identifying a total of 316 subdivision trees. Fees and Assessments: This development will be subject to the standard development fees. In addition, the development will be subject to a lateral assessment for the extension of sewer to the site and cash dedication in lieu of parkland. All of the lots will meet the minimum lot area and lot width requirements. The overall layout of the plat appears appropriate, given the constraints of the site. The applicant must address the conditions as outlined in the report. However, none of these conditions will impact the general design of the proposed plat. For that reason, both the Planning Commission and the staff recommend approval of the preliminary plat, subject to the listed conditions. The staff also recommends the Council approve the Wetland Replacement Plan for the Enclave at Cleary Lake Project. FINANCIAL IMPACT: There is no budget impact as a result of this action. Approval of the project will facilitate the development of the area and increase the City tax base. ALTERNATIVES: The City Council has the following alternatives: 1. Adopt a resolution approving the Preliminary Plat for this development subject to the listed conditions, with the finding that the preliminary plat is consistent with the intent and purpose of the Zoning and Subdivision Ordinances, and adopt a resolution approving the Wetland Replacement plan for the Enclave at Cleary Lake. 2. Deny the Preliminary Plat and the Wetland Replacement Plan on the basis it is inconsistent with the purpose and intent of the Zoning and Subdivision Ordinances. In this case, the Council should direct the staff to prepare a resolution with findings of fact based in the record for the denial of this request. 3. Defer consideration of this item and provide staff with specific direction. The Planning Commission and staff recommend Alternative #1. RECOMMENDED MOTION: A motion and second to adopt a resolution approving the preliminary plat to be known as the Enclave at Cleary Lake, subject to the listed conditions, and a motion and second to adopt a resolution approving the Wetland Replacement Plan. 16200 Eagle Creek Avenue S.E. Prior Lake, MN 55372-1714 RESOLUTION OS-xx A RESOLUTION APPROVING THE PRELIMINARY PLAT TO BE KNOWN AS THE ENCLAVE AT CLEARY LAKE WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, MOTION BY: SECOND BY: The Prior Lake Planning Commission conducted a public hearing on September 12, 2005, to consider an application from Pulte Homes for the preliminary plat to be known as the Enclave at Cleary Lake; and Notice of the public hearing on said preliminary plat has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and All persons interested in this issue were afforded the opportunity to present their views and objections related to the preliminary plat of the Enclave at Cleary Lake for the record at the public hearing conducted by the Planning Commission; and The Planning Commission and City Council have reviewed the preliminary plat according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said preliminary plat to be consistent with the provisions of said ordinances; and The Prior Lake City Council considered an application for preliminary plat approval of the Enclave at Cleary Lake on October 3, 2005; and The City Council has the authority to impose reasonable conditions on a preliminary plat. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. The above recitals are incorporated herein as if fully set forth. 2. The preliminary plat of the Enclave at Cleary Lake is approved subject to the following conditions: a. Call to Order: Chairman Stamson called the September 12,2005 Planning Commission meeting to order at 6:31 p.m. Those present were Commissioners Billington, Ringstad and Stamson, Planning Director Jane Kansier, Planning Coordinator Danette Moore, Planner Jeff Matzke, Assistant City Engineer Larry Poppler and Recording Secretary Connie Carlson. 2. Approval of Minutes: The Minutes from the August 22, 2005, Planning Commission meeting were approved as presented. 4. Consent: None 5. Public Hearings: Commissioner Stamson read the Public Hearing Statement and opened the meeting. A. EP05-158 Pulte Homes has submitted an application for a Preliminary Plat consisting of 118.2 acres to be subdivided into 117 lots for a residential development known as The Enclave at Cleary Lake. This property is located north of 180th Street, west of CSAH 87 (Revere Way), east of Jackson Circle and directly south of the Deerfield Development. Planning Coordinator Danette Moore presented the Planning Report dated September 12, 2005, on file in the office of the City Planning Department. Pulte Homes has applied for approval of a development to be known as The Enclave at Cleary Lake on property located north of 1 80th Street, west of Revere Way, east of Mushtown Road, and south of Deerfield Drive. The two phased proposal involves a single-family development consisting of 117 dwelling units on approximately 119 acres. All of the lots will meet the minimum lot area and lot width requirements. The overall layout ofthe plat appears appropriate, given the constraints of the site. The applicant must address the conditions as outlined in the L:\05 FILES\05 PLAN COMMISSION\05 MINUTES\MN091205.doc 1 Planning Commission Minutes September 12, 2005 report. However, none of these conditions will impact the general design of the proposed plat. For that reason, if the Planning Commission finds it appropriate, the plat can proceed to the City Council, subject to conditions. The staff recommended the following conditions: 1. In accordance with the agreement between the developer and Spring Lake Township, the developer shall make improvements to 180th Street concurrently with the development of the project. 2. Provide a revised Tree Inventory/Tree Preservation Plan that demonstrates size and species specific to individual trees detailed on the plan. The plan must also distinguish which trees proposed to be removed will be impacted by future building pads, utility areas, roadways and driveways. 3. Phase II of the project will not be allowed to proceed prior to the necessary upgrades of the lift station as outlined in this report. 4. The Wetland Mitigation Plan dated May 18, 2005, must be approved by the City. 5. All Engineering Department comments must be addressed. 6. A cash dedication in lieu of land must be paid for any remaining unmet parkland dedication requirements. There were no questions from the Commissioners. Comments from the Public: Tina Goodroad ofPulte Homes, thanked staff for all their help. Goodroad presented page 9 of the proposal and explained the trail; landscaping and monument signs. There have been no changes in the plan since the neighborhood meeting on May 10th. Ringstad questioned the home sale price. Goodroad responded around $500,000. Billington questioned if there were any concerns from the neighbors. Goodroad said a few township residents would like the area to remain rural. Byron Millenacker, 18000 Mushtown Road, stated his objection to the project as Spring Lake Township is mandating the residents to pay for the rest ofthe pavement on Mushtown Road. He felt the developer should pay their own way. It is not up to the residents to pay for Pulte Homes who is already making thousands of dollars on this project. If Mushtown Road is paved there will be more demand for development in the Spring Lake Township area. The annexation agreement was just signed two years ago however it was believed it would be twenty years before this area would develop. The agreement should be not sidestepped. The other concern is for traffic on Mushtown Road. Billington questioned if the paving and infrastructure costs were discussed at the neighborhood meeting. Millenacker said it was not and went on to say Pulte should pay for all the road improvements. Margaret Squires, 17320 Deerfield Drive, said she was confused with the wetlands. Kansier explained the wetland impacts. The large wetland will not be impacted in any way. The public hearing was closed at 6:52 p.m. Comments from the Commissioners: Ringstad: . Questioned the pavement of 1 80th to Mushtown Road. Kansier responded Pulte would be paying for it. . Read the report - very few issues. . Support. . Does not know if the road upgrade the resident (Millenacker) was referring to was part of the Pulte development. Spring Lake Township makes that decision. Billington: . Based on the material presented and the testimony, I will support. Stamson: . Agreed with Commissioners - it is a straightforward development. . Typical single family development - fits the area. . As far as the Mushtown Road upgrade comment - agreed with Ringstad - the Township has decided to pave the road with all the traffic from the southern part ofthe township. It has nothing to do with Pulte's development. . Overall the development fits. . Support. MOTION BY BILLINGTON, SECOND BY RINGSTAD, RECOMMENDING APPROVAL OF THE PRELIMINARY PLAT SUBJECT TO THE LISTED CONDITIONS. Vote taken indicated ayes by all. MOTION CARRIED. This item will go before the City Council on October 3,2005. B. 05-191 Dahle Brothers, Inc., is requesting a variance from the minimum front yard; shoreland setback and impervious surface coverage for property owner David Huberty located at 3051 Spring Lake Road SE.
